The rule of four is a US Supreme Court practice that permits four of the nine justices to grant a writ of certiorari. It has the specific purpose to prevent a majority of the Court's members from controlling their docket.
The rule of four is not required by the US Constitution, any law, or even the Court's own published rules. Rather, it is a custom that has been observed since the Court was given discretion on hearing appeals by the Judiciary Act of 1891, Judiciary Act of 1925, and the Supreme Court Case Selections Act of 1988. [1]
The "Rule of Four" has been explained by various Justices in judicial opinions throughout the years. [2] For example, Justice Felix Frankfurter described the rule as follows: "The 'rule of four' is not a command of Congress. It is a working rule devised by the Court as a practical mode of determining that a case is deserving of review, the theory being that if four Justices find that a legal question of general importance is raised, that is ample proof that the question has such importance. This is a fair enough rule of thumb on the assumption that four Justices find such importance on an individualized screening of the cases sought to be reviewed." [3]
The Rule of Four in general has remained constant for some time in which it takes at least four affirmative votes to grant a petition for certiorari, but the ancillary aspects of it have changed throughout the years, and Justices have not always agreed about these aspects. [4]
A good example is found in dueling opinions (for themselves alone, not opinions of the Court), in Roe v. Wade Pac. R. Co., Justice Frankfurter and Justice John Marshall Harlan II discussed their understandings of the conventions surrounding the Rule of Four. [5] In particular, the Justices disagreed as to whether once certiorari has been properly granted by the vote of four Justices, all Justices were then to rule on the merits of the petition, rather than to vote to dismiss it. Justice Frankfurter did not agree that Justices were required to reach the merits of a petition, even if it was properly granted, but Justice Harlan disagreed and felt that even if he disagreed with a grant of certiorari, the Rule of Four "requires that once certiorari has been granted a case should be disposed of on the premise that it is properly heard, in the absence of considerations appearing which were not manifest or fully apprehended at the time certiorari was granted." In law, certiorari is a court process to seek judicial review of a decision of a lower court or government agency. Certiorari comes from the name of an English prerogative writ, issued by a superior court to direct that the record of the lower court be sent to the superior court for review. The term is Latin for "to be made more certain", and comes from the opening line of such writs, which traditionally began with the Latin words "Certiorari volumus...".
John Marshall Harlan was an American lawyer and jurist who served as an associate justice of the U.S. Supreme Court from 1955 to 1971. Harlan is usually called John Marshall Harlan II to distinguish him from his grandfather, John Marshall Harlan, who served on the U.S. Supreme Court from 1877 to 1911.
Board of Education, Island Trees Union Free School District No. 26 v. Pico, 457 U.S. 853 (1982), was a landmark case in which the United States Supreme Court split on the First Amendment issue of local school boards removing library books from junior high schools and high schools. Four Justices ruled that it was unconstitutional, four Justices concluded the contrary, and one Justice concluded that the court need not decide the question on the merits. Pico was the first Supreme Court case to consider the right to receive information in a library setting under the First Amendment, but the court's fractured plurality decision left the scope of this right unclear.
The Supreme Court of the United States is the highest court in the federal judiciary of the United States. The procedures of the Court are governed by the U.S. Constitution, various federal statutes, and its own internal rules. Since 1869, the Court has consisted of one chief justice and eight associate justices. Justices are nominated by the president, and with the advice and consent (confirmation) of the U.S. Senate, appointed to the Court by the president. Once appointed, justices have lifetime tenure unless they resign, retire, or are removed from office.
MANual Enterprises, Inc. v. Day, 370 U.S. 478 (1962), is a decision by the Supreme Court of the United States in which the Court held that magazines consisting largely of photographs of nude or near-nude male models are not considered "obscene" within the meaning of 18 U.S.C. § 1461, which prohibits the mailing of obscene material. It was the first case in which the Court engaged in plenary review of a Post Office Department order holding obscene matter "nonmailable".
Toolson v. New York Yankees, 346 U.S. 356 (1953), is a United States Supreme Court case in which the Court upheld, 7–2, the antitrust exemption first granted to Major League Baseball (MLB) three decades earlier in Federal Baseball Club v. National League. It was also the first challenge to the reserve clause which prevented free agency, and one of the first cases heard and decided by the Warren Court.
Oyler v. Boles, 368 U.S. 448 (1962), was a case heard by the Supreme Court of the United States.
Schmerber v. California, 384 U.S. 757 (1966), was a landmark United States Supreme Court case in which the Court clarified the application of the Fourth Amendment's protection against warrantless searches and the Fifth Amendment right against self-incrimination for searches that intrude into the human body. Until Schmerber, the Supreme Court had not yet clarified whether state police officers must procure a search warrant before taking blood samples from criminal suspects. Likewise, the Court had not yet clarified whether blood evidence taken against the wishes of a criminal suspect may be used against that suspect in the course of a criminal prosecution.
