On September 21, 2007, Governor of New York Eliot Spitzer issued an executive order directing that state offices allow illegal aliens to be issued driver's licenses effective December 2007. [1] [2] The measure was introduced three times. Once, as an executive order that was later withdrawn, then revamped as a legislative bill, which was defeated in the New York State Senate, and finally introduced as an administrative measure through the Department of Motor Vehicles and withdrawn again after heavy public and political opposition.
Applicants for driver's licenses would not be required to prove legal immigration status and would be allowed to present a foreign passport as identification. [2] At that point, eight other states did not require individuals to prove their legal immigration status when applying for a driver's licenses. [3] Spitzer said that the new policy would help all New Yorkers by improving traffic safety, because unlicensed drivers are nearly five times as likely to be in fatal car crashes compared to licensed drivers. [2] Spitzer also claimed that the policy would effectively allow illegal immigrants to buy auto insurance, which would reduce the number of uninsured drivers in the state and therefore decrease insurance premiums for all New Yorkers by an estimated $120 million. [2]
After meeting with the Department of Homeland Security in October 2007, Spitzer agreed that licenses issued to illegal aliens would look different from other licenses and that the new licenses would not allow access to airplanes and federal buildings. [4]

The Spitzer proposal was met with massive criticism from both Republicans and Democrats. [5] Critics charged that the plan would open the door for illegal aliens to obtain official identification and compromise security improvements made since September 11, 2001. His critics included Democratic presidential candidate Senator Christopher Dodd, who denounced the proposal at a debate held on October 30. [6] After a day of equivocation following the debate, Senator Hillary Clinton issued a prepared statement that endorsed the plan. [7] New York City Mayor Michael Bloomberg opposed the executive order, calling it "inappropriate." [8] Minority leader of the State Assembly, James Tedisco, promised a lawsuit to block the proposal. [9]
County clerks across the state would have been required to issue driver's licenses to illegal aliens, but thirteen county clerks promised not to do so. [10] One such clerk who denounced the proposal was Erie County Clerk Kathy Hochul, who was appointed to serve an interim term in her office by Spitzer. She was elected to serve the remaining three years of the term of her predecessor, state Motor Vehicles Commissioner David Swarts, after vocally breaking with Spitzer. [11]
Others who opposed the proposal included Democratic Congresswoman Kirsten Gillibrand, [12] Democratic County Executive Steve Levy of Suffolk County, and Long Island Democratic State Senator Craig Johnson. [13] While the issue initially was significant only in New York, cable TV and talk radio made this a national controversy, as one of Spitzer's strongest critics was CNN host Lou Dobbs, who labeled Spitzer an "idiot" for this policy. [14] While opposition to the driver's license proposal emerged from both political parties, Spitzer claimed his opponents were aligned with the "rabid right." [13] [15]
On October 21, 2007, the State Senate voted to oppose the Spitzer plan by a 39-19 vote. [16] [17] Eight Democrats from moderate districts broke with Spitzer on the vote. [16] [17] After the vote, The New York Times called this issue "Mr. Spitzer’s single most unpopular decision since he took office."
Following the State Senate's vote, Spitzer revised his plan again, proposing the issuance of a third type of driver's license. [18] This driver's license would be available only to United States citizens who are New York State residents, and would be valid for crossing the Canada–US border. [18] Spitzer also announced that the expiration dates of temporary visas would be printed on the driver's licenses of individuals on temporary visas. [18]
A poll conducted by Survey USA on October 3 reported that 56% of New Yorkers opposed the Governor's plan. [19] By November 13, a poll by Siena College reported that 70% of New Yorkers opposed his plan; furthermore, only 25% would vote to re-elect Spitzer. [20]
On November 14, the day following the release of the Siena College poll, Governor Spitzer announced he would withdraw the plan to issue driver's licenses to illegal immigrants, acknowledging that it would never be implemented. [21] [7] [22] The decision drew derision from the press, as the Associated Press termed this reversal a "surrender." [23] WCBS-TV labeled him "Governor Flip-Flop." [22] State Senator Rubén Díaz of the Bronx said he was "betrayed" by Spitzer's abandonment of the plan. [24]
On June 27, 2019, New York Gov. Andrew Cuomo signed the Green Light Bill into law. The law allows undocumented immigrants to apply for and obtain driver licenses. [25]

Same-sex marriage has been legally recognized in the U.S. state of New York since July 24, 2011 under the Marriage Equality Act. The Act does not have a residency restriction, as some similar laws in other states do. It allows religious organizations to decline to officiate at same-sex wedding ceremonies.

