Election of the Provisional Head of the Italian State (June 26, 1947)
Enrico De Nicola submitted his resignation in June 1947, officially for health reasons, but also to regain legitimacy after the annual term of the Constituent Assembly of Italy, to which even his term was tied, had expired.
Enrico De Nicola, was an Italian jurist, journalist, politician, and provisional Head of State of republican Italy from 1946 to 1948. Afterwards, he became the first President of Italy on 1 January 1948.
The Italian Constituent Assembly was a parliamentary chamber which existed in Italy from 25 June 1946 until 31 January 1948. It had the task to write a constitution for the Italian Republic, which had replaced the Kingdom of Italy after the Italian civil war.
Enrico De Nicola, however, was still re-elected as Provisional Head of State; from 1 January 1948 he assumed the title of President of the Italian Republic in accordance with the first final provision of the Constitution of Italy.
The Constitution of the Italian Republic was enacted by the Constituent Assembly on 22 December 1947, with 453 votes in favour and 62 against. The text, which has since been amended 15 times, was promulgated in the extraordinary edition of Gazzetta Ufficiale No. 298 on 27 December 1947. The Constituent Assembly was elected by universal suffrage on 2 June 1946, at the same time as a referendum on the abolition of the monarchy. The Constitution came into force on 1 January 1948, one century after the Statuto Albertino had been enacted. Although the latter remained in force after Benito Mussolini's March on Rome in 1922, it had become devoid of substantive value.

An institutional referendum was held in Italy on 2 June 1946, a key event of Italian contemporary history. Until 1946, Italy had been a kingdom ruled by the House of Savoy, kings of Italy since the Risorgimento and previously rulers of Savoy. However, Benito Mussolini imposed fascism after the 28 October 1922 March on Rome, eventually engaging Italy in World War II alongside Nazi Germany. The popular referendum resulted in voters favouring the replacement of the monarchy with a republic. Monarchists had suspicions of fraud, but were never able to prove these. A Constituent Assembly was elected at the same time.

The Constitution of the Republic of China is the supreme law in the Republic of China. It was ratified by the Kuomintang led National Constituent Assembly session on December 25, 1946 in Nanking and adopted on December 25, 1947. Though the Constitution was intended for the whole China, it has never extensively nor effectively been implemented in any territory. In response to the outbreak of Chinese Civil War by the time of the constitution's promulgation, the newly elected National Assembly soon ratified the Temporary Provisions against the Communist Rebellion on May 10, 1948. The Temporary Provisions symbols the country's entering into the state of emergency and granted the Kuomintang led government of the Republic of China extra-constitutional powers.
A constituent assembly or constitutional assembly is a body or assembly of popularly elected representatives composed for the purpose of drafting or adopting a constitutional-type document. The constituent assembly is a subset of a constitutional convention elected entirely by popular vote; that is, all constituent assemblies are constitutional conventions, but a constitutional convention is not necessarily a constituent assembly. As the fundamental document constituting a state, a constitution cannot normally be modified or amended by the state's normal legislative procedures; instead a constitutional convention or a constituent assembly, the rules for which are normally laid down in the constitution, must be set up. A constituent assembly is usually set up for its specific purpose, which it carries out in a relatively short time, after which the assembly is dissolved. A constituent assembly is a form of representative democracy.
