The Hindu Widows' Remarriage Act 1856, also Act XV, 1856, passed on 16 July 1856, legalised the remarriage of widows in all jurisdictions of India under East India Company rule.The act was enacted on 26 July 1856. [1] It was drafted by Lord Dalhousie and passed by Lord Canning before the Indian Rebellion of 1857. It was the first major social reform legislation after the abolition of sati pratha in 1829 by Lord William Bentinck. [2] [3] [4] [5] [6] [7]

To protect what it considered family honour and family property, Hindu society had long disallowed the remarriage of widows, even child and adolescent ones, all of whom were expected to live a life of austerity and abnegation. [8] The Hindu Widows' Remarriage Act of 1856, [9] provided legal safeguards against loss of certain forms of inheritance for remarrying a Hindu widow, [8] though, under the Act, the widow forsook any inheritance due her from her deceased husband. [10] Especially targeted in the act were child widows whose husbands had died before consummation of marriage.

Vidyasagar's argument based on Hindu Dharma Sastras

Ishwar Chandra Vidyasagar, a Brahmin and a Sanskrit scholar was the most prominent campaigner of widow remarriage. He petitioned the Legislative council, [11] but there was a counter petition against the proposal with nearly four times more signatures by Radhakanta Deb and the Dharma Sabha. [12] [13] Eventhough Vidyasagar faced huge opposition from Hindu orthodox groups and he put use of his prodigious knowledge of Sanskrit to make an exhaustive search of authentic Hindu scriptures on law (i.e. Dharma sastras) to find support for his cause of Widow remarriage. He stumbled upon few verses in Parasara Smriti written by none than sage Parashara himself, which supported Widow remarriage.

Author Subal Chandra Mitra, writer of biography of Vidyasagar in 1902, mentions that moment of Vidyasagar's response: "After infinite toil and pains, one night, he suddenly bounced up in ecstasy and cried out loudly: — 'I have, at last, found it.'." [sic] [14] The verse is

Naṣṭe mṛte praprajite klibeca patite patau
Pañcasvāpatsu nārīṅāṃ patiranyo vidhīyate (Parāśara smṛti 4-30)

"1. On loss of a husband who went abroad, 2. on his death, 3. on his turning into a Sanyasi, 4. on his being an impotent, or 5. on his sinful degradation, — under any one of these five calamities, it is sanctioned for (those) women to take another husband."

Based on the above evidence, Vidyasagar made a convincing argument that sage Parashara suggested three choices for a widow, the first one to remarry, second one to remain celibate and the last one to perform Sahagamana . While the second choice was extremely tough in Kali yuga, final one got already banned by British and therefore only prevailing option is the first choice as suggested by Parashara, i.e. to remarry. [17]

Irrevocably, eternally married as a mere child, the death of the husband she had perhaps never known left the wife a widow, an inauspicious being whose sins in a previous life had deprived her of her husband, and her parents-in-law of their son, in this one. Doomed to a life of prayer, fasting, and drudgery, unwelcome at the celebrations and auspicious occasions that are so much a part of many communities of any religion family and community life, her lot was scarcely to be envied.

The Law

Lord Dalhousie personally finalised the bill despite the opposition and it being considered a flagrant breach of customs as prevalent then. [19] [20] Thus, Eswarchandra Vidyasagar changed the fate of Hindu widows across India, which was essential in reforming Hinduism that was submerged in social evils during 19th century. [21]

The preamble and sections 1, 2, and 5 of the Law: [10]

Whereas it is known that, by the law as administered in the Civil Courts established in the territories in the possession and under the Government of the East India Company, Hindu widows with certain exceptions are held to be, by reason of their having been once married, incapable of contracting a second valid marriage, and the offsprings of such widows by any second marriage are held to be illegitimate and incapable of inheriting property; and

Whereas many Hindus believe that this imputed legal incapacity, although it is in accordance with established custom, is not in accordance with a true interpretation of the precepts of their religion, and desire that the civil law administered by the Courts of Justice shall no longer prevent those Hindus who may he so minded from adopting a different custom, in accordance with the dictates of their own conscience, and

Where it is just to relieve all such Hindus from this legal incapacity of which they complain, and the removal of all legal obstacles to the marriage of Hindu widows will tend to the promotion of good morals and to the public welfare;

