The New York Dream Act is 2019 New York State law offering state-funded financial aid and scholarships to attend university to undocumented youth who arrived in the United States before the age of 18, a group often referred to as "DREAMers" and defined by the DREAM Act.

Bill

The bill makes students who attended a high school in New York State and graduated or passed a high school equivalency test eligible to apply for taxpayer-funded financial assistance. [1]


Political debate

The Democratic Party was in control of both houses of the state legislature and held the Governorship when the bill was passed. [2]

The New York Act is seen as part of the Democratic Party’s increasingly progressive left wing position on immigration. [3] [4] [5] [6] It was opposed by Republican politicians arguing that it diverts public funds from supporting the education of citizens of the United States. [5] [7]

DREAM Act American legislative proposal on immigration

The Development, Relief, and Education for Alien Minors Act, known as the DREAM Act, is a United States legislative proposal to grant temporary conditional residency, with the right to work, to qualifying immigrants who entered the United States as minors—and, if they later satisfy further qualifications, they would attain permanent residency.

Plyler v. Doe, 457 U.S. 202 (1982), was a case in which the Supreme Court of the United States struck down both a state statute denying funding for education to undocumented immigrant children in the United States and a municipal school district's attempt to charge an annual $1,000 tuition fee for each student to compensate for lost state funding. The Court found that any state restriction imposed on the rights afforded to children based on their immigration status must be examined under an rational-basis standard to determine whether it furthers a "substantial" government interest.

The California DREAM Act is a package of California state laws that allow children who were brought into the US under the age of 16 without proper visas/immigration documentation who have attended school on a regular basis and otherwise meet in-state tuition and GPA requirements to apply for student financial aid benefits. It and past similarly named legislation have been authored by California State Senator Gil Cedillo.

David Carlucci

David Carlucci is an American politician in Rockland County, New York. A member of the Democratic Party, he is the state senator for the 38th district, which includes most of Rockland County and parts of Westchester County. Carlucci was one of the youngest senators elected to the New York State Senate in 2010 at just 29-years-old.[3] Carlucci now serves as the chair of the Committee on Mental Health and Developmental Disabilities.

Matt Cartwright American politician and attorney

Matthew Alton Cartwright is an American politician and lawyer who is the United States Representative from Pennsylvania's 8th congressional district since 2013. The district, numbered as the 17th district from 2013 through 2019, includes a large swath of northeastern Pennsylvania, anchored by Scranton, Wilkes-Barre, and the Poconos. A member of the Democratic Party, Cartwright defeated 10-term incumbent Blue Dog Tim Holden, the Dean of the Pennsylvania Congressional delegation, in the Democratic primary on April 24, 2012, by a 57%-43% margin. Cartwright went on to defeat Republican Laureen Cummings in the general election on November 6, 2012, by a 61%-39% margin. As an attorney, Cartwright previously worked at the law firm of Munley, Munley, and Cartwright.

Luis R. Sepúlveda is an American attorney and politician who serves as the New York State Senator from the 32nd Senate District in the Bronx, New York.

Undocumented youth are young people living in the United States without U.S. citizenship or other legal immigration status. An estimated 1.1 million undocumented minors resided in the U.S. as of 2010, making up 16% of the undocumented population. Undocumented students face unique legal uncertainties and limitations within the United States educational system. They are sometimes called the 1.5 generation, as they have spent a majority of their lives in the United States.

Prerna Lal

Prerna Lal is a United States citizen, born and raised in Fiji Islands with roots in the San Francisco Bay Area. Lal is a founder of DreamActivist, an online advocacy network led by undocumented youth. Through the use of social media, Lal has been credited for organising an online network to stop the deportations of undocumented youth and they are well known as one of the pivotal figures and leaders of the DREAM Act movement. A clinical law professor, Lal is a frequent writer on immigration, racial justice, sexual orientation, and how these forces intersect. Lal is a graduate of The George Washington University Law School, and works as an immigration attorney.

Brooke Lierman

Brooke E. Lierman is an elected official in the U.S. state of Maryland who serves District 46 in the Maryland House of Delegates since 2015. She is a member of the Democratic Party.

Rob Ortt American politician

The district is located around the border of Nassau County and Suffolk County, encompassing the town of Huntington and the northern part of the town of Oyster Bay. Gaughran is a member of the Democratic Party.
