The English Law (Application) Act 1962, originally known as the Application of English Law Ordinance, is an Act of the Gibraltar Legislative Council concerning the applicability of English law in Gibraltar. [1]
The Ordinance affirmed that Gibraltar would follow English Common Law and defined in schedules which specific statutes of English law would apply in Gibraltar. [2] [3] The list of statutes would be updated infrequently. [4] It was also done to confirm in statute, rather than implied common automatic supersession, that Gibraltar would continue with English law. [5]
Though the Ordinance did not clarify whether Gibraltar would follow English case law precedents, it was later interpreted by Gibraltarian legal practitioners as meaning that they were not binding but were useful starting points for the consideration of judgments, due to the low amount of case law that originated in Gibraltar. [6]
The Ordinance was later used as a model in other British colonies for similar ordinances. In British Hong Kong, it was used as the basis for the Application of English Law Ordinance 1966. It is believed that the Hong Kong ordinance was drafted based upon Gibraltar's due to the Attorney General of Hong Kong Denys Roberts supplying a copy of Gibraltar's ordinance which he had from when he was the Attorney General of Gibraltar in 1962. [7] In 2012, the National Assembly for Wales investigated the possibility of creating a system of Welsh law separate from English law, and a barrister responding to the proposal referred to the English Law (Application) Act 1962 and found it ambiguous. [6]
While the Act confirmed many English offences, others were not confirmed, and the Act also made provision for the Gibraltar Parliament to amend or disapply any relevant legislation. As a result, some common law criminal offences have been abolished in Gibraltar, such as being a common scold, cheating the public revenue, champerty, and larceny. And at civil law, adultery and seduction were no longer to be causes of action. [8]
The United Kingdom has three distinctly different legal systems, each of which derives from a particular geographical area for a variety of historical reasons: English and Welsh law, Scots law, Northern Ireland law, and, since 2007, calls for a fourth type that of purely Welsh law as a result of Welsh devolution, with further calls for a Welsh justice system.
English law is the common law legal system of England and Wales, comprising mainly criminal law and civil law, each branch having its own courts and procedures.
Arson is the crime of willfully and deliberately setting fire to or charring property. Although the act of arson typically involves buildings, the term can also refer to the intentional burning of other things, such as motor vehicles, watercraft, or forests. The crime is typically classified as a felony, with instances involving a greater degree of risk to human life or property carrying a stricter penalty. Arson which results in death can be further prosecuted as manslaughter or murder. A common motive for arson is to commit insurance fraud. In such cases, a person destroys their own property by burning it and then lies about the cause in order to collect against their insurance policy.
In common law systems, a superior court is a court of general jurisdiction over civil and criminal legal cases. A superior court is "superior" in relation to a court with limited jurisdiction, which is restricted to civil cases involving monetary amounts with a specific limit, or criminal cases involving offenses of a less serious nature. Sedition is overt conduct, such as speech or organization, that tends toward rebellion against the established order. Sedition often includes subversion of a constitution and incitement of discontent toward, or insurrection against, established authority. Sedition may include any commotion, though not aimed at direct and open violence against the laws. Seditious words in writing are seditious libel. A seditionist is one who engages in or promotes the interest of sedition.
The year and a day rule is associated with the former common law standard that death could not be legally attributed to acts or omissions that occurred more than a year and a day before the death.
The legal system of Singapore is based on the English common law system. Major areas of law – particularly administrative law, contract law, equity and trust law, property law and tort law – are largely judge-made, though certain aspects have now been modified to some extent by statutes. However, other areas of law, such as criminal law, company law and family law, are almost completely statutory in nature.
Arson in royal dockyards and armories was a criminal offence in the United Kingdom and the British Empire. It was among the last offences that were punishable by capital punishment in the United Kingdom. The crime was created by the Dockyards etc. Protection Act 1772 passed by the Parliament of Great Britain, which was designed to prevent arson and sabotage against vessels, dockyards, and arsenals of the Royal Navy.
Unlawful assembly is a legal term to describe a group of people with the mutual intent of deliberate disturbance of the peace. If the group is about to start an act of disturbance, it is termed a rout; if the disturbance is commenced, it is then termed a riot. In England, the offence was abolished in 1986, but it exists in other countries.
Human rights protection is enshrined in the Basic Law and its Bill of Rights Ordinance (Cap.383). By virtue of the Bill of Rights Ordinance and Basic Law Article 39, the International Covenant on Civil and Political Rights (ICCPR) is put into effect in Hong Kong. Any local legislation that is inconsistent with the Basic Law can be set aside by the courts. This does not apply to national legislation that applies to Hong Kong, such as the National Security Law, even if it is inconsistent with the Bills of Rights Ordinance, ICCPR, or the Basic Law.
The law of Northern Ireland is the legal system of statute and common law operating in Northern Ireland since the partition of Ireland established Northern Ireland as a distinct jurisdiction in 1921. Prior to 1921, Northern Ireland was part of the same legal system as the rest of Ireland.

Offences Against the Person Act is a stock short title used for legislation in the United Kingdom, in the Republic of Ireland, in Hong Kong, in New Zealand, in Tasmania, in Jamaica, and in Antigua and Barbuda, relating to offences against the person. It seems to have been derived from the long title of the Act which has come to be known as the Offences Against the Person Act 1828. It is sometimes abbreviated to OAPA, as in "OAPA 1861".

A sodomy law is a law that defines certain sexual acts as crimes. The precise sexual acts meant by the term sodomy are rarely spelled out in the law but are typically understood by courts to include any sexual act deemed to be "unnatural" or "immoral". Sodomy typically includes anal sex, oral sex, manual sex, and bestiality. In practice, sodomy laws have rarely been enforced against heterosexual couples, and have mostly been used to target homosexual couples.
A reception statute is a statutory law adopted as a former British colony becomes independent by which the new nation adopts, or receives, the English common law before its independence to the extent not explicitly rejected by the legislative body or constitution of the new nation. Reception statutes generally consider the English common law dating prior to independence, as well as the precedents originating from it, as the default law because of the importance of using an extensive and predictable body of law to govern the conduct of citizens and businesses in a new state.
The Public Order Ordinance (’POO’) is a piece of primary legislation in Hong Kong. It codifies a number of old common law public order offences. It imposes notification requirements for public processions and meetings which resemble a licensing regime. It also provides for the designation of restricted areas along the Hong Kong-China border and in the military installations. The 1967 Ordinance was enacted in the aftermath of the 1967 Leftist riots. For the following decades, the stringent control over public processions and meetings was relaxed incrementally until 1990s when it was brought in line with human rights standards. Upon Hong Kong handover, the amendments in the 1990s were decreed "not adopted as the laws of the HKSAR" by the NPCSC of China and therefore reverted.
A political offence exception is a provision which limits the obligation of a sovereign state under an extradition or mutual legal assistance treaty or statute. Such provisos allow the state whose assistance has been requested to refuse to hand over a suspect to – or to gather evidence on behalf of – another state, if the requested party's competent authority determines that the requesting party seeks assistance in order to prosecute an offence of a political character.
The Companies Registry is a government department under the Financial Services and the Treasury Bureau of the Government of Hong Kong. Its responsibilities include the registration of Hong Kong companies and non-Hong Kong companies under the Companies Ordinance, open-ended fund companies under the Securities and Futures Ordinance and limited partnership funds under the Limited Partnerships Funds Ordinance. It administers the licensing regime for trust and corporate service providers under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance as well as the licensing regime for money lenders under the Money Lenders Ordinance.
