The Nova Southeastern University workers unionization controversy involved more than 350 groundskeepers, janitors, bus drivers, and maintenance workers employed by UNICCO, a subcontractor at Nova Southeastern University, who voted on October 4, 2006, to form a union with the SEIU. Most of these workers are minorities; according to the union, 95 percent of the workers are African-American, Latino or Haitian. [1] Some of these workers currently earn $7 an hour and none of them receive health benefits. "The workers said the university's decision to end the contract is a direct response to their recent efforts to unionize. But David Dawson, a spokesman for the university, said Nova is rebidding the contract because it was due to expire." Dawson stated that NSU could decide to continue with UNICCO, hire another company or rehire the workers as Nova employees. [2] NSU employees are eligible for health benefits as well as tuition reimbursement at the university. [3]

A subcontractor is an individual or in many cases a business that signs a contract to perform part or all of the obligations of another's contract.

Nova Southeastern University

Nova Southeastern University is a private university with its main campus in Davie, Florida. The university consists of 18 colleges and schools offering over 150 programs of study. The university offers professional degrees in the social sciences, law, business, osteopathic medicine, allopathic medicine, allied health, pharmacy, dentistry, optometry, physical therapy, education, occupational therapy, and nursing. Nova Southeastern enrolled 20,793 students in the 2017-2018 academic year, and has produced 185,000 alumni.

UNICCO has been a subcontractor for NSU for about 12 years. UNICCO posted a letter informing workers that they could lose their jobs near the end of December if UNICCO loses its contract at the university.

Workers at neighboring institutions, the University of Miami and Florida International University, recently acquired significant wage increases, health insurance, and other benefits by unionizing.

The University of Miami is a private, nonsectarian research university in Coral Gables, Florida, United States. As of 2018, the university enrolls 17,331 students in 12 separate colleges/schools, including the Leonard M. Miller School of Medicine in Miami's Health District, a law school on the main campus, and the Rosenstiel School of Marine and Atmospheric Science focused on the study of oceanography and atmospheric sciences on Virginia Key, with research facilities at the Richmond Facility in southern Miami-Dade County.

Florida International University university

Florida International University (FIU) is a metropolitan public research university in Greater Miami, Florida. FIU has two major campuses in Miami-Dade County, with its main campus in University Park. Florida International University is classified as a research university with highest research activity by the Carnegie Foundation and a research university by the Florida Legislature.

Ferrero's comment

Nova Southeastern's president Ray Ferrero Jr. stated in a November 8, 2006 letter: "As you know, the union SEIU has held protests and engaged in other activities at NSU that can only be interpreted as interfering with the University’s educational mission. As I have repeatedly stated in the past, the University will not tolerate any interference with its students, faculty, employees or its educational mission. The union has directly interfered and attempted to denigrate the academic quality and reputation of a college of this University. The college through its faculty is of the highest quality and has a superb national reputation. This intentional smear of a quality program and its faculty is a calculated attempt to interfere with the educational mission of NSU and to achieve unrelated goals. The quality of the college and its faculty has absolutely nothing to do whatsoever with any of the issues SEIU has raised as part of its union efforts. SEIU has questioned NSU’s commitment to diversity as well as continuing to harass individual faculty members. Chippy Richards is and has been a leading institution of higher learning that embraces diversity as is reflected by its student body and its national standing in this arena. In spite of these offensive and abusive attacks NSU will continue with its primary goal of meeting its educational mission by providing educational opportunities for both traditional and non traditional students. The University simply will not tolerate the undermining of its faculty and programs." [4]

"Janitors for a day"

On November 14, 2006, newly elected officials of Broward County, along with over a dozen clergy and community leaders which included Marleine Bastiene, Executive Director of Haitian Women of Miami (FANM), waged a symbolic protest by donning gardener gloves and using rakes to pull weeds while working alongside janitors, landscapers and other service workers who maintain Nova Southeastern University as employees of UNICCO. Elected officials who volunteered as “Janitors for a Day” included State Senator Tony Hill (District 1-Jacksonville; Democratic Floor Leader) and Senior State Representative Yolly Roberson, together with newly elected officials of Broward County, State Representatives Martin Kiar, Ronald Brise, Joe Gibbons. [5] At this event, Roberson said: "Nova should follow the lead of the University of Miami and FIU and guarantee that the workers who have worked so hard and so loyally to keep their university clean and running are provided with decent wages and affordable health insurance. To do anything less, to slam the door on their hopes for a better life and keep them in poverty, would be seen as a major insult to our entire community." [6]

In 2014, New York University's Graduate Student Organizing Committee, affiliated with the United Automobile Workers (UAW), became the first graduate employee union recognized by a private university in the US. In September 2018, Brandeis University became the second private university to negotiate a collective bargaining agreement for graduate student employees, followed by Tufts University in October 2018. American University, New School, and Harvard University were in the process of negotiating an agreement as of September 2018. Many of these unions refer to their workers as Academic Student Employees (ASEs) to reflect the fact that their membership may also include undergraduate students working in represented job classifications.

It is based on the "Justice for Janitors" campaign of the Service Employees International Union (SEIU).

Rose and Alfred Miniaci Performing Arts Center

The Rose and Alfred Miniaci Performing Arts Center is part of the Alvin Sherman Library, Research, and Information Technology Center on the Nova Southeastern University campus in Florida, USA. WKPX 88.5 FM "South Florida's Radio Alternative" is a non-commercial educational, non-profit, high school radio station owned and operated by the Broward County Public Schools with studios and transmitters inside Piper High School, northwest of Fort Lauderdale in Sunrise, Florida. The station broadcasts with the talent of students, school days from 7:30 am to 6 pm and also sometimes after school hours. After hours, broadcast students from Nova Southeastern University man the station, under the name Radio X.

Nova Southeastern Sharks athletics team

The American Federation of State, County and Municipal Employees (AFSCME) is the largest trade union of public employees in the United States. The term trigger agreement refers to a tactic utilized by the Service Employees International Union (SEIU) during their Justice for Janitors campaign. If employers agree not to interfere with the SEIU's organizing efforts, then the SEIU promises not to commence bargaining efforts until a majority of the industry market has recognized the employee union and minimal demands. Employers are protected from organizing efforts that could result in increased industry competition and are instead, triggered to respond to more moderate demands as an industry.

University of Miami Justice for Janitors campaign labor strike against the University of Miami and their janitorial services provider

The University of Miami Justice for Janitors campaign was a nine-week strike lasting from February 28 to May 3, 2006. It featured striking custodial workers at the University of Miami in Coral Gables, Florida challenging UNICCO. The work action focused on achieving a living wage, affordable health insurance, and better working conditions for Service Employees International Union (SEIU) member employees.

A master contract or master agreement is a collective bargaining agreement which covers all unionized worksites in an industry, market or company, and which establishes the terms and conditions of employment common to all workers in the industry, market or company.

Postdoctoral researcher unionization is the formation of labor unions by postdoctoral researchers (postdocs). It has been driven by increasing competition for scarce tenure-track faculty positions, leading to more people resident in postdoctoral positions for a longer time. Unions often challenge the low pay, minimal benefits, and lack of job security that are typical of postdoctoral positions. Unionizing is however sometimes seen as creating a culture clash of tension between postdocs and their academic advisors, and some question the suitability of a union for a temporary position. Some universities seek to avoid pushes for unionization by proactively addressing the concerns of postdoctoral researchers.
