Bangladesh Bar Council is a statutory autonomous body in Bangladesh, established under the Legal Practitioners and the Bar Council Order. [1] [2] It is the licensing and Regulatory body for lawyers in Bangladesh. [3]

The bar council can establish tribunals to investigate and prosecute complaints against lawyers. In 2019 there were five such tribunals. A tribunal may reprimand or suspend a lawyer or remove them from practice. It dealt with 378 complaints from 2014 to 2018. Nine lawyers have lost their license permanently and 6 were suspended for a limited period of time. [4]

History

The council was established in 1972 through the Legal Practitioners and the Bar Council Order. It has 15 members including the Attorney General of Bangladesh. It publishes a legal journal called Bangladesh Legal Decisions. [5] Members are elected to the council. [6]

Muhammad Jamiruddin Sarkar is a Bangladeshi lawyer and politician who served as the acting President of Bangladesh in 2002. He served as the Speaker of the Parliament of Bangladesh. He is one of the founding members of the Bangladesh Nationalist Party and was a member of the standing committee, which was the policy making body of the party, from its inception.

The Ghana Bar Association (GBA) is a professional association of lawyers in Ghana, including what used to be called solicitors and barristers but they are now called legal practitioners, as well as magistrates.By convention, all lawyers admitted to practice in Ghana become automatic members of the association. The GBA has its roots in the Gold Coast Bar Association, the first president was Sierra Leonean lawyer Francis (Frans) Dove. The Scottish Legal Complaints Commission (SLCC) is a non-departmental public body responsible dealing with unresolved complaints against legal practitioners operating in Scotland. It was established under the Legal Profession and Legal Aid (Scotland) Act 2007 and came into operation on 1 October 2008, replacing the Scottish Legal Services Ombudsman.

The term judicial review is not expressly used in Bangladeshi law, but Article 102 of the Constitution of Bangladesh allows writ petitions to be filed at the High Court Division for reviewing the actions of public authorities, or suspending proceedings in lower courts. The article has caused significant judicial activism in Bangladesh. In the 1970s, Article 102 was employed by the courts to set a precedent for invalidating detentions under the Special Powers Act. The courts have struck down constitutional amendments and enforced democratic local government under Article 102. The scope of such judicial review has expanded greatly since Justice Mustafa Kamal formally accepted public interest litigation for the first time in 1996, allowing associations and NGOs espousing the public's cause to file for judicial review.

Members of the Bar Council are elected from among members enrolled and practicing as lawyers practicing law in the state of Gujarat and they represent the state in Bar Council of India meetings. Segopotje Sheila Mphahlele is a South African judge who is currently serving as the Judge President of the Mpumalanga High Court. Formerly an attorney and insolvency practitioner, she has been a judge of the High Court of South Africa since December 2013.