It is enacted as follows:

  1. No marriage contracted between Hindus shall be invalid, and the issue of no such marriage shall be illegitimate, by reason of the woman having been previously married or betrothed to another person who was dead at the time of such marriage, any custom and any interpretation of Hindu Law to the contrary notwithstanding.
  2. All rights and interests which any widow may have in her deceased husband's property by way of maintenance, or by inheritance to her husband or to his lineal successors, or by virtue of any will or testamentary disposition conferring upon her, without express permission to remarry, only a limited interest in such property, with no power of alienating the same, shall upon her re-marriage cease and determine as if she had then died; and the next heirs of her deceased husband or other persons entitled to the property on her death, shall thereupon succeed to the same ....
  3. Except as in the three preceding sections is provided, a widow shall not by reason of her re-marriage forfeit any property or any right to which she would otherwise be entitled, and every widow who has re-married shall have the same rights of inheritance as she would have had, had such marriage been her first marriage.

Repeal in 1983

The widow remarriage act got repealed in 1983 and six years later Hindu Widows Remarriage and Property act, 1989.

A widow (female) or widower (male) is a person whose spouse has died and has usually not remarried. The state of having lost one's spouse to death is termed widowhood. An archaic term for a widow is "relict," literally "someone left over". This word can sometimes be found on older gravestones. The male form, "widower", is first attested in the 14th century, by the 19th century supplanting "widow" with reference to men.

The Uniform Civil Code is a proposal in India to formulate and implement personal laws of citizens which apply on all citizens equally regardless of their religion, gender and sexual orientation. Currently, personal laws of various communities are governed by their religious scriptures. <span class="mw-page-title-main">Sati (practice)</span> Historical Hindu practice of widow immolation

Sati was a historical practice in India in which a widow sacrifices herself by sitting atop her deceased husband's funeral pyre. Although it is debated whether it received scriptural mention in early Hinduism, it has been linked to related Hindu practices in the Indo-Aryan-speaking regions of India. Greek sources from around 300 BCE make isolated mention of sati, but it probably developed into a real fire sacrifice in the medieval era within the northwestern Rajput clans to which it initially remained limited, to become more widespread during the late medieval era.

Hindu texts present diverse views on the position of women, ranging from feminine leadership as the highest goddess, to limiting gender roles. The Devi Sukta hymn of Rigveda, a scripture of Hinduism, declares the feminine energy as the essence of the universe, the one who creates all matter and consciousness, the eternal and infinite, the metaphysical and empirical reality (Brahman), the soul, of everything. The woman is celebrated as the most powerful and the empowering force in some Hindu Upanishads, Sastras and Puranas, particularly the Devi Upanishad, Devi Mahatmya and Devi-Bhagavata Purana.

<span class="mw-page-title-main">Ishwar Chandra Vidyasagar</span> Indian educator and social reformer

Ishwar Chandra Bandyopadhyay popularly known as Ishwar Chandra Vidyasagar, was an Indian educator and social reformer of the nineteenth century. His efforts to simplify and modernise Bengali prose were significant. He also rationalised and simplified the Bengali alphabet and type, which had remained unchanged since Charles Wilkins and Panchanan Karmakar had cut the first (wooden) Bengali type in 1780.

Hindu law, as a historical term, refers to the code of laws applied to Hindus, Buddhists, Jains and Sikhs in British India. Hindu law, in modern scholarship, also refers to the legal theory, jurisprudence and philosophical reflections on the nature of law discovered in ancient and medieval era Indian texts. It is one of the oldest known jurisprudence theories in the world and began three thousand years ago whose original sources were the Hindu texts.

Parashara was a maharishi and the author of many ancient Indian texts. He is accredited as the author of the first Purana, the Vishnu Purana, before his son Vyasa wrote it in its present form. He was the grandson of the sage Vasishtha and the son of the sage Shakti. There are several texts which give reference to Parashara as an author/speaker. The various texts attributed to him are given in reference to Parashara being the speaker to his student.

