Irene Xavier

Irene Xavier is a Malaysian women's rights activist. She is a prominent member of Friends of Women, Selangor - Persatuan Sahabat Wanita, Selangor (PSWS), a women's rights NGO. She is also a key activist of Suaram, Malaysia's leading human rights organisation.

Irene was one of the 106 people detained under the Internal Security Act (Malaysia) in 1987 during Operation Lalang. As the Internal Security Act is often used to silence dissent, Irene was targeted because of her work as a women's rights activist. In the first 60 days of incommunicado detention, she claimed that she was beaten, humiliated and mentally abused.

The Internal Security Act 1960 was a preventive detention law in force in Malaysia. The legislation was enacted after the Federation of Malaya gained independence from Britain in 1957. The ISA allows for detention without trial or criminal charges under limited, legally defined circumstances. On 15 September 2011, the Prime Minister of Malaysia, Najib Razak said that this legislation will be repealed and replaced by two new laws. The ISA was replaced and repealed by the Security Offences Act 2012 which has been passed by Parliament and given the royal assent on 18 June 2012. The Act came into force on 31 July 2012.

Operation Lalang was a major crackdown between 27 October and 20 November 1987 undertaken by the Royal Malaysian Police, ostensibly to prevent the occurrence of racial riots in Malaysia. The operation saw the arrest of 106 to 119 people—political activists, opposition politicians, intellectuals, students, artists, scientists and others, who were detained without trial under the Internal Security Act (ISA). It was the second largest swoop in Malaysian history involving the ISA since the 13 May riots 18 years earlier. It also involved the revoking of the publishing licenses of two dailies, The Star and the Sin Chew Jit Poh and two weeklies, The Sunday Star and Watan.

The protection of basic human rights is enshrined in Constitution of Malaysia. These include liberty of the person and prohibition of slavery and forced labour. At the national level, legislative measures that exist to prevent human rights violations and abuses can be found in acts and laws on issues that either have a human rights component or relate to certain groups of society whose rights may be at risk of being violated. Human rights groups are generally critical of the Malaysian government and the Royal Malaysia Police. Preventive detention laws such as the Internal Security Act and the Emergency Ordinance 1969 allow for detention without trial or charge and as such are a source of concern for human rights organizations like Suara Rakyat Malaysia.

The Internal Security Act (ISA) of Singapore is a statute that grants the executive power to enforce preventive detention, prevent subversion, suppress organized violence against persons and property, and do other things incidental to the internal security of Singapore. The present Act was originally enacted by the Parliament of Malaysia as the Internal Security Act 1960, and extended to Singapore on 16 September 1963 when Singapore was a state of the Federation of Malaysia.

The Kamunting Detention Centre is a prison camp located in Kamunting, near the town of Taiping, Perak, in Malaysia. The prison is used by the government to detain and interrogate persons arrested under the Internal Security Act (ISA). The detention is also known as Malaysia's Supermax prison or Maximum security prison. It is alleged that this is the site where the Malaysian authorities would hold up political prisoners. Among notable events which prompted widespread use of the ISA were Operation Lalang in 1987 and the years during the Reformasi movement, beginning 1999. The centre has also been used to detain other groups of people declared by the government to be a threat to national security such as terrorists and cults. Some notable groups detained in Kamunting includes the Al-Arqam cult and the Al-Ma'unah terrorist group.

Chng Suan Tze v. Minister for Home Affairs is a seminal case in administrative law decided by the Court of Appeal of Singapore in 1988. The Court decided the appeal in the appellants' favour on a technical ground, but considered obiter dicta the reviewability of government power in preventive detention cases under the Internal Security Act ("ISA"). The case approved the application by the court of an objective test in the review of government discretion under the ISA, stating that all power has legal limits and the rule of law demands that the courts should be able to examine the exercise of discretionary power. This was a landmark shift from the position in the 1971 High Court decision Lee Mau Seng v. Minister of Home Affairs, which had been an authority for the application of a subjective test until it was overruled by Chng Suan Tze.

<i>Teo Soh Lung v Minister for Home Affairs</i>

Teo Soh Lung v Minister for Home Affairs is the name of two cases of the Singapore courts, a High Court decision delivered in 1989 and the 1990 judgment in the appeal from that decision to the Court of Appeal. The cases were concerned with the constitutionality of amendments made to the Constitution of the Republic of Singapore and the Internal Security Act ("ISA") in 1989. The latter statute authorizes detention without trial on security grounds. These amendments had the effect of changing the law on judicial review of executive discretion under the ISA by re-establishing the subjective test enunciated in the 1971 High Court decision Lee Mau Seng v Minister for Home Affairs which had been overruled in 1988 by Chng Suan Tze v Minister for Home Affairs, and limiting the right of judicial review to ensuring compliance with procedures specified in the ISA. In other words, the amendments were intended to render the exercise of power by the President and the Minister for Home Affairs under the ISA to detain persons without trial not justiciable by the courts. Both the High Court and Court of Appeal found that these amendments were constitutional because Parliament had done nothing more than enact the rule of law relating to the law applicable to judicial review. Thus, the amendments validly operated to deprive the applicant Teo Soh Lung of the ability to apply to the courts for judicial review.

Suara Rakyat Malaysia, better known by its abbreviation SUARAM, is a human rights organisation in Malaysia created in 1987 after Operation Lalang, when 106 opposition, unions, activist leaders were detained without trial under the Internal Security Act. In 1989, the detainee support group, ISA detainees and other activist groups decided to form SUARAM, whose primary object was to campaign for the abolition of the ISA and detention without trial. SUARAM later evolved into other areas of human rights and environmental rights.
