The Department of the Attorney General (DotAG) is the current Western Australian government department responsible for the provision of high quality and accessible justice, legal, registry, guardianship and trustee services to meet the needs of the community and the Western Australian Government. [1]

Western Australia state in Australia

Western Australia is a state occupying the entire western third of Australia. It is bounded by the Indian Ocean to the north and west, and the Southern Ocean to the south, the Northern Territory to the north-east, and South Australia to the south-east. Western Australia is Australia's largest state, with a total land area of 2,529,875 square kilometres, and the second-largest country subdivision in the world, surpassed only by Russia's Sakha Republic. The state has about 2.6 million inhabitants – around 11 percent of the national total – of whom the vast majority live in the south-west corner, 79 per cent of the population living in the Perth area, leaving the remainder of the state sparsely populated.

History

The original Department of Attorney General existed between 1891 and 1909. [2]

The subsequent department between 1909 and 1993 was named the Crown Law Department and was the longest lasting entity under the one name. [3]

In 1993 the Ministry of Justice was formed by the amalgamation of the former Corrective Services and Crown Law Departments and the Youth Justice Bureau, as well as some of the functions of the Ministry of Consumer Affairs. [4] During which time, the Ministry of Justice formed an SDA with the Department of Infrastructure, Regional Development and Cities in order to provide the administration of justice to the external territories of Christmas Island and Cocos (Keeling) Islands. The Department of Infrastructure, Regional Development and Cities is an Australian Public Service department of the Government of Australia charged with the responsibility for infrastructure and major projects, transport, local government, external territories administration, rural and regional development, population policy, and cities.

Christmas Island Australian external territory

The Territory of Christmas Island is an Australian external territory comprising the island of the same name. Christmas Island is located in the Indian Ocean, around 350 kilometres (220 mi) south of Java and Sumatra and around 1,550 kilometres (960 mi) north-west of the closest point on the Australian mainland. It has an area of 135 square kilometres (52 sq mi).

Cocos (Keeling) Islands Australian external territory

The Territory of Cocos (Keeling) Islands is an Australian external territory in the Indian Ocean, comprising a small archipelago approximately midway between Australia and Sri Lanka and closer to the Indonesian island of Sumatra. It is part of Southeast Asia and is in the Southern Hemisphere. The territory's dual name reflects that the islands have historically been known as either the Cocos Islands or the Keeling Islands.

Then it was changed to the Department of Justice between 2001 and 2006. [7]

On 1 February 2006, the Department of Justice was abolished, and functions of the department passed to two newly formed departments: the Department of the Attorney General and the Department of Corrective Services.. [8]

Solicitor General

The principal legal adviser to the Attorney General is the Solicitor-General who is described as the second law officer of the State. The Office of the Solicitor General was created with the Solicitor General Act (1969). [10]

While the Attorney General is a political appointment, the Solicitor General is an independent position. The Attorney General may delegate functions to the Solicitor General.

On 10 October 2018, Joshua Thomson SC was appointed Solicitor General for a term of 5 years. [11] He replaced Peter Quinlan SC , who was appointed Chief Justice of Western Australia.

The Honourable Justice Duncan James Colquhoun Kerr is a Judge of the Federal Court of Australia and served as President of the Administrative Appeals Tribunal from 2012 to 2017.

The Solicitor General of India is subordinate to the Attorney General of India. He is the second law officer of the country, assists the Attorney General, and is himself assisted by four Additional Solicitors General for India. Currently solicitor general of India is Tushar Mehta. Like the Attorney General for India, the Solicitor General and the Additional Solicitors General advise the Government and appear on behalf of the Union of India in terms of the Law Officers Rules, 1972. However, unlike the post of Attorney General for India, which is a Constitutional post under Article 76 of the Constitution of India, the posts of the Solicitor General and the Additional Solicitors General are merely statutory. A justice ministry, ministry of justice, or department of justice is a ministry or other government agency in charge of the administration of justice. The ministry or department is often headed by a minister of justice or secretary of justice. In countries where this agency is called a department the head of the department is entitled attorney general, for example in the United States. Monaco is an example of a country that does not have a ministry of justice, but rather a Directorate of Judicial Services that oversees the administration of justice. Vatican City, a country under the sovereignty of the Holy See, also does not possess a ministry of justice. The legislative body is overseen by the President of the Pontifical Commission for Vatican City State.

The New South Wales Department of Justice, a department of the New South Wales Government, is responsible for the administration and development of a just and equitable legal system of courts, tribunals, laws and other mechanisms that further the principles of justice in New South Wales.

The Law Reform Commission of Western Australia is a commission to investigate, review and advise on the reform of the law in Western Australia, a state of Australia. The present commission came into existence on 31 October 1972.

The Aboriginal Community Court is the name given to the specialised courts dealing with indigenous offenders in the Australian State of Western Australia. The proceedings are conducted in the Magistrates Court of Western Australia. The court is not an actual court, but it is the commonly referred to designation of the court when dealing with indigenous offenders accused of crime. This is to show its distinctiveness from the usual procedures involved in that criminal court, but also to demonstrate that the same court structure deals with both indigenous and non-indigenous offenders.

Attorney Generals Office (United Kingdom) United Kingdom government ministerial department

Department of Justice and Attorney-General (Queensland)

The Department of Justice and Attorney-General (DJAG) is a department of the Queensland Government with responsibilities for the administration of justice, support to Queensland courts, regulatory policy and consumer protection, legal aid, youth justice, corrective services, and other community and legal services.

Peter Damien Quinlan is the Chief Justice of Western Australia. His appointment was announced on 1 August 2018, and took effect on 13 August. He was the Solicitor-General of Western Australia from 2016 to 2018.
