Debra Danburg

Debra Danburg was a representative of the Democratic party. [1] [2] She served as a representative in the Houston/Harris district in the state of Texas from 1981 to 2003. [3] Danburg's notable accomplishments include legislation that updated "rape" laws and amended them to be more gender equal, and legislation to reform punishment for sexual offenders that emphasized reform.

Danburg contributed to the passage of HB 1730, which made important changes in the old rape laws. [4] Under this bill, the term “sexual assault” would replace “rape,” updating the terminology to include all genders and all acts of rape and attempted rape. The bill also removed any kind of “pleasure” references. [5] [6]

Danburg was also successful in passing HB 263, which ended spousal exemption from sexual assault. Spouses could now report marital rape, which eventually could lead to prosecution. [7] [8]

Danburg can also be credited with the passage of the “3-G” legislation, which ensured that criminals convicted of capital murder, aggravated kidnapping, aggravated robbery or aggravated sexual assault serve their full sentence without parole, while also supporting alternative punishments that included rehabilitation counseling, restitution centers, and boot camps. [9]

Post-politics, Danburg survived a bout with cancer. [10] She also remarried after moving to Austin. [11]

The Parliament of India passed the 'Protection of Children Against Sexual Offences Bill (POCSO), 2011' regarding child sexual abuse on 22 May 2012, making it an Act. Gender-targeted crimes continued to be prosecuted, but it was not until after World War II when an international criminal tribunal – the International Military Tribunal for the Far East – were officers charged for being responsible of the gender-targeted crimes and other crimes against humanity. Despite the various rape charges, the Charter of the Tokyo Tribunal did not make references to rape, and rape was considered as subordinate to other war crimes. This is also the situation for other tribunals that followed, but with the establishments of the International Criminal Tribunal for the former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR), there was more attention to the prosecution of gender-targeted crimes with each of the statutes explicitly referring to rape and other forms of gender-targeted violence.

Sexual consent plays an important role in laws regarding rape, sexual assault and other forms of sexual violence. In a court of law, whether or not the alleged victim had freely given consent, and whether or not they were deemed to be capable of giving consent, can determine whether the alleged perpetrator is guilty of rape, sexual assault or some other form of sexual misconduct.
