Early life & Education

Dr. Shahdeen Malik was born in Saruala village of Biswanath Upazila under Sylhet district of Bangladesh. Malik's father, Abdul Malik Chowdhury, was the chief conservatory officer of the Forest Department. [4] Malik obtained LL.B (pass) degree from University of Dhaka. Later, He completed his master's in law at the Patrice Lumumba Peoples' Friendship University of Russia in 1979. [5] He obtained another LL.M degree from the University of Pennsylvania Law School in 1984. [5] He completed his PhD at SOAS, University of London in 1994. [5]

Career

Dr. Shahdeen Malik is a senior advocate of the Supreme Court of Bangladesh and head of chambers of a law firm named Ergo Legal Counsel. Shahdeen Malik’s practice spans over two decades in the Supreme Court and the district court where he was enrolled in 2000 and 1996 respectively. Malik started his practice at Bangladesh Supreme Court in 2003. [5] Before entering law profession, Malik joined the University of Dhaka in 1980 as a lecturer. [5]

Malik joined Bangladesh Legal Aid and Services Trust in 1990. [5] He wrote a book named Public Interest Litigation in South Asia - Rights in Search of Remedies in 1997. [6]

Malik was a founder director and faculty at the law school of BRAC University. [5]

From 2010 to 2019, Malik served at the Bangladesh Institute of Law and International Affairs as an honorary director. [7] He criticised the Fifteen Amendment to the Constitution of Bangladesh, which abolished the caretaker government on 19 July after praising it on 10 July 2011. [8] [9] In 2013, he was the lawyer of the Bangladesh Election Commission. [10]

Malik is a Trustee board member of the Centre for Policy Dialogue. [5] He is a member of the governing body of the ActionAid Bangladesh, and the Refugee and Migratory Movement Research Unit. [5] He is an Independent director of Pubali Bank Limited. [11] He is an adjunct professor at Gono University. [7]

In February 2022, Malik withdrew his name from consideration for the next election commissioner of Bangladesh. [12] He described the speech by the Minister of Law, Anisul Huq, in Geneva defending the human rights record of the government as embarrassing. [13]

Motiur Rahman Nizami was a politician, former Minister of Bangladesh, Islamic scholar, writer and the former leader of the Bangladesh Jamaat-e-Islami. He is noted for leading Al-Badr during the Bangladesh Liberation War. On 29 October 2014, he was convicted of masterminding the Demra massacre by the International Crimes Tribunal of Bangladesh. Nizami was the Member of Parliament for the Pabna-1 constituency from 1991 to 1996 and again from 2001 to 2006. He also served as the Bangladeshi Minister of Agriculture and Minister of Industry.

Hefazat-e-Islam Bangladesh is a far-right conservative-islamic advocacy group consisted mostly of hard-line religious teachers and students. The group is mainly based on qawmi madrasas in Bangladesh. In 2013, they submitted a 13-point charter to the Government of Bangladesh, which included the demand for the enactment of a blasphemy law. Although it started as a fundamentlist group, later it began to drift towards Moderate Islam with Awami League administration recognizing Qawmi Madrasah degrees and forming a anti radical Islamism unity.

Sara Hossain is a Bangladeshi lawyer. She is a barrister in the Supreme Court of Bangladesh. She is the honorary executive director of the Bangladesh Legal Aid and Services Trust (BLAST), a major legal aid provider. She has been at the forefront of advocating for women's rights in Bangladeshi courts and played a key role in drafting legal reforms to protect women. She was the plaintiff's lawyer in the landmark case of Bangladesh National Women Lawyers Association (BNWLW) v. Bangladesh, in which the Supreme Court supported the judicial practice of referring to international human rights law in the absence of domestic legislation. She is known for her role in challenging fatwa violence when a fatwa is issued to mete out punishment to women and girls. She co-edited 'Honour': Crimes, Paradigms and Violence Against Women with Lynn Welchman.

Bangladesh Statue of Justice controversy is a controversy that surrounds the building of a statue of justice at the premises of the Bangladesh Supreme Court. The controversy centers on the statue's depiction of the Themis, the Greek goddess of divine law, wearing a sari. Islamic groups like Hefazat-e-Islam and Bangladesh Awami Olama League consider the statue to be idolatry and have taken legal actions calling for its removal.

The term judicial review is not expressly used in Bangladeshi law, but Article 102 of the Constitution of Bangladesh allows writ petitions to be filed at the High Court Division for reviewing the actions of public authorities, or suspending proceedings in lower courts.
