The Federal Mine Safety and Health Review Commission (MSHRC) is an independent adjudicative agency of the United States government that provides administrative trial and appellate review of legal disputes arising under the Federal Mine Safety and Health Amendments Act, or Mine Act, of 1977.
Under the Mine Act, the U.S. Department of Labor issues regulations covering health and safety in the nation's mines. Federal mine inspectors employed by the Department's Mine Safety and Health Administration (MSHA) enforce these regulations by issuing citations and orders to mine operators. The commission is concerned solely with the adjudication of disputes under the Mine Act, including the determination of appropriate penalties. It does not regulate mining or enforce the Mine Act. The commission was established as an independent agency to ensure its impartiality.
Most cases deal with civil penalties assessed against mine operators and address whether the alleged safety and health violations occurred as well as the appropriateness of proposed penalties. Other types of cases include orders to close a mine, miners' charges of safety related discrimination and miners’ requests for compensation after the mine is idled by a closure order.
The commission's administrative law judges (ALJs) decide cases at the trial level. The five-member Commission provides appellate review. Commissioners are appointed by the President and confirmed by the Senate. Review of an ALJ decision by the commission is not guaranteed but requires the affirmative vote of two Commissioners. Most of the cases accepted for review are generated from petitions filed by parties adversely affected by an ALJ decision. However, cases can also be accepted based on the commission's own direction for review. An ALJ decision that is not accepted for review becomes a final, non-precedential order of the commission. Appeals from the commission's decisions are to the U.S. courts of appeals.
Procedures for appealing cases to the commission are contained in its Rules of Procedure published in 29 CFR Part 2700. The commission also publishes these rules in a separate pamphlet. A brochure, entitled "How a Case Proceeds Before the Commission" is also available. The commission's headquarters and Office of Administrative Law Judges are co-located in Washington, D.C., with an additional OALJ's offices in Denver, Colorado and Pittsburgh, Pennsylvania. Currently, the commission has a budget of more than US$18 million and a staff of 76 employees. [3]
The commission is composed of five members, appointed by the president of the United States with the consent of the United States Senate. All members shall be appointed on the basis of their training, education, or experience. Members are appointed to terms of six years. They cannot continue to serve on the commission past expiration of their term. Any member of the commission may be removed by the President for inefficiency, neglect of duty, or malfeasance in office. [4]

A tribunal, generally, is any person or institution with authority to judge, adjudicate on, or determine claims or disputes—whether or not it is called a tribunal in its title. For example, an advocate who appears before a court with a single judge could describe that judge as "their tribunal". Many governmental bodies are titled "tribunals" to emphasize that they are not courts of normal jurisdiction. For instance, the International Criminal Tribunal for Rwanda was a body specially constituted under international law; in Great Britain, employment tribunals are bodies set up to hear specific employment disputes.
The United States Consumer Product Safety Commission is an independent agency of the United States government. The CPSC seeks to promote the safety of consumer products by addressing "unreasonable risks" of injury ; developing uniform safety standards ; and conducting research into product-related illness and injury. In part due to its small size, the CPSC attempts to coordinate with outside parties—including companies and consumer advocates—to leverage resources and expertise to achieve outcomes that advance consumer safety. The agency was created by section 4 of the Consumer Product Safety Act in 1972. The agency reports to Congress and the President; it is not part of any other department or agency in the federal government. The CPSC has five commissioners, who are nominated by the president and confirmed by the Senate for staggered seven-year terms. Historically, the commission was often run by three commissioners or fewer. Since 2009, however, the agency has generally been led by five commissioners, one of whom serves as chairman. The commissioners set policy for the CPSC. The CPSC is headquartered in Bethesda, Maryland.

