Trustee (disambiguation)

Last updated

A trustee is a legal term for a holder of property on behalf of a beneficiary.

Trustee person who holds property, authority, or a position of trust or responsibility for the benefit of another

Trustee is a legal term which, in its broadest sense, is a synonym for anyone in a position of trust and so can refer to any person who holds property, authority, or a position of trust or responsibility to transfer the title of ownership to the person named as the new owner, in a trust instrument, called a beneficiary. A trustee can also refer to a person who is allowed to do certain tasks but not able to gain income, although that is untrue. Although in the strictest sense of the term a trustee is the holder of property on behalf of a beneficiary, the more expansive sense encompasses persons who serve, for example, on the board of trustees of an institution that operates for a charity, for the benefit of the general public, or a person in the local government.

The "trusty system" was a strict system of discipline and security in prisons in parts of the United States that was made compulsory under Mississippi state law but was used in other states as well, such as Arkansas, Alabama, Louisiana, New York and Texas. The method of controlling and working inmates at Mississippi State Penitentiary at Parchman was designed in 1901 to replace convict leasing.

Trusteeism and the trustee system are practices and institutions within certain parishes of the Catholic Church in the United States, under which laypersons participate in the administration of Ecclesiastical Property. When laypersons are among the trustees, the Church seeks agreement with the civil authorities to have the property administered under principles of canon law.

Other uses

The trustee model of representation is a model for how we should understand the role of representatives, and is frequently contrasted with the delegate model of representation. Constituents elect their representatives as 'trustees' for their constituency. These 'trustees' have sufficient autonomy to deliberate and act in favour of the greater common good and the national interest, even if it means going against the short-term interests of their own constituencies. The model provides a solution to the problem of uninformed constituents who lack the necessary knowledge on issues to take an educated position. By contrast, in the delegate model, the representative is expected to act strictly in accordance to a mandate from the represented.
