Patent engineer

A patent engineer or patent scientist is a patent professional who is typically involved in preparing and prosecuting patent applications. The terms are usually applied to patent professionals with scientific or engineering backgrounds that do not require either attorney or patent agent qualifications, but still work with patent applications. In general, the position involves many of the technical aspects of patent prosecution, including doing background and prior art searches, preparing the description and drawings for patent applications, and giving technical expertise during invention evaluation.[ citation needed ] Positions of this nature may focus a great deal on research and development while including patent considerations, emphasizing their technical background rather than legal or patent agent qualification.[ citation needed ]

Patent scientists and engineers often pursue either patent agent qualification and/or attend law school (this applies in the U.S. but not in Europe) to become patent attorneys. [1]

The term is used differently in different countries, and thus may or may not require the same legal qualifications as a general legal practitioner.

Patent prosecution describes the interaction between applicants and their representatives, and a patent office with regard to a patent, or an application for a patent. Broadly, patent prosecution can be split into pre-grant prosecution, which involves arguing before, and sometimes negotiation with, a patent office for the grant of a patent, and post-grant prosecution, which involves issues such as post-grant amendment and opposition.

The European Patent Convention (EPC), the multilateral treaty providing the legal system according to which European patents are granted, contains provisions regarding whether a natural or juristic person needs to be represented in proceedings before the European Patent Office (EPO).

In the United Kingdom, a Chartered Engineer (CEng) is an engineer registered with the UK's regulatory body for the engineering profession, the Engineering Council. Chartered Engineers are degree-qualified or can demonstrate equivalent work-based learning and have gained the appropriate professional competencies through education and working experience. Demonstration of competence is defined in the UK Standard for Professional Engineering Competence, assessed through professional review of academic qualifications and professional development. Formal, non-formal and informal learning can be assessed. The title Chartered Engineer is protected in the UK under law by means of the Engineering Council’s Royal Charter and Bye-laws. As of 2019 there are approximately 180,000 engineers registered as a Chartered Engineer. Chartered Engineers are registered through Professional Engineering Institutions (PEIs) licensed by the Engineering Council which are relevant to their industry or specialism.

Under case number G 3/08, the Enlarged Board of Appeal of the EPO issued on May 12, 2010 an opinion in response to questions referred to it by the President of the European Patent Office (EPO), Alison Brimelow, on October 22, 2008. The questions subject of the referral related to the patentability of programs for computers under the European Patent Convention (EPC) and were, according to the President of the EPO, of fundamental importance as they related to the definition of "the limits of patentability in the field of computing." In a 55-page long opinion, the Enlarged Board of Appeal considered the referral to be inadmissible because no divergent decisions had been identified in the referral.
