Legal education in Malaysia

As a commonwealth country, the Malaysian legal education system is rooted from the United Kingdom. Legal qualifications offered by the local law faculties require students to have a pre-university qualification such as the Malaysian Higher School Certificate, A-Level, International Baccalaureate, Foundation Course or a Diploma. Generally, the law degree programmes in Malaysia consist of civil law subjects, but there are institutions such as International Islamic University Malaysia and Universiti Sultan Zainal Abidin that include Sharia or Islamic law courses as requirements for admission and graduation. Legal qualifications in Malaysia can be obtained by four routes.

  1. The first route is the Bachelor of Laws (Hons) or LL.B (Hons) programme with a minimum of four (4) years of full-time study from recognised local universities: University of Malaya, International Islamic University Malaysia, National University of Malaysia and Universiti Teknologi MARA. In 2008, LL.B (Hons) from Multimedia University and Universiti Utara Malaysia were recognised. [3] In 2013, LL.B (Hons) from Universiti Sultan Zainal Abidin was given provisional recognition and by 2015 full recognition has been accorded. [4] [5]
  2. The second route is the three (3) year degree programme known as the Bachelor of Legal Studies (Hons) or BLS (Hons) offered by the Universiti Teknologi MARA (UiTM). Upon completion of the BLS (Hons) programme, the students can choose either to work as legal advisors / legal executives but they are not fully qualified to apply to be advocates and solicitors. [6] If they choose to practice as advocates and solicitors, they have to be vetted and short-listed to continue with a one (1) year Bachelor of Laws (Hons) or LL.B (Hons) programme offered by UiTM. Those who are not short-listed may sit for the Certificate in Legal Practice or CLP examination or re-apply after gaining working experience. The LL.B(Hons) programme from UiTM is unique in the country in which the students are put in a simulated legal office environment in which they are designated in firms and given case studies. [7] The programme is designed after the Inns of Court in England.
  3. The third route is the three (3) year degree programme known as the Bachelor of Jurisprudence (Hons) or B.Juris (Hons) from the University of Malaya (UM). [8] It is taught externally at private institutions but B.Juris (Hons) may also be awarded to University of Malaya's students who can't or choose not to proceed to the fourth and final year of the LL.B (Hons) programme. [9] B.Juris (Hons) is equivalent to Bachelor of Legal Studies (Hons) from UiTM. It is a popular alternative to LL.B (Hons) from University of London International Programme. Upon graduation, the students need to sit for the Certificate in Legal Practice examination to practice law.
  4. The fourth route is the three (3) year LL.B (Hons) from shortlisted universities in the United Kingdom (including B.A Law from Oxford and Cambridge), New Zealand and Australia. There are private institutions in Malaysia that offer such LL.B (Hons) programme through twinning arrangements. Students do their degree one (1) year in Malaysia and two (2) years at the foreign universities (1+2). The LL.B (Hons) from the University of London International Programmes is the only recognised foreign degree that can be fully completed at the local private institutions. Upon graduation, the students need to sit for the Certificate in Legal Practice examination to practice law. [10]

Historically, admission by legal articleship or clerkship was accepted but such route is no longer existed.

Apart from the above-mentioned four routes, in order for the graduates to be eligible to practice as Advocates and Solicitors, they need to complete their pupillage period (also known as reading in chambers or chambering) for nine months before being called to the Bar.

Development of a Common Bar Course

In May 2008, minister in the Prime Minister's Department Zaid Ibrahim, who was also the then de facto Minister of Law announced that the CLP would be scrapped and be replaced with the Common Bar Course and the Common Bar Exam. This proposed exam will be compulsory for every student wishing to practice in Malaysia, including local graduates. [11]

The Malaysian Bar has been advocating a Common Bar Course (CBC) and Examination (CBE) since the 1980s as a single entry point to the legal profession for both local and foreign law graduates. [12]

Early in March 2011, the Attorney-General announced that the Legal Qualifying Board was considering implementing the CBC. Court of Appeal judge Datuk Abdul Wahab Patail is chairing a working group to study its implementation. The CBC would be a 20-month course that would also focus on vocational skills. The CBC model combines the modern legal education approaches in other Commonwealth countries as well as local requirements. There will be modules not commonly seen in other courses to meet specific needs among local graduates, such as the Legal Language and Communication Skills to address the poor command of English and the Practice Management Skills to expose lawyers intending to start their own firm on risk management. Of the five semesters, the first three are full-time studies while the final two are part-time, where students will be pupils at law firms concurrently. It will also feature a Student Law Office programme where the “students-at-law” will get to practice what they have learned in a simulated legal environment, which has been successfully carried out in Universiti Teknologi MARA. [13]

Universiti Teknologi Petronas Private university in Perak, Malaysia

Universiti Teknologi PETRONAS (UTP) is a Malaysian research university established 10 January 1997. It is wholly owned by Petroliam Nasional Berhad (PETRONAS), Malaysia's oil and gas multinational corporation. The campus is built on 400 hectares in the new township of Seri Iskandar, Perak, Malaysia.

