Restraint and seclusion is a highly controversial practice in the special education system involving holding students down physically or involuntarily locking students in seclusion rooms. [1] In United States public schools, the practices of restraint and seclusion are not regulated on the federal level. All but four of the 50 U.S. states have regulations on portions of these practices. [2]
Seclusion and restraint are often misused in both public and private schools causing severe injury and trauma for students. restraint and seclusion are often used as punishment for minor behavioral problems. [3] [4] these issues have caused people to call the practices a human rights issue, disabled rights issue, and civil rights issue. There is a recorded surveillance video of an 8 year old being dragged by 3 staff members into a seclusion room/padded cell with no windows. after the door had been opened he was found laying in his own blood. his mother had called it a battle between adults and a child and said "I challenge the experts to show us anywhere how this helps the behavior. How this isn’t traumatizing. Because you can’t. There is no positive thing that comes from this," Linda said. "It doesn't change behavior. It re-traumatizes children. And it opens them up to injuries and all other kinds of things. Why are you continuing to do this?" [5]
Seclusion can occur in any room someone can be locked alone in. most fit the definition for padded cells. [6] While most seclusion rooms could be called padded cells not all are padded. [7]
Restraints are defined by the U.S. Department of Education as "a personal restriction that immobilizes or reduces the ability of a student to move his or her torso, arms, legs, or head freely". [8]
Prone restraints are a practice where students are physically held, face-down, on the floor. [8]
Seclusion is defined by the Department of Education as "the involuntary confinement of a student alone in a room or area from which the student is physically prevented from leaving". [8]
Although these practices are not regulated at the federal level, federal guidelines suggest these practices should never be used except if a student's behavior "poses imminent danger of serious physical harm to self or others". [8]
Restraint and seclusion are legal in Connecticut. The acts were recorded to have taken place tens of thousands of times per year for over a decade, especially to Black students and students with autism. A bill introduced in 2023, SB 1200, would replace seclusion with a time-out in an unlocked room and limit when restraint is allowed. [9] [10]
Prone restraints are permitted in Vermont, though strictly limited. In 2022, Harwood Union Unified School District put a temporary halt to the practice while a task force would examine the district's use of the tactics. [8]

Physical restraint refers to means of purposely limiting or obstructing the freedom of a person's or an animal's bodily movement.
Special education is the practice of educating students in a way that accommodates their individual differences, disabilities, and special needs. This involves the individually planned and systematically monitored arrangement of teaching procedures, adapted equipment and materials, and accessible settings. These interventions are designed to help individuals with special needs achieve a higher level of personal self-sufficiency and success in school and in their community, which may not be available if the student were only given access to a typical classroom education.
School discipline relates to actions taken by teachers or school organizations toward students when their behavior disrupts the ongoing educational activity or breaks a rule created by the school. Discipline can guide the children's behavior or set limits to help them learn to take better care of themselves, other people and the world around them.
UConn Health is a healthcare system and hospital, and branch of the University of Connecticut that oversees clinical care, advanced biomedical research, and academic education in medicine. The system is funded directly by the State of Connecticut and the University’s financial endowment. Its primary location, UConn John Dempsey Hospital, is a teaching hospital located in Farmington, Connecticut, in the US. The Association for Behavior Analysis International (ABAI) is a nonprofit organization dedicated to promoting behavior analysis. The organization has over 9,000 members. The group organizes conferences and publishes journals on the topic of applied behavior analysis (ABA). ABAI has issued detailed, specific position papers intended to guide practitioners of ABA. The ABAI publishes six scholarly journals including The Psychological Record and their primary organ, Perspectives on Behavior Science, formerly The Behavior Analyst. They also publish an informational journal, Education and Treatment of Children, describing practical treatment of children with behavioral problems.

A padded cell or seclusion room is a controversial enclosure used in a psychiatric hospital or a special education setting in a private or public school, in which there are cushions lining the walls and sometimes has a cushioned floor as well. The padding is an attempt to prevent patients from hurting themselves by hitting their head on the hard surface of the walls. In most cases, an individual's placement in a padded cell is involuntary.

The Council of Parent Attorneys and Advocates (COPAA) is an independent national American association of parents of children with disabilities, attorneys, advocates, and related professionals who protect the legal and civil rights of students with disabilities and their families. COPAA has a 22-member Board of Directors who run the organization. Board members are selected to be representative of diversity of COPAA's peer-to-peer network and have significant experience in various aspects of COPAA's work. Currently COPAA has more than 3400 members in all states, the District of Columbia and several territories. Over 90% of all of its members, including professionals, are people with disabilities or parents and family members of people with disabilities. COPAA accomplishes its mission largely through the work of its network of volunteers, who are supported by the staff of the organization.
In the United States, the school-to-prison pipeline (SPP), also known as the school-to-prison link, school–prison nexus, or schoolhouse-to-jailhouse track, is the disproportionate tendency of minors and young adults from disadvantaged backgrounds to become incarcerated because of increasingly harsh school and municipal policies. Additionally, this is due to educational inequality in the United States. Many experts have credited factors such as school disturbance laws, zero-tolerance policies and practices, and an increase in police in schools in creating the "pipeline". This has become a hot topic of debate in discussions surrounding educational disciplinary policies as media coverage of youth violence and mass incarceration has grown during the early 21st century.
The Keeping All Students Safe Act or KASSA is designed to protect children from the abuse of restraint and seclusion in school. The first Congressional bill was introduced in the United States House of Representatives on December 9, 2007, and named the Preventing Harmful Restraint and Seclusion in Schools Act. The primary sponsors of the two bills are Senator Tom Harkin (D-IA), Chair of the Senate Health, Education, Labor, and Pensions Committee, Congressman George Miller (D-CA), Ranking Member of the House Education and Workforce Committee, and Congressman Gregg Harper (R-MS).

Natchaug Elementary School is a public elementary school in Willimantic, Connecticut, United States. The school opened in 1865 at the junction of Milk Street and Jackson Street, in downtown Willimantic. It is part of the Windham Public School system and one of four elementary schools and a K-8 STEM magnet school. Natchaug is accredited by the New England Association of Schools and Colleges. The name Natchaug comes from the Nipmuc word meaning "land between the rivers." The school colors are bright green and blue.
On November 30, 2018, 13-year-old Max Benson, an autistic boy from Davis, California, died at the hospital from cardiac complications as a result of being held in an extended prone physical restraint by staff at his now-defunct K-12 non-public school, Guiding Hands School in El Dorado County, California where he was placed a few months before by Davis Joint Unified School District who denied Max and two other students a Free and Appropriate Education (FAPE).
The first confirmed case of the COVID-19 pandemic in the U.S. state of Connecticut was confirmed on March 8, although there had previously been multiple people suspected of having COVID-19, all of which eventually tested negative. The 2020 Advanced Placement examination controversy involved College Board, a nonprofit education company, allegedly performing a series of potentially illegal activities, including phishing students and creating unfair testing conditions. Estimates indicated that 4,914,000 AP tests were taken online due to the COVID-19 pandemic, with some experiencing technical difficulties while submitting their examinations. In response, a lawsuit was filed against the College Board alleging breach of contract, gross negligence, misrepresentation, unjust enrichment and violations of the Americans with Disabilities Act. The lawsuit was subsequently administratively closed pending the outcome of arbitration between the College Board and the plaintiffs.

Abuse in special education usually refers to the use of restraint and seclusion, but can also refer to students being threatened with violence or staff withholding food. This abuse often leaves students with trauma and can leave the parents feeling guilt for the abuse.
