His Majesty's Inspectorate of Prosecution in Scotland (IPS), has statutory responsibility for the inspection of the criminal justice system of Scotland. IPS is headed by the HM Chief Inspector of Prosecution in Scotland. [2]
IPS is responsible to the Lord Advocate. [3]
As a public authority, decisions and actions of IPS are susceptible to judicial review.
The first chief inspector was appointed in 2003, and after initially operating as a non-statutory body, IPS was placed on a statutory footing in 2007. [4] [5]
His Majesty's Inspectorate of Education (HMIe) was an executive agency of the Scottish Government, responsible for the inspection of public and private, primary and secondary schools, as well as further education colleges, community learning, Local Authority Education Departments and teacher education.
The Law Officers are the senior legal advisors to His Majesty's Government of the United Kingdom and devolved governments of Northern Ireland, Scotland and Wales. They are variously referred to as the Attorney General, Solicitor General, Lord Advocate, or Advocate General depending on seniority and geography - though other terms are also in use, such as the Counsel General for Wales. Law Officers in these roles are distinguished by being political appointees, while also being bound by the duties of independence, justice and confidentiality among the other typical professional commitments of lawyers. These roles do not have any direct oversight of prosecutions nor do they directly lead or influence criminal investigations. This is a distinguishing factor between Law Officers and the State Attorneys General of the United States or US Attorney General.
The Crown Office and Procurator Fiscal Service is the independent public prosecution service for Scotland, and is a Ministerial Department of the Scottish Government. The department is headed by His Majesty's Lord Advocate, who under the Scottish legal system is responsible for prosecution, along with the sheriffdom procurators fiscal. In Scotland, virtually all prosecution of criminal offences is undertaken by the Crown. Private prosecutions are extremely rare.
The courts of Scotland are responsible for administration of justice in Scotland, under statutory, common law and equitable provisions within Scots law. The courts are presided over by the judiciary of Scotland, who are the various judicial office holders responsible for issuing judgments, ensuring fair trials, and deciding on sentencing. The Court of Session is the supreme civil court of Scotland, subject to appeals to the Supreme Court of the United Kingdom, and the High Court of Justiciary is the supreme criminal court, which is only subject to the authority of the Supreme Court of the United Kingdom on devolution issues and human rights compatibility issues.
A procurator fiscal, sometimes called PF or fiscal, is a public prosecutor in Scotland, who has the power to impose fiscal fines. They investigate all sudden and suspicious deaths in Scotland, conduct fatal accident inquiries and handle criminal complaints against the police. They also receive reports from specialist reporting agencies such as His Majesty's Revenue and Customs.
His Majesty's Inspectorate of Constabulary and Fire & Rescue Services (HMICFRS), formerly Her Majesty's Inspectorate of Constabulary (HMIC), has statutory responsibility for the inspection of the police forces of England and Wales, and since July 2017 the fire and rescue services of England. HMICFRS is headed by the Chief Inspector of Constabulary and Chief Inspector of Fire & Rescue Services. It has taken over the responsibilities of His Majesty's Fire Service Inspectorate.
His Majesty's Chief Inspector of Prisons is the head of HM Inspectorate of Prisons and the senior inspector of prisons, young offender institutions and immigration service detention and removal centres in England and Wales. The current chief inspector is Charlie Taylor.
An inspectorate or inspectorate-general is a civil or military body charged with inspecting and reporting on some institution or institutions in its field of competence. Inspectorates cover a broad spectrum of organizations which vary in a number of terms, notably whether and to the degree to which they become involved in criminal investigations; the extent to which they achieve independence from the institutions being inspected; as well as the nature of their inspection regimes and reporting processes.
HM Inspectorate of Prisons for Scotland was established in 1981, following recommendations of the May Committee report of 1979. The Inspectorate is directly funded by the Scottish Government.
Rodney Emrys Morgan was Criminology lecturer at the University of Bath in the early 1980s and is Professor Emeritus, University of Bristol and Visiting Professor at the University of Sussex. He is the former chair of the Youth Justice Board for England and Wales (2004-7) and prior to that was HM Chief Inspector of Probation for England and Wales (2001-4).
Scots criminal law relies far more heavily on common law than in England and Wales. Scottish criminal law includes offences against the person of murder, culpable homicide, rape and assault, offences against property such as theft and malicious mischief, and public order offences including mobbing and breach of the peace. Scottish criminal law can also be found in the statutes of the UK Parliament with some areas of criminal law, such as misuse of drugs and traffic offences appearing identical on both sides of the Border. Scottish criminal law can also be found in the statute books of the Scottish Parliament such as the Sexual Offences (Scotland) Act 2009 and Prostitution (Scotland) Act 2007 which only apply to Scotland. In fact, the Scots requirement of corroboration in criminal matters changes the practical prosecution of crimes derived from the same enactment. Corroboration is not required in England or in civil cases in Scotland. Scots law is one of the few legal systems that require corroboration.
A fiscal fine is a form of deferred prosecution agreement in Scotland issued by a procurator fiscal for certain summary offences as an alternative to prosecution. Alternatives to prosecution are called direct measures in Scotland.
His Majesty's Inspectorate of Constabulary in Scotland (HMICS) is a public body of the Scottish Government and reports to the Scottish Parliament. It has statutory responsibility for the inspection of the effectiveness and efficiency of the police service in Scotland.
An independent custody visitor is someone who visits people who are detained in police stations in the United Kingdom to ensure that they are being treated properly. Prisoner escort and custody lay observers carry out a similar function in relation to the escort of prisoners from one place to another, or their custody at court.
An Act of Sederunt is secondary legislation made by the Court of Session, the supreme civil court of Scotland, to regulate the proceedings of Scottish courts and tribunals hearing civil matters. Originally made under an Act of the Parliament of Scotland of 1532, the modern power to make Acts of Sederunt is largely derived from the Courts Reform (Scotland) Act 2014. Since 2013, draft Acts have also been prepared by the Scottish Civil Justice Council and submitted to the Court of Session for approval.
His Majesty's Inspectorate of Probation (HMIP) is a statutory body and independent UK inspectorate funded by the Ministry of Justice, formed in 1936.
The judiciary of Scotland are the judicial office holders who sit in the courts of Scotland and make decisions in both civil and criminal cases. Judges make sure that cases and verdicts are within the parameters set by Scots law, and they must hand down appropriate judgments and sentences. Judicial independence is guaranteed in law, with a legal duty on Scottish Ministers, the Lord Advocate and the Members of the Scottish Parliament to uphold judicial independence, and barring them from influencing the judges through any form of special access.

Criminal Justice Inspection Northern Ireland (CJI), has statutory responsibility for the inspection of the criminal justice system of Northern Ireland. CJI is headed by the Chief Inspector of Criminal Justice for Northern Ireland.

The role of the Chief Inspector is to: submit a report to the Lord Advocate on any particular matter connected with the operation of COPFS which is referred by the Lord Advocate
IPS was first established in 2003, following an independent inquiry by Dr Raj Jandoo into the liaison arrangements between the police, COPFS and the family of Surjit Singh Chhokar, following the murder of Mr Chhokar and related prosecutions. One of the recommendations of the inquiry was that an inspectorate of COPFS be established, 'to introduce a measure of accountability, which is essential for public confidence.' After initially operating as a non-statutory body, IPS was placed on a statutory footing in 2007.
