History

The Fifth District Court of Appeal was created by the 1979 session of the Florida Legislature. [1] The addition of the Florida Sixth District Court of Appeal in 2023 changed the caseload of the Fifth DCA.

Previously, the Fifth DCA handled cases from the following counties and circuit courts: Lake, Marion, Sumter, Citrus & Hernando (Fifth Circuit); Volusia, Flagler, Putnam & St. Johns (Seventh Circuit); Orange & Osceola (Ninth Circuit); and Brevard & Seminole (18th Circuit). The Ninth Circuit was reassigned to the Sixth DCA and the Fourth Circuit (Clay, Duval & Nassau) was added from the First DCA. [1]

The Florida First District Court of Appeal, also known as the First DCA, is headquartered in Tallahassee, Florida, the state capital. It is unique among the six Florida District Courts of Appeal in that, much like the U.S. Court of Appeals for the D.C. Circuit at the federal level, it handles most of the appeals in state administrative law matters. It is also solely responsible for handling appeals in workers' compensation cases. It is the Court of Appeals for 29 Florida counties, covering the Panhandle as well as the north-central parts of the state. The First DCA includes the following: First Circuit ; Second Circuit ; Third Circuit ; Eighth Circuit ; and Fourteenth Circuit.

Gerald Bard Tjoflat is an American lawyer and Senior United States circuit judge of the United States Court of Appeals for the Eleventh Circuit. He previously served as a U.S. district judge on the U.S. District Court for the Middle District of Florida from 1970 to 1975 and as a state court judge on the Fourth Judicial Circuit of Florida from 1968 to 1970.

During George H. W. Bush's term in office as the president of the United States of America, he nominated 11 individuals for 10 different federal appellate judgeships who were not processed by the Democratic-controlled Senate Judiciary Committee. The Republicans claim that Senate Democrats of the 102nd Congress on purpose tried to keep open particular judgeships as a political maneuver to allow a future Democratic president to fill them. All 10 of the judgeships were eventually filled with Clinton nominees, although one nominee, Roger Gregory, was nominated by Clinton and then renominated by President George W. Bush. None of the nominees were nominated after July 1, 1992, the traditional start date of the unofficial Thurmond Rule during a presidential election year. Senator Orrin Hatch, the Republican leader of the Senate Judiciary Committee during the 106th Congress mentioned the controversy over President George H.W. Bush's court of appeals nominees during the following controversy involving the confirmation of any more Democratic court of appeals nominees during the last two years of President Bill Clinton's second term.

The Judicial Conference of the United States, formerly known as the Conference of Senior Circuit Judges, was created by the United States Congress in 1922 with the principal objective of framing policy guidelines for administration of judicial courts in the United States. The Conference derives its authority from 28 U.S.C. § 331, which states that it is headed by the chief justice of the United States and consists of the chief justice, the chief judge of each court of appeals federal regional circuit, a district court judge from various federal judicial districts, and the chief judge of the United States Court of International Trade.