Constitutional avoidance is a legal doctrine of judicial review in United States constitutional law that dictates that United States federal courts should refuse to rule on a constitutional issue if the case can be resolved without involving constitutionality. In Ashwander v. Tennessee Valley Authority (1936), the Supreme Court of the United States established a seven-rule test for the justiciability of controversies presenting constitutional questions:

Quantity of Books v. Kansas, 378 U.S. 205 (1964), is an in rem United States Supreme Court decision on First Amendment questions relating to the forfeiture of obscene material. By a 7–2 margin, the Court held that a seizure of the books was unconstitutional, since no hearing had been held on whether the books were obscene, and it reversed a Kansas Supreme Court decision that upheld the seizure.
Nevada Commission on Ethics v. Carrigan, 564 U.S. 117 (2011), was a Supreme Court of the United States decision in which the court held that the Nevada Ethics in Government Law, which required government officials recuse in cases involving a conflict of interest, is not unconstitutionally overbroad. Specifically, the law requires government officials to recuse themselves from advocating for and voting on the passage of legislation if private commitments to the interests of others materially affect the official's judgment. Under the terms of this law, the Nevada Commission on Ethics censured city councilman Michael Carrigan for voting on a land project for which his campaign manager was a paid consultant. Carrigan challenged his censure in court and the Nevada Supreme Court ruled in his favor, claiming that casting his vote was protected speech. The Supreme Court reversed, ruling that voting by a public official on a public matter is not First Amendment speech.
Breithaupt v. Abram, 352 U.S. 432 (1957), was a United States Supreme Court case in which the Court ruled that involuntary blood samples, taken by a skilled technician to determine intoxication, do not violate substantive due process under the Fourteenth Amendment of the United States Constitution. This case was only the second time the Court considered whether police could forcibly enter inside a suspect's body to extract evidence. Writing for a 6–3 majority, Justice Tom C. Clark argued that blood tests were necessary as a matter of public policy to ensure traffic safety on roads and highways, and that "modern community living requires modern scientific methods of crime detection." Chief Justice Earl Warren and Justice William O. Douglas both wrote dissenting opinions in which they argued that the involuntary blood sample taken in this case was "repulsive" and violated substantive due process.
Lucia v. Securities and Exchange Commission, 585 U.S. 237 (2018), was a decision by the Supreme Court of the United States on the status of administrative law judges of the Securities and Exchange Commission. The Court held that they are considered inferior officers of the United States and so are subject to the Appointments Clause and must be appointed through the President or other delegated officer of the United States, rather than hired. As "inferior" officers, their appointments are not subject to the Senate's advice and consent role.
Kisor v. Wilkie, No. 18-15, 588 U.S. ___ (2019), was a US Supreme Court case related to the interpretation by an executive agency of its own ambiguous regulations. The case involved a veteran who had been denied some benefits from the United States Department of Veterans Affairs due to the agency's interpretation of its regulations. The case challenges the "Auer deference" established in the 1997 case Auer v. Robbins, in which the judiciary branch of the government normally defers to an agency's own interpretation of its own regulations in resolving matters of law. Lower courts, including the Federal Appeals Circuit Courts, ruled against the veteran, acknowledging the Auer deference.
Gundy v. United States, 588 U.S. 128 (2019), was a United States Supreme Court case that held that 42 U.S.C. § 16913(d), part of the Sex Offender Registration and Notification Act ("SORNA"), does not violate the nondelegation doctrine. The section of the SORNA allows the Attorney General to "specify the applicability" of the mandatory registration requirements of "sex offenders convicted before the enactment of [SORNA]". Precedent is that it is only constitutional for Congress to delegate legislative power to the executive branch if it provides an "intelligible principle" as guidance. The outcome of the case could have greatly influenced the broad delegations of power Congress has made to the federal executive branch, but it did not.
United States v. Arthrex, Inc., 594 U.S. ___ (2021), was a United States Supreme Court case related to the Appointments Clause of the United States Constitution as it related to patent judges on the Patent Trial and Appeal Board (PTAB). In a complex decision, the Court ruled that these judges were considered "principal officers" under the Appointments Clause, normally subject to appointment through the US President and the US Senate, but to remedy the matter, the Court ruled that the constitutional issue is resolved by allowing the PTAB decisions to be subject to review by the appropriately-appointed Director of the Patent Office.
The shadow docket refers to motions and orders in the Supreme Court of the United States in cases which have not yet reached final judgment, decision on appeal, and oral argument. This especially refers to stays and injunctions, but also includes summary decisions and grant, vacate, remand (GVR) orders. The phrase "shadow docket" was first used in this context in 2015 by University of Chicago Law professor William Baude.
Pennekamp v. Florida, 328 U.S. 331 (1946), was a Supreme Court case in which the court held that a Florida circuit court which held the Miami Herald in contempt of court for publishing a scathing publication of that court was a violation of the First and Fourteenth Amendment. The unanimous court reversed the judgement of the Supreme Court of Florida which affirmed the contempt of court charge.
Brown v. Allen, 344 U.S. 443 (1953), is a landmark United States Supreme Court case about habeas corpus.
