The Air Carrier Access Act of 1986 (ACAA) is Title 49, Section 41705 of the U.S. Code.
The Act amended the earlier section 404(b) of the Federal Aviation Act of 1958 (FAA), which was repealed by the Airline Deregulation Act of 1978. The ACAA prohibits commercial airlines from discriminating against passengers with disabilities. The act was passed by the U.S. Congress in direct response to a narrow interpretation of Section 504 of the Rehabilitation Act of 1973 by the U.S. Supreme Court in U.S. Department of Transportation (DOT) v. Paralyzed Veterans of America (PVA). In PVA, the Supreme Court held that private, commercial air carriers are not liable under Section 504 because they are not "direct recipients" of federal funding to airports. [1]
The Act was construed to contain an implied private right of action. However, in 2001, the U.S. Supreme Court decided Alexander v. Sandoval , [2] which held that federal courts may not find an implied private right unless a statute gives explicit indication that Congress intended to bestow such a right. In 2004, the U.S. Court of Appeals for the Tenth Circuit followed the lead of the US Court of Appeals for the Eleventh Circuit, which relied on the Sandoval decision to hold that the Act can only be enforced by filing an administrative complaint with the DOT. In 2013, the DOT provided new rules requiring all domestic and foreign air carriers to have accessible websites and kiosks. By December 12, 2015, the core functionality of all air carrier's websites needed to be accessible, and by December 12, 2016, the remaining web pages were required to be accessible. [5]
In 2022, it was announced that the DOT had published the Airline Passengers with Disabilities Bill of Rights. It (as stated by the DOT) “describes the fundamental rights of air travelers with disabilities under the Air Carrier Access Act and its implementing regulation, 14 Code of Federal Regulations (CFR) Part 382.” [6] [7]
Since this act prohibits airlines from discriminating against passengers with disabilities, they must allow them to bring along their service animals. In recent years, people were taking advantage of this act. Delta Air Lines released the statistic that they had seen an 84% increase in animal incidents. Not all of the disability animals that came through the doors of Delta Air Lines, however, were actually service animals. [8] Since December 2020, the U.S. Department of Transportation (DOT) does not include emotional support animals in the Air Carrier Access Act, which is the act that allows service animals to fly on airplanes if they meet requirements. [9] Before December 2020, they did include emotional support animals in their definition of service animals (US Department of Transportation, 2020). [10]

It affords similar protections against discrimination to Americans with disabilities as the Civil Rights Act of 1964, which made discrimination based on race, religion, sex, national origin, and other characteristics illegal, and later sexual orientation and gender identity. The Airline Deregulation Act is a 1978 United States federal law that deregulated the airline industry in the United States, removing federal control over such areas as fares, routes, and market entry of new airlines. The act gradually phased out and disbanded the Civil Aeronautics Board, but the regulatory powers of the Federal Aviation Administration (FAA) were not diminished over all aspects of aviation safety.

Southern Sky Air Tours, d/b/a Direct Air was an airline business based in Myrtle Beach, South Carolina, United States. Direct Air started in 2007 and leased aircraft with charter airlines. Its main base was Myrtle Beach International Airport. Direct Air's flights were operated by Sky King, Inc., Xtra Airways, World Atlantic Airlines, and USA Jet. In March 2012 Direct Air ceased operations, stranding many of its passengers. An air operator's certificate (AOC) is the approval granted by a civil aviation authority (CAA) to an aircraft operator to allow it to use aircraft for commercial purposes. This requires the operator to have personnel, assets and systems in place to ensure the safety of its employees and of the flying public. The civil airline industry is entirely privately owned and has been largely deregulated since 1978, while most major airports are publicly owned. The three largest airlines in the world by passengers carried are U.S.-based; American Airlines is number one after its 2013 acquisition by US Airways. Of the world's 50 busiest passenger airports, 16 are in the United States, including the top five and the busiest, Hartsfield–Jackson Atlanta International Airport. In terms of cargo, in 2015, eight of the world's thirty busiest airports were in the U.S., including the world's second-busiest, Memphis International Airport, just behind Hong Kong International Airport in Hong Kong. Private aircraft are also used for medical emergencies, government agencies, large businesses, and individuals.
The European Union Persons with Reduced Mobility (PRM) legislation is intended to ensure that Persons with Reduced Mobility (whether disabled, elderly or otherwise) traveling via public transport, whether by air, land or sea, should have equal access to travel as compared to travelers with unrestricted mobility. Travel providers are compelled to provide and install sufficient access facilities to enable Passenger with Reduced Mobility to enjoy similar access to other passengers (where feasible and with certain safety exemptions).
There are no worldwide uniform standards regulating the provision of assistance for airline passengers with disabilities. American regulations place the responsibility on the airlines, the European Union's rules make the airport responsible for providing the assistance, and in South America there are no regulations at all. The International Air Transport Association (IATA) is concerned about the difficulties caused by inconsistent regulations.
