The Periodic Report of the United States of America to the United Nations Committee Against Torture is periodically submitted by the United States government, through the State Department, to the United Nations Committee Against Torture. In October 2005, the report focused on the detention of suspects in the War on Terror, including those held in Guantánamo Bay. This particular Periodic Report is significant as the first official response of the U.S. government to allegations that prisoners are mistreated in Guantánamo Bay and in Afghanistan. The report denies those allegations. The report does not address detainees held by the Central Intelligence Agency.

An unlawful combatant, illegal combatant or unprivileged combatant/belligerent is a person who directly engages in armed conflict in violation of the laws of war and therefore is claimed not to be protected by the Geneva Conventions. The International Committee of the Red Cross points out that the terms "unlawful combatant", "illegal combatant" or "unprivileged combatant/belligerent" are not defined in any international agreements. While the concept of an unlawful combatant is included in the Third Geneva Convention, the phrase itself does not appear in the document. Article 4 of the Third Geneva Convention does describe categories under which a person may be entitled to prisoner of war status. There are other international treaties that deny lawful combatant status for mercenaries and children.
Riduan Isamuddin, also known by the nom de guerreHambali, is the former military leader of the Indonesian terrorist organization Jemaah Islamiyah (JI). He is now in American custody at Guantanamo Bay detainment camp in Cuba. He is currently awaiting trial in a military commission.
Mohamedou Ould Slahi is a Mauritanian citizen who was detained at Guantánamo Bay detention camp without charge from 2002 until his release on October 17, 2016.
Enemy combatant is a term for a person who, either lawfully or unlawfully, engages in hostilities for the other side in an armed conflict, used by the U.S. government and media during the War on terror. Usually enemy combatants are members of the armed forces of the state with which another state is at war. In the case of a civil war or an insurrection "state" may be replaced by the more general term "party to the conflict".
Extrajudicial prisoners of the United States, in the context of the early twenty-first century War on Terrorism, refers to foreign nationals the United States detains outside of the legal process required within United States legal jurisdiction. In this context, the U.S. government is maintaining torture centers, called black sites, operated by both known and secret intelligence agencies. Such black sites were later confirmed by reports from journalists, investigations, and from men who had been imprisoned and tortured there, and later released after being tortured until the CIA was comfortable they had done nothing wrong, and had nothing to hide.

Hassan Muhammad Salih bin Attash is a citizen of Saudi Arabia, held by the United States in the Guantanamo Bay detention camp in Cuba. Joint Task Force Guantanamo counter-terrorism analysts estimate that bin Attash was born in 1985, in Jeddah, Saudi Arabia.
The Guantanamo Bay detention camp is a United States military prison within the Guantanamo Bay Naval Base, also referred to as Gitmo, on the coast of Guantánamo Bay in Cuba. As of April 2023, of the 779 people detained there since January 2002 when the military prison first opened after the September 11 attacks, 740 had been transferred elsewhere, 30 remained there, and 9 had died while in custody.

Sami Abdul Aziz Salim Allaithy Alkinani is an Egyptian professor who was held in the Guantanamo Bay detention camps, in Cuba. His Guantanamo Internment Serial Number was 287. Analysts reported that he was born on October 28, 1956, in Shubrakass Egypt. He was repatriated to Egypt on September 30, 2005. He was later classified by the United States Department of Defense as a no longer enemy combatant.
Hammdidullah, a.k.a.Janat Gul, is a citizen of Afghanistan who was held in extrajudicial detention in the Guantanamo Bay detention camps as part of the War on Terror. American counter-terror analysts estimate he was born in 1973, in Sarpolad, Afghanistan.
Adel Hassan Hamad is a citizen of Sudan, who was held in the United States Guantanamo Bay detention camp, in Cuba. Joint Task Force Guantanamo counter-terrorism analysts estimate he was born in 1958, in Port Sudan, Sudan. Adel Hassan was repatriated to Sudan without charges on December 12, 2007.

Mohammed Ahmad Ghulam Rabbani is a citizen of Pakistan who was extrajudicially detained by the United States military at the Guantanamo Bay detention camp in Cuba from 2004 to 2023. He was never charged with a crime, was never tried, and was a subject of enhanced interrogation techniques.
Moath Hamza Ahmed al-Alwi is a citizen of Yemen, held in extrajudicial detention in the United States Guantanamo Bay detainment camps, in Cuba. His detainee ID number is 28. Guantanamo analysts estimated he was born in 1977, in Bajor, Yemen.
Mohammed Abdul Malik Bajabu is a citizen of Kenya currently held in administrative detention in the United States' Guantanamo Bay detention camps, in Cuba. He was born in Busia, Uganda in 1973, but has Kenyan citizenship. Abdul Malik was captured in February 2007, on suspicion of leading a terrorist bomb-plot in Mombasa. He was transferred to Guantanamo on 26 March 2007. Abdul Malik is a confirmed member of the East Africa al-Qaeda network as well as a confirmed member of the Council of Islamic Courts and the Islamic Part of Kenya. He "actively participated" in the facilitation of weapons and the planning of terrorist acts against the U.S., according to the Joint Task Force (JTF) at Guantanamo Bay. He was recommended for continued detention under the Department of Defense's control. The JTF gave Abdul Malik a high risk threat against the United States' interests and allies. He has no reports of disciplinary infractions as of May 22, 2007, granting him a low detention risk value. Abdul Malik does, however, have a high intelligence value.

Rafiq Bin Bashir Bin Jalud al Hami is a citizen of Tunisia, who was formerly held for over seven years without charge or trial in the United States's Guantanamo Bay detention camps, in Cuba. His Guantanamo Internment Serial Number was 892. The Department of Defense reports that he was born on 14 March 1969, in Tunisia.