An administrative law judge (ALJ) in the United States is a judge and trier of fact who both presides over trials and adjudicates claims or disputes involving administrative law. ALJs can administer oaths, take testimony, rule on questions of evidence, and make factual and legal determinations.
The federal judiciary of the United States is one of the three branches of the federal government of the United States organized under the United States Constitution and laws of the federal government. The U.S. federal judiciary consists primarily of the U.S. Supreme Court, the U.S. Courts of Appeals, and the U.S. District Courts. It also includes a variety of other lesser federal tribunals.
The Mine Safety and Health Administration (MSHA) is a large agency of the United States Department of Labor which administers the provisions of the Federal Mine Safety and Health Act of 1977 to enforce compliance with mandatory safety and health standards as a means to eliminate fatal accidents, to reduce the frequency and severity of nonfatal accidents, to minimize health hazards, and to promote improved safety and health conditions in the nation's mines. MSHA carries out the mandates of the Mine Act at all mining and mineral processing operations in the United States, regardless of size, number of employees, commodity mined, or method of extraction. David Zatezalo was sworn in as Assistant Secretary of Labor for Mine Safety and Health, and head of MSHA, on November 30, 2017. He served until January 20, 2021. Jeannette Galanais served as Acting Assistant Secretary by President Joe Biden on February 1, 2021 until Christopher Williamson took office on April 11, 2022.
In most legal jurisdictions, a supreme court, also known as a court of last resort, apex court, and highcourt of appeal, and court of final appeal, is the highest court within the hierarchy of courts. Broadly speaking, the decisions of a supreme court are binding on all other courts in a nation and are not subject to further review by any other court. Supreme courts typically function primarily as appellate courts, hearing appeals from decisions of lower trial courts, or from intermediate-level appellate courts. A supreme court can also, in certain circumstances, act as a court of original jurisdiction.

The Occupational Safety and Health Review Commission (OSHRC) is an independent federal agency created under the Occupational Safety and Health Act to decide contests of citations or penalties resulting from OSHA inspections of American work places. It is not part of the Department of Labor or OSHA. It functions as a two-tiered administrative court, with established procedures for conducting hearings, receiving evidence, and rendering decisions by its Administrative Law Judges, and if necessary discretionary review of those decisions by a panel of Commissioners.
The Federal Coal Mine Safety Act of 1952 is a U.S. law authorizing the federal government to conduct annual inspections of underground coal mines with more than 15 workers, and gave the United States Bureau of Mines the authority to shut down a mine in cases of "imminent danger." The Act authorized the assessment of civil penalties against mine operators for failing to comply with an order to shut down or for refusing to give inspectors access to mine property. The law did not authorize monetary penalties for noncompliance with the safety provisions. In 1966, Congress extended coverage to all underground coal mines.
J. Davitt McAteer is an American lawyer, author, and activist from Fairmont, West Virginia. McAteer was appointed to the position of assistant secretary for the Mine Safety and Health Administration from 1993 to 2000 under President Bill Clinton. Throughout his career, McAteer has been an advocate for safe working conditions for miners, particularly in the coal industry. After the Upper Big Branch Mine disaster of 2010, where an explosion caused by negligence led to the death of 29 miners, McAteer Served on Governor Earl Ray Tomblin's independent investigation panel to determine the cause of the explosion. McAteer is the author of "Monongah: The Tragic Story of the 1907 Monongah Mine Disaster".
Lucia v. Securities and Exchange Commission, 585 U.S. 237 (2018), was a decision by the Supreme Court of the United States on the status of administrative law judges of the Securities and Exchange Commission. The Court held that they are considered inferior officers of the United States and so are subject to the Appointments Clause and must be appointed through the President or other delegated officer of the United States, rather than hired. As "inferior" officers, their appointments are not subject to the Senate's advice and consent role.
Securities and Exchange Commission v. Jarkesy was a case before the Supreme Court of the United States. In May 2022, the Court of Appeals for the Fifth Circuit held, under certain statutory provisions, the Securities and Exchange Commission's administrative adjudication of fraud claims without jury trials in their administrative proceedings with their own administrative law judges (ALJs) rather than Article III judges violated three provisions of the Constitution. The justices ruled that the Securities and Exchange Commission violated the Seventh Amendment.
