Connecticut Environmental Policy Act

The Connecticut Environmental Policy Act (CEPA) establishes environmental policy for the U.S. state of Connecticut. It requires an Environmental Impact Evaluation (EIE) for any state action which could potentially impact the natural environment. The lead agency is responsible for preparing the EIE, which is reviewed and approved by the Office of Policy and Management once it is completed.

State law

Section 22a, Chapter 439 of the Connecticut General Statutes details the state's environmental policy and the EIE requirements of state agencies under CEPA. The objectives of CEPA are described in Section 1(b) of the act:

[I]t is the continuing responsibility of the state government to use all practicable means, consistent with other essential considerations of state policy, to improve and coordinate state plans, functions, programs, and resources to the end that the state may: (1) Fulfill the responsibility of each generation as trustee of the environment for succeeding generations; (2) assure for all residents of the state safe, healthful, productive, and esthetically and culturally pleasing surroundings; (3) attain the widest range of beneficial uses of the environment without degradation, risk to health or safety, or other undesirable and unintended consequences; (4) preserve important historic, cultural, and natural aspects of our Connecticut heritage, and maintain, wherever possible, an environment which supports diversity and variety of individual choice; (5) achieve an ecological balance between population and resource use which will permit high standards of living and a wide sharing of life's amenities; (6) enhance the quality of renewable resources and approach the maximum attainable recycling of depletable resources; and (7) practice conservation in the use of energy, maximize the use of energy efficient systems and minimize the environmental impact of energy production and use. Connecticut Environmental Impact Evaluation

CEPA states that, with a few exceptions, the sponsoring state agency must prepare an EIE before undertaking any action that may have significant impacts on the environment. Like the federal environmental impact statement, the EIE must include a range of alternatives along with the 'No Action' option. The EIE must consider the following impacts for each alternative: [2]

Once the lead agency has completed an EIE, it is made available for public review and comment for 45 days (this period may be extended to 60 days for large or complex actions). Upon the expiration of the review and comment period the lead agency issues a Record of Decision and the EIE is submitted to the State Office of Policy and Management (OPM) for final review of the evaluation's adequacy. If the EIE is found to be inadequate, the OPM will require an EIE supplement from the lead agency, or reject it entirely if the EIE is seriously flawed.

Under CEPA, individuals, citizens' groups, municipal governments, or businesses can petition the Department of Energy and Environmental Protection (DEEP) to hold public hearings on an EIE after it has been released for review and comment. If the DEEP receives a petition containing 25 signatures or from an organization containing 25 members or more, the agency is required by law to hold a public hearing and consider comments submitted during the hearing. While the Office of Policy and Management approves an EIE, the Connecticut State Constitution delegates much of the state's authority to its 169 town governments. This arrangement gives the towns significant veto power over a state project since each affected town must issue its own permits for the portion of a state project within its jurisdiction, even after the state DEEP and OPM have both approved the project.

The majority of Connecticut's towns have ordinances that extend CEPA regulations to activities headed by an agency within the municipal government. Many towns require individuals and businesses to obtain a number of permits before starting a major project. The process of obtaining these permits requires at least some kind of environmental impact analysis and public hearings in most places. For most Connecticut towns the approval authority for issuing local permits rests with the Planning and Zoning Board, although additional approval by the local wetlands or conservation commission is necessary in some towns for a project to proceed.

Exceptions

A federally mandated environmental impact statement (EIS) may be submitted in lieu of an EIE for a federal/state action, as long as the EIS contents meets all of the requirements for an equivalent EIE.

National Environmental Policy Act United States federal environmental law (enacted 1970)

The National Environmental Policy Act (NEPA) is a United States environmental law that promotes the enhancement of the environment and established the President's Council on Environmental Quality (CEQ). The law was enacted on January 1, 1970. To date, more than 100 nations around the world have enacted national environmental policies modeled after NEPA.

Endangered Species Act of 1973 United States Law

The Endangered Species Act of 1973 is the primary law in the United States for protecting imperiled species. Designed to protect critically imperiled species from extinction as a "consequence of economic growth and development untempered by adequate concern and conservation", the ESA was signed into law by President Richard Nixon on December 28, 1973. The Supreme Court of the United States described it as "the most comprehensive legislation for the preservation of endangered species enacted by any nation". The purposes of the ESA are two-fold: to prevent extinction and to recover species to the point where the law's protections are not needed. It therefore "protect[s] species and the ecosystems upon which they depend" through different mechanisms. For example, section 4 requires the agencies overseeing the Act to designate imperiled species as threatened or endangered. Section 9 prohibits unlawful ‘take,’ of such species, which means to "harass, harm, hunt..." Section 7 directs federal agencies to use their authorities to help conserve listed species. The Act also serves as the enacting legislation to carry out the provisions outlined in The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). The Supreme Court found that "the plain intent of Congress in enacting" the ESA "was to halt and reverse the trend toward species extinction, whatever the cost." The Act is administered by two federal agencies, the United States Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS). FWS and NMFS have been delegated by the Act with the authority to promulgate any rules and guidelines within the Code of Federal Regulations (CFR) to implement its provisions.

