The Attorney General for India is the chief legal advisor of the Government of India. The attorney general is appointed by the President of India at the instance of the Union Cabinet under Article 76(1) of the Constitution and hold office during the pleasure of the President. The Attorney General must meet the qualifications necessary for an appointment as a Judge of the Supreme Court. Therefore, the Attorney General should have served as a judge in a high court for a minimum of five years, or as an advocate in a high court for at least ten years. Alternatively, the President may consider an individual as eligible for the role if they are deemed an eminent jurist.
R. Venkataramani is the incumbent Attorney-General for India. He succeeded to the office as the 16th Attorney-General on 1 October 2022. His predecessor was K. K. Venugopal. [1]
The attorney general is necessary for advising the Government of India on legal matters referred to them. The attorney general also perform other legal duties assigned to by the President. Article 88 of the Constitution confers on the attorney general has the right of audience in all Courts in India as well as the right to participate in the proceedings of the Parliament, though not to vote. [2] The attorney general appears on behalf of Government of India in all cases (including suits, appeals and other proceedings) in the Supreme Court in which Government of India is concerned. The attorney general also represent the Government of India in any reference made by the President to the Supreme Court under Article 143 of the Constitution.
Unlike the Attorney General of the United States, the Attorney General of India has no executive authority. Those functions are performed by the Law Minister of India. Also the AG is not a government servant and is not debarred from private legal practice.
The Attorney General is permitted to receive briefs; however, they are precluded from advocating against the government. Moreover, the Attorney General is restricted from representing an accused party in criminal proceedings and assuming a directorial role in a company without the explicit consent of the government.
The attorney general is assisted a Solicitor General and Additional Solicitor Generals. [2] The attorney general is to be consulted only in legal matters of real importance and only after the Ministry of Law has been consulted. All references to the attorney general are made by the Law Ministry.
Fee and allowances payable to the law officers (including Attorney General for India, Solicitor General of India and the Additional Solicitors General) of the Government of India are as under: [3]

In addition to the above fee payable for cases, a retainer fee is paid to the attorney general for India, Solicitor General of India and the Additional Solicitors General at the rate of ₹50,000, ₹40,000 and ₹30,000 per month, respectively. Moreover, the attorney general for India is also paid a sumptuary allowance of Rs. 4,000 per month, except during the period of his leave.
It has evolved into a customary practice for the Attorney General to submit their resignation upon the inception of a new government. As the appointee of the government, the Attorney General serves as its advocate, implying a lack of complete neutrality. Nevertheless, holding a constitutional mandate, the Attorney General's viewpoints are subject to public scrutiny. Nonetheless, instances have arisen where the Attorney General's positions appear to have been notably influenced by political considerations. [4]
During some of the AG tenures, it has been felt that the attorney general has gone too far. Niren De during Indira Gandhi replied to a question by Hans Raj Khanna stating that even the right to life can be suspended during emergency.[ citation needed ]
Similarly, in 2005, when the UPA government was planning a possible coalition with Mayawati, Milon K. Banerjee's opinion absolving Mayawati in the Taj corridor case was ignored by the Supreme Court. [5] In a direct condemnation of the government which asked the CBI to heed attorney general Milon Banerjee's opinion and close the case against Mayawati, the Supreme Court told the agency not to go solely on the AG's opinion and place all evidence before it. [6]
In 2009, Milon K. Banerjee's opinion absolving Ottavio Quattrocchi in the Bofors scandal has also been viewed as "devaluing and eroding the Attorney General's position". [4]
During the UPA-II government (2009–2014), the conduct of Attorney General Goolam Vahanvati was criticised in a number of cases. In 2G spectrum case, he became the first attorney general in India's history who had to testify as a witness in a corruption case in a trial court. [7] [8] In late April 2013, in coal-gate scandal, Vahanvati was accused of misrepresenting facts in the top-most court of India. [9] Again in the same case, Vahanvati's role came under scrutiny after allegations of impropriety and coercion emerged from his junior law officer, Harin P. Raval, who resigned from the post of Additional Solicitor General as a result. [10]

A barrister is a type of lawyer in common law jurisdictions. Barristers mostly specialise in courtroom advocacy and litigation. Their tasks include arguing cases in courts and tribunals, drafting legal pleadings, researching the law and giving legal opinions.
In most common law jurisdictions, the attorney general or attorney-general is the main legal advisor to the government. In some jurisdictions, attorneys general also have executive responsibility for law enforcement, prosecutions or even responsibility for legal affairs generally. In practice, the extent to which the attorney general personally provides legal advice to the government varies between jurisdictions, and even between individual office-holders within the same jurisdiction, often depending on the level and nature of the office-holder's prior legal experience.
An "advocate" is a professional in the field of law. Different countries and legal systems uses the term with somewhat differing meanings. The broad equivalent in many English law–based on jurisdictions could be a barrister or a solicitor. However, in Scottish, Manx, South African, Italian, French, Spanish, Portuguese, Scandinavian, Polish, Israeli, South Asian and South American jurisdictions, "advocate" indicates a lawyer of superior classification.
A solicitor is a legal practitioner who traditionally deals with most of the legal matters in some jurisdictions. A person must have legally-defined qualifications, which vary from one jurisdiction to another, to be described as a solicitor and enabled to practise there as such. For example, in England and Wales a solicitor is admitted to practise under the provisions of the Solicitors Act 1974. With some exceptions, practising solicitors must possess a practising certificate. There are many more solicitors than barristers in England; they undertake the general aspects of giving legal advice and conducting legal proceedings.
A solicitor general or solicitor-general, in common law countries, is usually a legal officer who is the chief representative of a regional or national government in courtroom proceedings. In systems that have an attorney-general, the solicitor general is often the second-ranked law officer of the state and a deputy of the attorney-general. The extent to which a solicitor general actually provides legal advice to or represents the government in court varies from jurisdiction to jurisdiction, and sometimes between individual office holders in the same jurisdiction.
A bar association is a professional association of lawyers as generally organized in countries following the Anglo-American types of jurisprudence. The word bar is derived from the old English/European custom of using a physical railing to separate the area in which court business is done from the viewing area for the general public.
The Solicitor General of India (SGI) is subordinate to the Attorney General for India. The SGI is the second-highest law officer of the country, assists the Attorney General, and is assisted by Additional Solicitors General of India (Addl. SGIs). The SGI and the Addl. SGIs advise the Government and appear on behalf of the Union of India in terms of the Law Officers (Conditions of Service) Rules, 1972. However, unlike the post of Attorney General for India, which is a Constitutional post under Article 76 of the Constitution of India, the posts of the Solicitor General and the Additional Solicitors General are merely statutory.

