Christopher Murray Maxwell AC [1] is an Australian jurist. He succeeded Justice John Winneke as President of the Victorian Court of Appeal on 16 July 2005. [2] He retired as President of the Court of Appeal on 15 July 2022, after serving in the role for 17 years. [3]

Career

Maxwell was educated at Melbourne Grammar School and the University of Melbourne where he was resident at Trinity College. [4] He played rugby and Australian rules football at Trinity, where he was the senior student in 1973. After graduating with honours in 1974, he was selected as Victorian Rhodes Scholar for 1975, completing a Bachelor of Philosophy at Oxford University. [4] [2] In 1978, he became a barrister at Lincoln's Inn in London practising briefly at the English Bar. [4] In 1979, he returned to Melbourne working as a solicitor at law firm Phillips Fox. [2] In 1981, he became principal private secretary to ALP Senator Gareth Evans who was appointed as federal Attorney-General in 1983. [2] In 1983, he left to become a barrister in Victoria and was variously reader for Kenneth Hayne QC and reader for Ross Robson QC. [2] [5] He signed the Victorian Bar Roll in 1984 and became a QC in 1998. [2]

Maxwell was a Victorian Legal Aid Commissioner for seven years from 1986 and also a member of the board of Liberty Victoria for six years, two of them as president from 2000. [2] [5] He appeared with Julian Burnside QC in the Tampa refugee case, and was then famously but unsuccessfully countersued (as a board member of Liberty Victoria) by the Commonwealth of Australia for costs. [2] In 1982 he published An Introduction to the Securities Industry Codes (Sydney: Butterworths, 1982) with Robert Baxt and Selwyn Bajada, released in a second edition in 1988 as Stock Markets and the Securities industry: Law and Practice (Sydney: Butterworths, 1988). In 2002, he was later commissioned by the Victorian government to review the Occupational Health and Safety Act 1985. [6]

In 2019, Maxwell heard the high profile County Court appeal of Cardinal George Pell against his conviction for the commission of sexual offences. Maxwell concurred with the Court of Appeal 2-1 majority rejecting the appeal, which was subsequently overruled by the High Court. [7] [8]

During an appeal into a drug importation conviction by Tony Mokbel due to the actions of Nicola Gobbo in providing information to Victoria Police, Maxwell called the actions of Gobbo and others involved in her informing "disgraceful" and a "matter of profound importance". [9]

Maxwell is an adjunct professor at Victoria University. He is married with three children. His wife is a daughter of Sir Ninian Stephen who was a Governor-General of Australia and High Court Justice.[ citation needed ]

Antonios Sajih Mokbel is an Australian criminal who has been convicted of a number of offences, most prominently commercial drug trafficking. He has spent most of his life in Melbourne, Australia. Operation Purana alleged that he is the mastermind behind the Melbourne amphetamine trade. He has been linked to Carl Williams, and charged but not convicted of two murders in the Melbourne gangland war. He disappeared from Melbourne while on trial in March 2006, and was arrested by Greek police in Athens on 5 June 2007. Since being brought back to Australia he has remained incarcerated.

John Spence Winneke, was a judge of the Supreme Court of Victoria and President of the Court of Appeal of the Supreme Court of Victoria, which is the highest ranking court in the Australian state of Victoria.

The Royal Commission into the Management of Police Informants - An inquiry into Victoria Police’s use of Nicola Gobbo as a human source, referred to in the press as Lawyer X Royal Commission, was a royal commission in Victoria, Australia set up to examine the actions of Nicola Gobbo and Victoria Police whilst Gobbo, also referred to as Informer 3838, Lawyer X (media), and EF (litigation), was working as a lawyer and acting as a registered informer. It was announced on 3 December 2018, in response to the High Court AB v CD; EF v CD judgement, and was established on 13 December 2018 under Hon Margaret McMurdo to examine the adequacy and effectiveness of the processes of Victoria Police for the recruitment, handling and management of human sources who are subject to legal obligations of confidentiality or privilege and the effect of using such sources on past cases.

The Kellem review was an Independent Broad-based Anti-corruption Commission (IBAC) inquiry undertaken by Murray Kellam from July 2014 to February 2015 into Victoria Police human source management. The review was initiated in response to newspaper reports about the actions of lawyer Nicola Gobbo in providing information to police.

<i>Pell v The Queen</i> Judgement of the High Court of Australia

Pell v The Queen was a High Court of Australia decision that overturned the conviction of Cardinal George Pell for sexual offences against a child. On 22 June 2017, Victoria Police announced Pell was arrested for historical sexual assault charges on two choirboys at St. Patricks Cathedral in Melbourne. The allegations stemmed from Pell's time spent as Archbishop of Melbourne, and pertained to two anonymous victims referred to throughout the court process as victim 'A' and victim 'B'. B died before the allegations went to trial. Pell was tried twice in the County Court of Victoria.