An environmental impact statement (EIS), under United States environmental law, is a document required by the 1969 National Environmental Policy Act (NEPA) for certain actions "significantly affecting the quality of the human environment". An EIS is a tool for decision making. It describes the positive and negative environmental effects of a proposed action, and it usually also lists one or more alternative actions that may be chosen instead of the action described in the EIS. Several U.S. state governments require that a document similar to an EIS be submitted to the state for certain actions. For example, in California, an Environmental Impact Report (EIR) must be submitted to the state for certain actions, as described in the California Environmental Quality Act (CEQA). One of the primary authors of the act is Lynton K. Caldwell.

California Environmental Quality Act California law requiring environmental concerns be considered during land development

The California Environmental Quality Act (CEQA) is a California statute passed in 1970 and signed in to law by then-Governor Ronald Reagan, shortly after the United States federal government passed the National Environmental Policy Act (NEPA), to institute a statewide policy of environmental protection. CEQA does not directly regulate land uses, but instead requires state and local agencies within California to follow a protocol of analysis and public disclosure of environmental impacts of proposed projects and, in a departure from NEPA, adopt all feasible measures to mitigate those impacts. CEQA makes environmental protection a mandatory part of every California state and local (public) agency's decision making process. It has also become the basis for numerous lawsuits concerning public and private projects.

Environmental impact assessment Assessment of the environmental consequences of a decision before action

Environmental Impact assessment (EIA) is the assessment of the environmental consequences of a plan, policy, program, or actual projects prior to the decision to move forward with the proposed action. In this context, the term "environmental impact assessment" (EIA) is usually used when applied to actual projects by individuals or companies and the term "strategic environmental assessment" (SEA) applies to policies, plans and programmes most often proposed by organs of state. It is a tool of environmental management forming a part of project approval and decision-making. Environmental assessments may be governed by rules of administrative procedure regarding public participation and documentation of decision making, and may be subject to judicial review.

Environmental planning

Environmental planning is the process of facilitating decision making to carry out land development with the consideration given to the natural environment, social, political, economic and governance factors and provides a holistic framework to achieve sustainable outcomes. A major goal of environmental planning is to create sustainable communities, which aim to conserve and protect undeveloped land.

The Canadian Environmental Assessment Act, 2012 and its regulations established the legislative basis for the federal practice of environmental assessment in most regions of Canada from 2012 to 2019. It was repealed with the coming into force of the Impact Assessment Act on August 28, 2019.

Mitigation banking is the preservation, enhancement, restoration or creation (PERC) of a wetland, stream, or habitat conservation area which offsets, or compensates for, expected adverse impacts to similar nearby ecosystems. The goal is to replace the exact function and value of specific habitats that would be adversely affected by a proposed activity or project. The public interest is served when enforcement agencies require more habitat as mitigation, often referred to as a mitigation ratio, than is adversely impacted by management or development of nearby acreage.

Environmental policy of the United States

The environmental policy of the United States is a federal governmental action to regulate activities that have an environmental impact in the United States. The goal of environmental policy is to protect the environment for future generations while interfering as little as possible with the efficiency of commerce or the liberty of the people and to limit inequity in who is burdened with environmental costs. As his first official act bringing in the 1970s, President Richard Nixon signed the U.S. National Environmental Policy Act (NEPA) into law on New Years Day, 1970. Also in the same year, America began celebrating Earth Day, which has been called "the big bang of U.S. environmental politics, launching the country on a sweeping social learning curve about ecological management never before experienced or attempted in any other nation." NEPA established a comprehensive US national environmental policy and created the requirement to prepare an environmental impact statement for “major federal actions significantly affecting the quality of the environment.” Author and consultant Charles H. Eccleston has called NEPA, the world's “environmental Magna Carta”.

Modern United States wind energy policy coincided with the beginning of modern wind industry of the United States, which began in the early 1980s with the arrival of utility-scale wind turbines in California at the Altamont Pass wind farm. Since then, the industry has had to endure the financial uncertainties caused by a highly fluctuating tax incentive program. Because these early wind projects were fueled by investment tax credits based on installation rather than performance, they were plagued with issues of low productivity and equipment reliability. Those investment tax credits expired in 1986, which forced investors to focus on improving the reliability and efficiency of their turbines. The 1990s saw rise to a new type of tax credit, the production tax credit, which propelled technological improvements to the wind turbine even further by encouraging investors to focus on electricity output rather than installation.