The Ministry of Law and Justice in the Government of India is a cabinet ministry which deals with the management of the legal affairs, legislative activities and administration of justice in India through its three departments namely the Legislative Department and the Department of Legal Affairs and the Department of Justice respectively. The Department of Legal Affairs is concerned with advising the various Ministries of the Central Government while the Legislative Department is concerned with drafting of principal legislation for the Central Government. The attorney general of Sri Lanka is the Sri Lankan government's chief legal adviser, and its primary lawyer in the Supreme Court of Sri Lanka. The attorney general is usually a highly respected senior advocate, and is appointed by the ruling government. The current attorney general is Sanjay Rajaratnam. The president does not have any power to make orders, mandatory or otherwise, to the attorney general. He heads the Attorney General's Department which is the public prosecutor.
Kottayan Katankot Venugopal is an Indian constitutional lawyer and a senior advocate in the Supreme Court of India. He was enrolled as an advocate on January 27, 1954. On 1 July 2017, he was appointed as the Attorney General of India and retired on 30 September 2022. He is Patron of SAARCLAW and earlier has been its President. He is founder of M K Nambyar SAARCLAW Centre For Advanced Legal Studies at the NALSAR University of Law.
The Office of the Solicitor General of the Philippines, formerly known as the Bureau of Justice, is an independent and autonomous office attached to the Department of Justice. The OSG is headed by Menardo Guevarra.
Goolamhussein Essaji Vahanvati was an Indian senior counsel who served as the 11th Attorney General for India. His first term in office began in June 2009 and was for three years.
Milon Kumar Banerji was an Indian jurist who was Attorney General of India from 1992 to 1996 and again from 2004 to 2009. He was also Solicitor General from 1986 to 1989. He died on 20 July 2010 after a long illness, having suffered a stroke in December 2009. He was 82.
Gourab Banerji is a Senior Advocate appearing in varied cases before the Indian courts and in many domestic and international arbitrations in India and overseas. He is an alumnus of Cambridge University (1986-1989), from where he graduated with First Class Honours, and has been practicing in India since 1990. As an Additional Solicitor General of India in the Supreme Court (2009-2014), he represented the Union of India in many sensitive and landmark cases. Banerji has also been appointed amicus curiae by the Courts in several matters relating to land laws, international commercial arbitration, Supreme Court practice and procedure, as well as indirect tax. He is also an Overseas Associate at the Essex Court Chambers, London.
Raju Ramachandran is a senior advocate at the Supreme Court of India and a former Additional Solicitor General. He served as an amicus curiae for the Supreme Court of India in the 2002 Gujarat riots case and in the appeal of Ajmal Kasab in the 2008 Mumbai attacks case.
Sidharth Luthra is a senior advocate at the Supreme Court of India. In July 2012, Sidharth Luthra was appointed as the Additional Solicitor General of India at the Supreme Court and represented the union and various state governments in matters relating to fundamental rights, electoral reforms, criminal law and policy issues. He resigned from this position in May 2014. He is the son of K.K. Luthra who was also a senior advocate and brother of senior advocate Geeta Luthra.
The National Judicial Appointments Commission (NJAC) was a proposed body which would have been responsible for the recruitment, appointment and transfer of judicial officers, legal officers and legal employees under the government of India and in all state governments of India. The commission was established by amending the Constitution of India through the 99th constitution amendment with the Constitution (Ninety-Ninth Amendment) Act, 2014 or 99th Constitutional Amendment Act-2014 passed by the Lok Sabha on 13 August 2014 and by the Rajya Sabha on 14 August 2014. The NJAC would have replaced the collegium system for the appointment of judges as invoked by the Supreme court via judicial fiat by a new system. Along with the Constitution Amendment Act, the National Judicial Appointments Commission Act, 2014, was also passed by the Parliament of India to regulate the functions of the National Judicial Appointments Commission. The NJAC Bill and the Constitutional Amendment Bill, was ratified by 16 of the state legislatures in India, and subsequently assented by the President of India Pranab Mukherjee on 31 December 2014. The NJAC Act and the Constitutional Amendment Act came into force from 13 April 2015.
R. Venkataramani is an Indian constitutional lawyer and a Senior Advocate in the Supreme Court of India. He is currently serving as the 14th Attorney-General for India. He was appointed as a Member, Law Commission of India in 2010. He has been appearing for the State of Tamil Nadu as a Special Senior Counsel for the past 12 years and also acting as Special Senior Counsel for the State of Andhra Pradesh.