Niyoga was a Hindu practice, primarily followed during the ancient period. It was permitted for the widows or wives who had no child by their spouse to procreate a child with another man. The basic purpose of niyoga is to ensure the continuation of the family lineage and to mitigate the financial and social precariousness that a childless widow would have faced in society. Niyoga was forbidden in the Kali age by Brhaspati and other smrti writers. It has been held that niyoga has nothing to do with polyandry. Sir Henry Maine thinks that the Niyoga is of a later date than the Levirate, but J. D. Mayne justified regarding the Levirate as merely an enlarged form of the Niyoga, that came into effect after a man's death. The Niyoga system, which enabled a woman to choose and invite a male with the desirable seed, and bear children.

Widow inheritance is a cultural and social practice whereby a widow is required to marry a male relative of her late husband, often his brother. The practice is more commonly referred as a levirate marriage, examples of which can be found in ancient and biblical times.

<span class="mw-page-title-main">Remarriage</span>

Remarriage is a marriage that takes place after a previous marital union has ended, as through divorce or widowhood. Some individuals are more likely to remarry than others; the likelihood can differ based on previous relationship status, level of interest in establishing a new romantic relationship, gender, culture, and age among other factors. Those who choose not to remarry may prefer alternative arrangements like cohabitation or living apart together. Remarriage also provides mental and physical health benefits. However, although remarried individuals tend to have better health than individuals who do not repartner, they still generally have worse health than individuals who have remained continuously married. The Hindu Succession Act, 1956 is an Act of the Parliament of India enacted to amend, codify and secularize the law relating to intestate or unwilled succession, among Hindus, Buddhists, Jains, and Sikhs. The Act lays down a uniform and comprehensive system of inheritance and succession into one Act. The Hindu woman's limited estate is abolished by the Act. Christian views on divorce find their basis both in biblical sources and in texts authored by the Church Fathers of the early Christian Church, who were unanimous in the teaching regarding the issue.

The Bengal Sati Regulation, or Regulation XVII, A. D. 1829 of the Bengal Code was a legal act promulgated in British India under East India Company rule, by the then Governor-General Lord William Bentinck. The act made the practice of sati or suttee—or the immolation of a Hindu widow on the funeral pyre of her deceased husband—illegal in all jurisdictions of British India and subject to legal prosecution.

The Custom of Paris was one of France's regional custumals of civil law. It was the law of the land in Paris and the surrounding region in the 16th–18th centuries and was applied to French overseas colonies, including New France. Rukhmabai was an Indian physician and feminist. She is best known for being one of the first practicing women doctors in colonial India as well as being involved in a landmark legal case involving her marriage as a child bride between 1884 and 1888. The case raised significant public debate across several topics, which most prominently included law vs tradition, social reform vs conservatism and feminism in both British-ruled India and England. This ultimately contributed to the Age of Consent Act in 1891.

Dharma Sabha was formed in 1830 in Calcutta by Radhakanta Deb. The organization was established mainly to counter the ongoing social reform movements led by protagonists such as Raja Ram Mohun Roy and Henry Derozio. More specifically, the impetus of forming the organization came from a new law enacted by the colonial British rule which banned the barbaric practice of burning widows alive (sati) in the country; the focus of the new association was to repel the law which was seen as an intrusion by the British into the religious affairs of the indigenous people by some sections of the Hindu community. The Dharma Sabha filed an appeal in the Privy Council against the ban on Sati by Lord William Bentinck as, according to them, it went against the assurance given by George III of non-interference in Hindu religious affairs; however, their appeal was rejected and the ban on Sati was upheld in 1832. It published a newspaper called Samachar Chandrika.

Widow chastity was an ideal in traditional Chinese cultural practices and beliefs that honored widowed women and discouraged their remarriage, encouraging them instead to live a life of "virtuous chastity". The idea of widow chastity has a long history in China, but the emphasis on the practice is believed to have its origin among Song dynasty Neo-Confucians, and reached a culmination and eventual end in the Qing era.

In Hinduism, Śāstra pramāṇam refers to the authority of the scriptures with regard to puruṣārtha, the objects of human pursuit, namely dharma, artha, kāma (pleasure) and mokṣa (liberation). Together with smṛti, ācāra, and ātmatuṣṭi, it provides pramana and sources of dharma, as expressed in Classical Hindu law, philosophy, rituals and customs.