The Border Protection, Anti-terrorism, and Illegal Immigration Control Act of 2005 was a bill in the 109th United States Congress. It was passed by the United States House of Representatives on December 16, 2005 by a vote of 239 to 182, but did not pass the Senate. It was also known as the "Sensenbrenner Bill," for its sponsor in the House of Representatives, Wisconsin Republican Jim Sensenbrenner. Rubén Díaz Sr. is a Puerto Rican politician living and working in the United States and an ordained Pentecostal minister. He has represented the 18th Council District in the New York City Council since January 2018. A member of the Democratic Party, Díaz represented the 32nd district in the New York State Senate from 2003 to 2017; his Senate district included parts of the Bronx neighborhoods of Castle Hill, Parkchester, Morrisania, Hunts Point, Melrose, Longwood, and Soundview. A socially conservative Democrat, Díaz is known for his outspoken opposition to abortion and same-sex marriage.
James Nicholas Tedisco is an American politician. Since 2017, he has been the New York State Senator for New York's 49th Senate District, which includes parts of Saratoga, Schenectady and Herkimer Counties and all of Fulton and Hamilton Counties.
Antoine Maurice Thompson is an American politician from Buffalo, New York. A Democrat, Thompson represented the 60th District in the New York State Senate from 2007 to 2011. Thompson previously served as the Masten District councilman on the Buffalo Common Council from 2001 to 2007.
David Swarts was the Commissioner of the New York State Department of Motor Vehicles, in the Cabinet of Gov. David Paterson. He was appointed to this position by former Gov. Eliot Spitzer on Dec. 21, 2006 and took office on Jan. 1, 2007, when the Spitzer Administration took office. He continued in the Paterson Administration after Gov. Spitzer resigned from office amid a sex scandal on March 17, 2008.
A traffic congestion fee will go into effect in New York City by 2021, that will charge vehicles traveling into or within a predetermined area in the Manhattan central business district. First proposed in 2007, this congestion pricing plan was approved and implemented in the 2019 New York State budget. This will be the first such fee scheme enacted in the United States.
The right of foreigners to vote in the United States has historically been a contentious issue. A foreigner, in this context, is an alien or a person who is not a citizen of the United States. Since enactment of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, federal law has prohibited noncitizens from voting in federal elections, punishing them by fines, imprisonment, inadmissibility and deportation. Exempt from punishment is any noncitizen who, at the time of voting, had two natural or adoptive U.S. citizen parents, who began permanently living in the United States before turning 16 years old, and who reasonably believed that he or she was a citizen of the United States. The federal law does not prohibit noncitizens from voting in state or local elections, but no state has allowed noncitizens to vote in state elections since Arkansas became the last state to outlaw noncitizen voting in 1926. However, in some states, local governments have the power to allow noncitizens to vote in local elections. Presently, eleven local governments, ten of them in Maryland, allow noncitizens to vote in their local elections. San Francisco allows noncitizen parents to vote in School Board elections.
Jane Lewis Corwin is an American politician and businesswoman who currently serves a Commissioner of the International Joint Commission for United States and Canada. She previously served as a Republican Party member of the New York State Assembly from 2009 to 2016. She represented the 144th Assembly District which covers parts of Erie and Niagara counties. Corwin was also the Republican Party nominee in the special election held on May 24, 2011 to fill Western New York's 26th district seat in the U.S. House of Representatives previously held by Republican Chris Lee. She faced three other candidates in the election; losing to Democrat Kathy Hochul 47 percent to 42 percent.
Eliot Laurence Spitzer is an American politician, attorney, educator, and real estate developer. A member of the Democratic Party, he served as the 54th Governor of New York.
In the United States, a cityidentification card is a form of identification card issued by a municipality, such as a city, rather than a state or federal government. Under federal law, cities may issue their own identification cards as they see fit, and do not have to consider the immigration or criminal status of an applicant before doing so. New Haven, Connecticut issued the first municipal identification cards in the United States, the Elm City Resident Card, in 2007. On January 15, 2009, the city/county of San Francisco launched the SF City ID Card, a municipal identification card program modeled after New Haven's. Other cities that issue identification cards include Asbury Park, New Jersey, and Washington, D.C.. In Mercer County, New Jersey, a community ID card is being issued by a local non profit organization with the endorsement of various law enforcement agencies.
There are thought to be over half a million undocumented immigrants in New York City. They come from many parts of the world, especially Latin America, Asia, Eastern Europe, and the Caribbean. About 70% of them have paid work, in catering, construction, retail, driving, cleaning, and many other trades; at least in catering, their wages tend to be lower than those of comparable workers. City regulations restrict public officials and police officers from enquiring about immigration status of residents with whom they come into contact.
Kathleen Courtney Hochul is an American politician serving as Lieutenant Governor of New York since 2015. She previously served as the U.S. Representative for New York's 26th congressional district from June 1, 2011 to January 3, 2013. She prevailed in the four-candidate special election of May 24, 2011, to fill the seat left vacant by the resignation of Republican Chris Lee, and was the first Democrat to represent the district in 40 years.
The Marriage Equality Act is a 2011 New York State law that made same-sex marriage legal. The Marriage Equality Act also prohibited state and local courts and governments from penalizing religious and religious-supervised institutions, their employees, and their clergy for refusing to sanctify or recognize marriages that contradict their religious doctrines or for declining to provide services and accommodations in connection with such marriages. The bill was introduced in the New York State Assembly by Assemblyman Daniel O'Donnell. It was signed into law on June 24, 2011 and took effect on July 24, 2011.
Kathleen A. Marchione is an American politician from the State of New York. A Republican, Marchione served as Town Clerk and Town Supervisor in the Town of Halfmoon, New York before becoming Saratoga County Clerk. She served in that role from 1997 through 2012. In 2012, Marchione was elected to the New York State Senate in District 43; she held that position until 2018. Marchione is notable for having unseated Republican State Senator Roy McDonald following his 2011 vote to legalize same-sex marriage in New York.
As of December 2019, 15 U.S. states, the District of Columbia, and Puerto Rico issue driver's licenses or permits to some or all of the population residing illegally in the United States. State laws permitting this are on the books in California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maryland, New Mexico, Nevada, New York, Oregon, Utah, Vermont, and Washington. Oregon now issues such licenses with the passage of the Equal Access To Roads Act in the Oregon legislature; governor Kate Brown signed the bill into law on August 9, 2019, becoming effective immediately. Oregon previously issued such licenses in 2008 and briefly from 2013 until the 2014 Oregon Ballot Measure 88. Some members of the New York's State Board of Elections has claimed that illegal immigrants and non-citizens having access to these licenses significantly increases the likelihood of voter fraud. In New York, for example, Republican and Democratic legislators, including the law's sponsors, observed that the current law only requires a driver's license number to cast a ballot.
