The enrolled bill rule is a principle of judicial interpretation of rules of procedure in legislative bodies and rule of recognition. Under the doctrine, once a bill passes a legislative body and is signed into law, the courts assume that all rules of procedure in the enactment process were properly followed. That is, "[i]f a legislative document is authenticated in regular form by the appropriate officials, the court treats that document as properly adopted." [1]
The doctrine was adopted in The King v. Arundel . [2] It was based on the proposition that when an Act was passed and assented to, it was affixed with the Great Seal, the "effective legal act of enactment". [3] It was "a regal act, and no official might dispute the king's word".
The enrolled bill rule was restated by Lord Campbell in Edinburgh & Dalkeith Railway Co v Wauchope. [4] In that case it was complained that the passage of a private bill was defective because proper notice had not been given. The House of Lords rejected the notion that the validity of an Act could be questioned.
In the United States, the rule was adopted by the Supreme Court in Field v. Clark , 143 U.S. 649 (1892). In effect, the court ruled that the enrolled bill signed by the presiding officers of the two houses of Congress was the best evidence of what had been passed, being on balance better evidence than the journals of the respective houses, so it should not be called into question. At the time of the decision in Field, nine states had adopted the doctrine, and thirteen had rejected it. [5] At least two states have weakened it:

The doctrine of nondelegation is the theory that one branch of government must not authorize another entity to exercise the power or function which it is constitutionally authorized to exercise itself. It is explicit or implicit in all written constitutions that impose a strict structural separation of powers. It is usually applied in questions of constitutionally improper delegations of powers of any of the three branches of government to either of the other, to the administrative state, or to private entities. Although it is usually constitutional for executive officials to delegate executive powers to executive branch subordinates, there can also be improper delegations of powers within an executive branch.
In the United States, the exclusionary rule is a legal rule, based on constitutional law, that prevents evidence collected or analyzed in violation of the defendant's constitutional rights from being used in a court of law. This may be considered an example of a prophylactic rule formulated by the judiciary in order to protect a constitutional right. The exclusionary rule may also, in some circumstances at least, be considered to follow directly from the constitutional language, such as the Fifth Amendment's command that no person "shall be compelled in any criminal case to be a witness against himself" and that no person "shall be deprived of life, liberty or property without due process of law."
In United States constitutional law and criminal procedure, the good-faith exception is one of the limitations on the exclusionary rule of the Fourth Amendment.
Seminole Tribe of Florida v. Florida, 517 U.S. 44 (1996), was a United States Supreme Court case which held that Article One of the U.S. Constitution did not give the United States Congress the power to abrogate the sovereign immunity of the states that is further protected under the Eleventh Amendment. Such abrogation is permitted where it is necessary to enforce the rights of citizens guaranteed under the Fourteenth Amendment as per Fitzpatrick v. Bitzer. The case also held that the doctrine of Ex parte Young, which allows state officials to be sued in their official capacity for prospective injunctive relief, was inapplicable under these circumstances, because any remedy was limited to the one that Congress had provided.
Banco Nacional de Cuba v. Sabbatino, 376 U.S. 398 (1964), was a United States Supreme Court case that determined that the policy of United States federal courts would be to honor the Act of State Doctrine, which dictates that the propriety of decisions of other countries relating to their internal affairs would not be questioned in the courts of the United States.
Statutory interpretation is the process by which courts interpret and apply legislation. Some amount of interpretation is often necessary when a case involves a statute. Sometimes the words of a statute have a plain and a straightforward meaning. But in many cases, there is some ambiguity in the words of the statute that must be resolved by the judge. To find the meanings of statutes, judges use various tools and methods of statutory interpretation, including traditional canons of statutory interpretation, legislative history, and purpose. In common law jurisdictions, the judiciary may apply rules of statutory interpretation both to legislation enacted by the legislature and to delegated legislation such as administrative agency regulations.

Inevitable discovery is a doctrine in United States criminal procedure that permits admission of evidence that was obtained through illegal means if it would "inevitably" have been obtained regardless of the illegality. It is one of several exceptions to the exclusionary rule, or the related fruit-of-the-poisonous tree doctrine, which prevent evidence collected in violation of a defendant's constitutional rights from being admitted in court.
In United States law, a federal enclave is a parcel of federal property within a state that is under the "Special Maritime and Territorial Jurisdiction of the United States". These enclaves are used for the many different functions of the United States federal government, and include post offices, arsenals, dams, road, etc., and usually are owned, secured and administered by the U S. federal government itself. The United States in many cases has received similar jurisdictional authority over privately owned properties which it leases, or privately owned and occupied properties which are located within the exterior boundaries of a large area as to which a state has ceded jurisdiction to the United States.

Griffin v. California, 380 U.S. 609 (1965), was a United States Supreme Court case in which the Court ruled, by a 6–2 vote, that it is a violation of a defendant's Fifth Amendment rights for the prosecutor to comment to the jury on the defendant's declining to testify, or for the judge to instruct the jury that such silence is evidence of guilt.
Judicial review is a process under which a government's executive, legislative, or administrative actions are subject to review by the judiciary. In a judicial review, a court may invalidate laws, acts, or governmental actions that are incompatible with a higher authority. For example, an executive decision may be invalidated for being unlawful, or a statute may be invalidated for violating the terms of a constitution. Judicial review is one of the checks and balances in the separation of powers—the power of the judiciary to supervise the legislative and executive branches when the latter exceed their authority. The doctrine varies between jurisdictions, so the procedure and scope of judicial review may differ between and within countries.
Wieman v. Updegraff, 344 U.S. 183 (1952), is a unanimous ruling by the United States Supreme Court which held that Oklahoma loyalty oath legislation violated the due process clause of the Fourteenth Amendment to the United States Constitution because it did not give individuals the opportunity to abjure membership in subversive organizations. Due process requires that individuals have scienter, and the Oklahoma statute did not accommodate this requirement.
United States v. Grimaud, 220 U.S. 506 (1911), was a case argued before the Supreme Court of the United States. The case tested the constitutionality of the Forest Reserve Act of 1891, which delegated the power to make rules and regulations regarding the use of federal Forest Service lands and to punish violations of these rules as a criminal offense to the Secretary of the U.S. Department of Agriculture. The Court ruled, after a re-argument, that such a delegation of rulemaking power was permissible because it was separate from true legislative power.
Zivotofsky v. Clinton, 566 U.S. 189 (2012), is a Supreme Court of the United States decision in which the Court held that a dispute about passport regulation was not a political question and thus resolvable by the US court system. Specifically, Zivotofsky's parents sought to have his passport read "Jerusalem, Israel", rather than "Jerusalem", as his place of birth. The State Department had rejected that request under a longstanding policy that took no stance on the legal status of Jerusalem. Zivotofsky's parents then sued, citing a Congressional law that ordered the Secretary of State to list people born in Jerusalem as born in Israel.
Georgia v. Public.Resource.Org, Inc., No. 18-1150, 590 U.S. ___ (2020), is a United States Supreme Court case regarding "whether the government edicts doctrine extends to—and thus renders uncopyrightable—works that lack the force of law, such as the annotations in the Official Code of Georgia Annotated" (OCGA). On April 27, 2020, the Court ruled 5–4 that the OCGA cannot be copyrighted because the OCGA's annotations were "authored by an arm of the legislature in the course of its legislative duties"; thus the Court found that the annotations fall under the government edicts doctrine and are ineligible for copyright.