<i>Sierra Club v. Babbitt</i>

Sierra Club v. Babbitt, 15 F. Supp. 2d 1274, is a United States District Court for the Southern District of Alabama case in which the Sierra Club and several other environmental organizations and private citizens challenged the United States Fish and Wildlife Service (FWS). Plaintiffs filed action seeking declaratory injunctive relief regarding two incidental take permits (ITPs) issued by the FWS for the construction of two isolated high-density housing complexes in habitat of the endangered Alabama beach mouse. The District Court ruled that the FWS must reconsider its decision to allow high-density development on the Alabama coastline that might harm the endangered Alabama beach mouse. The District Court found that the FWS violated both the Endangered Species Act (ESA) and the National Environmental Policy Act (NEPA) by permitting construction on the dwindling beach mouse habitat.

Exemptions for hydraulic fracturing under United States federal law

There are many exemptions for hydraulic fracturing under United States federal law: the oil and gas industries are exempt or excluded from certain sections of a number of the major federal environmental laws. These laws range from protecting clean water and air, to preventing the release of toxic substances and chemicals into the environment: the Clean Air Act, Clean Water Act, Safe Drinking Water Act, National Environmental Policy Act, Resource Conservation and Recovery Act, Emergency Planning and Community Right-to-Know Act, and the Comprehensive Environmental Response, Compensation, and Liability Act, commonly known as Superfund.

The Donlin Gold Project is a large, undeveloped, refractory gold deposit located 12 miles (19 km) north of Crooked Creek, Alaska on the Kuskokwim River, about 280 miles (450 km) northwest of Anchorage. The deposit has proven and probable reserves estimated to be 33.9 million ounces of gold at a grade of 2.1 g/t and could produce an average of one million ounces annually over a 27-year mine life.

Federal Lands Jobs and Energy Security Act

The Federal Lands Jobs and Energy Security Act is a bill that would require the Bureau of Land Management (BLM) to establish certain fees for activities related to the development of oil and gas on federal lands. A portion of those amounts along with a portion of fees from renewable energy projects on federal lands would be available to the agency, subject to appropriation, to cover the costs of activities aimed at increasing energy development on federal lands. The bill also would exempt lawsuits related to energy production on federal lands from the Equal Access to Justice Act (EAJA). In addition, the legislation would require the BLM to offer for sale at least 25 percent of onshore federal lands nominated by firms for oil and gas leasing. It was introduced in the United States House of Representatives during the 113th United States Congress. President Barack Obama threatened to veto the bill on November 19, 2013.

Responsibly And Professionally Invigorating Development Act of 2013

The Responsibly And Professionally Invigorating Development Act of 2013 is a bill that would aim to expedite the review process required by the National Environmental Policy Act (NEPA) for construction projects that are partly or fully financed with federal funds or require permits or approvals from federal regulatory agencies. It was to do so by establishing specific deadlines for environmental reviews, which sometimes go on so long that they can delay a project for years.

The State Environmental Quality Review Act (SEQRA) is a stipulation enacted by the state of New York that all local and state government agencies must uniformly reflect the environmental impacts when considering taking social and/or economic factors into action.

City Environmental Quality Review (CEQR) is a process New York City agencies must undergo to determine if any discretionary action they approved has any deteriorating impact on the environment. Projects that have to be reviewed by CEQR are either in need of permits or approval from a city agency, need city funding, or are directly undertaken by a city agency.

Twin Metals LLC is seeking approval to create and operate a copper sulfide mine near Ely, Minnesota, on Superior National Forest land. There has been significant opposition to the proposed mine, most notably because of its proximity to the Boundary Waters Canoe Area Wilderness, location within a watershed that drains into the BWCA, and the air, water, light and noise pollution and traffic effects of converting a forested area bordering the BWCA into a substantial industrial mining facility. Twin Metals is a subsidiary of the Chilean conglomerate Antofagasta, which is controlled by billionaire Andrónico Luksic. The original lease is a 1966 lease to the International Nickel Corporation. The leases were terminated under the Obama administration but renewed under the Trump administration. Critics have objected to and filed lawsuits against various aspects of the lease renewal and regulatory processes. In March 2021, President Joe Biden announced that the Interior and Agriculture departments would review Twin Metals' lease renewal and a judge ordered a pause in the lawsuit(s) until June 21, 2021, to review the Trump administration's decision to renew the leases. On October 20, 2021, the Biden administration ordered a study that could lead to a 20-year ban on mining upstream from the Boundary Waters Canoe Area Wilderness. The federal government said it has filed an application for a "mineral withdrawal", which would begin with a thorough study of the likely environmental and other impacts of mining if it were permitted in a watershed that flows into the Boundary Waters.
