John Harun Mwau (born 24 June 1948) is a Kenyan businessman and politician. He is the former Member of Parliament for Kilome Constituency. He was the first director of the defunct Kenya Anti-Corruption Authority [1] but was removed after a year when a tribunal ruled that he was unfit to hold the office. [2]

Harun Mwau is the founding chairman Party of Independent Candidates of Kenya (PICK) and ran as a Presidential Candidate in the 1992 Kenyan general election. [3] Mwau polled 10,449 votes and later petitioned the High Court to declare him the only validly nominated candidate, as other candidates did not present the list of supporters nominating them using the correct paper size. The case was dismissed by the High Court. [4]

Prior to his career as a politician, he was a sports shooter and competed at the 1968 Summer Olympics and the 1972 Summer Olympics. [5]

Controversy

Drug trafficking accusations

In 2011, the United States designated Harun Mwau, who was MP at the time, on a list of seven “narcotic kingpins”. Under this legislation, American assets are frozen, and access to the American financial system is denied. [6] [7] Harun Mwau has been cited as one of "the more powerful and active narcotics traffickers in the region" by the Director of the Office of Foreign Assets Control of the US Department of Treasury. [8] Harun Mwau has been denying the charges [6] [8] and says that the United States government is attempting to seize his businesses, which are estimated to be worth $750 million. [9]

Litigations

In 2005, Harun Mwau sued the Nation Media group for an alleged defamatory article which implicated him in a tax evasion scandal. [10] The same year, he filed four suits against the senior executives and editors of Kenya's leading media houses to permanently bar the media from publishing reports linking him to drug trafficking. [11] In 2011, Harun Mwau sued the United States Ambassador Michael Ranneberger for associating him to narcotic drug trafficking. [12]   In 2013, he sued a student over a Facebook post linking him to the murder of Internal Security minister, George Saitoti. [13] In 2014, he sued the author of a report from the International Peace Institute, where his designation by the US government as a foreign narcotics kingpin was mentioned. [14] In 2017, he sued the authors of two blog posts which link him to a businessman believed to be close to Colombia's drug cartels. [15] The same year, he sued the Kenyan Independent Electoral and Boundaries Commission for "intending to conduct a fresh presidential election without nominations". [16]

Mwau vied for senatorial position for Makueni in 2013 Election. He was defeated by Mutula Kilonzo [17]

2013 Makueni by-election

Mutula Kilonzo Jnr a son of former senator Mutula Kilonzo of Wiper Democratic Party won 163,232 votes to win the Makueni Senate seat in the 2013 by-election. Mwau therefore has lost senatorial election to father and son in a span of 5 month. [18]

Makueni by-election, the first after the 4 March 2013 general election, was occasioned by the death of Mutula Kilonzo on 27 April 2013. The voter turnout was 60.4%.

Makueni County is a county in the former Eastern Province of Kenya. Its capital town is Wote. It's the largest town in the county. Emali town which is an important market and stop over for the Standard Gauge Railway (SGR), is another major town in the county. It is multicultural and adds diversity to Makueni County. The county had a population of 987,653 in the 2019 census. The county lies between Latitude 1° 35' and 2° 59' South and Longitude 37° 10' and 38° 30' East. Mohammed Abdul Malik Bajabu is a citizen of Kenya currently held in administrative detention in the United States' Guantanamo Bay detention camps, in Cuba. He was born in Busia, Uganda, but has Kenyan citizenship. Abdul Malik was captured in February 2007, on suspicion of leading a terrorist bomb-plot in Mombasa. He was transferred to Guantanamo on 26 March 2007. Abdul Malik is a confirmed member of the East Africa al-Qaeda network as well as a confirmed member of the Council of Islamic Courts and the Islamic Part of Kenya. He "actively participated" in the facilitation of weapons and the planning of terrorist acts against the U.S., according to the Joint Task Force (JTF) at Guantanamo Bay. He was recommended for continued detention under the Department of Defense's control. The JTF gave Abdul Malik a high risk threat against the United States' interests and allies. He has no reports of disciplinary infractions as of May 22, 2007, granting him a low detention risk value. Abdul Malik does, however, have a high intelligence value.

General elections were held in Kenya on 4 March 2013. Voters elected the President, members of the National Assembly and newly formed Senate. They were the first elections held under the new constitution, which was approved in a 2010 referendum, and were also the first run by the new Independent Electoral and Boundaries Commission (IEBC). They coincided with the 2013 Kenyan local elections.

The Independent Electoral and Boundaries Commission (IEBC) is an independent regulatory agency that was founded in the year 2011 through the making of the Constitution of Kenya. The Commission is responsible for conducting or supervising referendums and elections to any elective body or office established by the Constitution, and any other elections as prescribed by an Act of Parliament. It was created in a provision of the 2010 constitution and the Independent Electoral and Boundaries Commission Act. Its mandate includes "the continuous registration of voters and revision of the voter's roll, the delimitation of constituencies and wards, the regulation of political parties process, the settlement of electoral disputes, the registration of candidates for elections, voter education, the facilitation of the observation, monitoring and evaluation of elections, the regulation of money spent by a candidate or party in respect of any election, the development of a code of conduct for candidates and parties, [and] the monitoring of compliance with legislation on nomination of candidates by parties."

She was lead negotiator for president Kibaki in the National accord talks after the disputed election of 2007. She was reappointed minister of Justice & constitutional Affairs with the added mandate of National cohesion. She initiated all the necessary legislation to facilitate the coalition government, and led the enactment of the constitution of kenya review Act 2008 that enabled the completion of constitution culminating in the constitution of kenya 2010. Martha resigned on principle as minister of justice in April 2008 and continued to serve as MP Gichugu for the rest of the term.

Local elections were held in Machakos County to elect a Governor and County Assembly on 4 March 2013. Under the new constitution, which was passed in a 2010 referendum, the 2013 general elections were the first in which Governors and members of the County Assemblies for the newly created counties were elected. They will also be the first general elections run by the Independent Electoral and Boundaries Commission(IEBC) which has released the official list of candidates.

Kethi Diana Kilonzo is a Kenyan lawyer, lecturer and accountant. She is the daughter of the late Makueni Senator Mutula Kilonzo and is most notable for her performance as the head counsel for Africa Centre for Open Governance's petition against the declaration of Uhuru Kenyatta as the President of Kenya. Kethi Diana Kilonzo argued against the results announced by IEBC Chairman Isaack Hassan and cited the results as not credible. The petition, which had been filed alongside that of the Coalition for Reforms and Democracy, sought to nullify the 2013 election, which the two petitioners claimed to have been altered by the first respondent under the leadership of the second respondent to the advantage of the third and fourth respondents that is the president and deputy president of Kenya, respectively. The petition was heard by a panel of six Supreme Court judges, headed by Willy Mutunga

<span class="mw-page-title-main">Death of Mutula Kilonzo</span>

On 27 April 2013, Kenyan politician and lawyer Mutula Kilonzo, who was serving as the first Senator of Makueni County, died at his ranch in Maanzoni, Machakos County. A requiem mass was held at the Nairobi Baptist Church in Nairobi on 8 May, followed by his burial at his home village in Makueni County, in line with his wishes.

Mutula Kilonzo Jnr. is the current Governor of Makueni County government, Kenya. He is a member and chair of the Wiper Democratic Movement, Kenya and was elected as the second Senator of Makueni County Government on the WDM-K ticket in a by-election in July 2013, after the demise of his father lawyer Mutula Kilonzo and is currently serving as the second Governor for Makueni county, having been elected in the August 2022 elections. He is married to Anita Mutula and they have two children.