University of Technology Malaysia Public university in Malaysia

University of Technology Malaysia (UTM) is a premier Malaysian public research-intensive university ranked 187th in the world by QS University rankings. Its medium of instruction is English.

The Postgraduate Certificate in Laws is an intensive one-year full-time professional legal qualification programme in Hong Kong. It allows graduates to proceed to legal training before qualifying to practice as either a barrister or a solicitor in Hong Kong. The "LL." of the abbreviation for the certificate is from the genitive plural legum. The programme can be seen as the equivalent of the Legal Practice Course (LPC) or the Bar Professional Training Course (BPTC) in England and Wales, or the Certificate in Legal Practice (Malaysia) (CLP) in Malaysia which focuses heavily on practical and procedural issues in legal practice, unlike a first degree in law.

Common Professional Examination

The Common Professional Examination/Postgraduate Diploma in Law (CPE/PGDL) is a postgraduate law course in England and Wales that is taken by non-law graduates wishing to become either a solicitor or barrister in England and Wales. It is being replaced by the Solicitor Qualifying Examination (SQE) which was introduced on 1 September 2021.

A law school is an institution specializing in legal education, usually involved as part of a process for becoming a lawyer within a given jurisdiction.

The Master of Public Health or Master of Philosophy in Public Health (M.P.H.), Master of Science in Public Health (MSPH), Master of Medical Science in Public Health (MMSPH) and the Doctor of Public Health (Dr.P.H.), International Masters for Health Leadership (IMHL) are interdisciplinary professional degrees awarded for studies in areas related to public health. The MPH degree focuses on public health practice, as opposed to research or teaching. Master of Public Health programs are available throughout the world in Schools of Public Health, Programs in Public Health, Medical Schools, and Schools of Public Affairs. MPH degrees, in addition to including a core curriculum, will usually also let students pursue a specialization in a specific field, such as epidemiology, biostatistics, or health management.

INTEC Education College

INTEC Education College (INTEC), formerly known as the Centre for Preparatory Studies or Pusat Pendidikan Persediaan (PPP), Overseas Preparatory Programme (OPP) or Program Persediaan Luar Negeri (PPLN), and the International Education Centre (INTEC)International Education College (INTEC). The institution is the place where students undergo specially prepared programs before they further their studies abroad in countries such as the United States, United Kingdom, Germany, France, Australia, Korea and Japan. They are now also providing professional accountancy courses such as ACCA and CIMA.

UiTM Faculty of Law is one of the professional graduate faculties of UiTM and is located in Shah Alam, Malaysia. It is among the notable public premier law school in Malaysia.

UiTM Football Club is a Malaysian professional football club based in Shah Alam, Selangor, Malaysia. The club plays in the Malaysia Super League. Founded in 2008, their home ground is 10,000-seater UiTM Stadium. The club widely known as The Lion Troops.

Universiti Teknologi MARA Malaysian public university

The MARA University of Technology is a public university based primarily in Shah Alam, Selangor. It was established to help rural Malays in 1956 as the RIDA Training Centre, and opened with around 50 students. It has since grown into the largest institution of higher education in Malaysia as measured by physical infrastructure, faculty and staff, and student enrollment.

Universiti Teknologi MARA, Perlis

Universiti Teknologi MARA (UiTM) Cawangan Perlis is one of the branch campus of Universiti Teknologi MARA located in Arau, Perlis, Malaysia. It was established in 1974 at Kangar, making it as the third oldest UiTM campus in the whole country. In 1980, the campus moved to their permanent location in Arau. Dato’ Eddin Syazlee bin Shith is a Malaysian politician who has served as Deputy Minister in the Prime Minister's Department in charge of Economic Affairs in the Barisan Nasional (BN) administration under Prime Minister Ismail Sabri Yaakob and Minister Mustapa Mohamed since August 2021. He served as the Deputy Minister of Works in the Perikatan Nasional (PN) administration under former Prime Minister Muhyiddin Yassin and former Minister Fadillah Yusof from July 2020 to August 2021 and Member of Parliament (MP) for Kuala Pilah since May 2018. He briefly served as the Deputy Minister in the Prime Minister's Department in charge of Parliament and Law in the PN administration under Muhyiddin and former Minister Takiyuddin Hassan from March 2020 to July 2020. He also served as the Deputy Minister of Communications and Multimedia in the Pakatan Harapan (PH) administration under former Prime Minister Mahathir Mohamad and former Minister Saifuddin Abdullah from July 2018 to February 2020. He is a member and the State Chairman of Negeri Sembilan of the Malaysian United Indigenous Party (BERSATU), a component party of the PN and formerly PH coalitions.

Rahmat Mohamad

Professor Dato' Dr. Rahmat bin Mohamad is a Malaysian legal scholar and professor of law at the Universiti Teknologi MARA. He is currently the Chairman of the Human Rights Commission of Malaysia (SUHAKAM).
