The Marland report, officially Education of the Gifted and Talented: Report to Congress, is a 1972 report to the Congress of the United States by Sidney P. Marland Jr., which contains a widely known definition of giftedness of children. It is the first national report on gifted education. One of its most compelling major findings was:
Gifted and Talented children are, in fact, deprived and can suffer psychological damage and permanent impairment of their abilities to function well which is equal to or greater than the similar deprivation suffered by any other population with special needs served by the Office of Education.

The deleterious effects of failing to provide GT services is corroborated by recent research:
National efforts to increase the availability of a variety of appropriate instructional and out-of-school provisions must be a high priority since research indicates that many of the emotional or social difficulties gifted students experience disappear when their educational climates are adapted to their level and pace of learning." [emphasis added] [1]

Regarding the final point, after nearly five decades, the Federal government's stance is unchanged, allocating 0.02% of its budget (approximately $13.5 million of $66.6 billion in FY 2021) to GT education via the Jacob Javits Gifted and Talented Students Education Act. Intellectual giftedness is an intellectual ability significantly higher than average. It is a characteristic of children, variously defined, that motivates differences in school programming. It is thought to persist as a trait into adult life, with various consequences studied in longitudinal studies of giftedness over the last century. These consequences sometimes includes stigmatizing and social exclusion. There is no generally agreed definition of giftedness for either children or adults, but most school placement decisions and most longitudinal studies over the course of individual lives have followed people with IQs in the top 2.5 percent of the population—that is, IQs above 130. Definitions of giftedness also vary across cultures.

The No Child Left Behind Act of 2001 (NCLB) was a U.S. Act of Congress promoted by the Presidency of George W. Bush. It reauthorized the Elementary and Secondary Education Act and included Title I provisions applying to disadvantaged students. It mandated standards-based education reform based on the premise that setting high standards and establishing measurable goals could improve individual outcomes in education. To receive federal school funding, states had to create and give assessments to all students at select grade levels.
Jacob Koppel Javits was an American lawyer and politician. During his time in politics, he represented the state of New York in both houses of the United States Congress. A member of the Republican Party, he also served as the state's Attorney General. Generally considered a liberal Republican, he was often at odds with his own party. A supporter of labor unions, the Great Society, and the civil rights movement, he played a key role in the passing of civil rights legislation. An opponent of the Vietnam War, he drafted the War Powers Resolution in 1973.
The Individuals with Disabilities Education Act (IDEA) is a piece of American legislation that ensures students with a disability are provided with a Free Appropriate Public Education (FAPE) that is tailored to their individual needs. IDEA was previously known as the Education for All Handicapped Children Act (EHA) from 1975 to 1990. In 1990, the United States Congress reauthorized EHA and changed the title to IDEA. Overall, the goal of IDEA is to provide children with disabilities the same opportunity for education as those students who do not have a disability.
An unfunded mandate is a statute or regulation that requires any entity to perform certain actions, with no money provided for fulfilling the requirements. This can be imposed on state or local government, as well as private individuals or organizations. The key distinction is that the statute or regulation is not accompanied by funding to fulfill the requirement
The Low Income Home Energy Assistance Program is a United States federal social services program first established in 1981 and funded annually through Congressional appropriations. The mission of LIHEAP is to assist low income households, particularly those with the lowest incomes that pay a high proportion of household income for home energy, primarily in meeting their immediate home energy needs. The program, part of the United States Department of Health and Human Services (HHS), is funded by grants appropriated from the federal government.
Center for Talent Development (CTD), established in 1982, is a direct service and research center in the field of gifted education and talent development based at Northwestern University.
Education in Western Australia consists of public and private schools in the state of Western Australia, including public and private universities and TAFE colleges. Public school education is supervised by the Department of Education, which forms part of the Government of Western Australia. The School Curriculum and Standards Authority is an independent statutory authority responsible for developing a curriculum and associated standards in all schools, and for ensuring standards of student achievement, and for the assessment and certification according to those standards.
A therapeutic boarding school is a residential school offering therapy for students with emotional or behavioral issues. The National Association of Therapeutic Schools and Programs listed 140 schools and programs as of 2005. Many therapeutic boarding schools in the United States have been connected to the abusive troubled teen industry.
Cluster grouping is an educational process in which four to six gifted and talented (GT) or high-achieving students or both are assigned to an otherwise heterogeneous classroom within their grade to be instructed by a teacher who has had specialized training in differentiating for gifted learners. Clustering can be contrasted with other ability-grouping strategies in which high achievers fill their own dedicated class, entirely separate from other students.
Gifted students are outstanding learners who are not usually considered at risk of academic failure or problems. However, gifted students can still underachieve. There are risks related to the student's giftedness. This concept was formally set forth in 1972 in the U.S. in the Marland Report:

The Kilah Davenport Child Protection Act of 2013 is a law that broadens the coverage of current laws that address domestic assaults by certain repeat offenders. The law also requires the United States Department of Justice to write a report on child abuse prevention laws in all U.S. states and territories, "with a particular focus on penalties for cases of severe child abuse."
The Strengthening Transparency in Higher Education Act is a bill that would reserve $1 million from funding for the United States Department of Education to replace the current College Navigator website with a new website and change the type of information that the website would need to provide. The bill also would amend the requirements for the department’s net-price calculator, which provides details on the costs of post-secondary education. The purpose of the bill is to help students get the facts they need to make a wise decision about where to go to college.
The Emergency Medical Services for Children Reauthorization Act of 2014 is a bill that would amend the Public Health Service Act to reauthorize the Emergency Medical Services for Children Program through FY2019. The bill would authorize appropriations of about $20 million in 2015 and $101 million over the 2015-2019 period.
Julia Link Roberts is an American scholar of gifted education. In 2004, she was described as one of the fifty-five most influential people in the field. She is the Mahurin Professor of Gifted Studies at Western Kentucky University, and the executive director of The Center for Gifted Studies at Western Kentucky University and The Carol Martin Gatton Academy of Mathematics and Science in Kentucky.
The federal government of the United States has limited authority to act on education, and education policy serves to support the education systems of state and local governments through funding and regulation of elementary, secondary, and post-secondary education. The Department of Education serves as the primary government organization responsible for enacting federal education policy in the United States.
