Tax audit representation, also called audit defense, is a service in which a tax or legal professional stands in on behalf of a taxpayer (an individual or legal entity) during an Internal Revenue Service (IRS) or state income tax audit.

Overview

In the United States, during an income tax audit or examination, the IRS and all states allow a taxpayer to have an authorized representative. [1] The representative must be authorized to practice before the IRS or state, and specific credentials are required. The types of representatives who are allowed to represent taxpayers before the IRS in income tax audits include attorneys, certified public accountants, and enrolled agents. [2]

An audit representative develops the strategy used to defend the taxpayer's position. He or she assists the taxpayer in preparing all documents requested by the taxing authority and typically attends all meetings and handles correspondence on behalf of the taxpayer.

Pre-paid audit representation

While many tax professionals offer audit representation services to their clients, some companies offer pre-paid services. In an August, 1979 article in the Journal of Accountancy, Professors Ray Roberts, CPA and Philip Storrer, CPA proposed the idea of "prepaid tax return audit fees". [3] Addressing the high costs of retaining professional help during an audit, the professors suggested to fellow accountants that they offer their clients the opportunity to prepay audit representation fees for a small amount.

Accountants who have demonstrated competency through their professional associations' certification exams are certified to use titles such as Chartered Accountant, Chartered Certified Accountant or Certified Public Accountant. Certified Public Accountant Title of qualified accountants in many countries

Certified Public Accountant (CPA) is the title of qualified accountants in numerous countries in the English-speaking world. It is generally equivalent to the title of chartered accountant in other English-speaking countries. In the United States, the CPA is a license to provide accounting services to the public. It is awarded by each of the 50 states for practice in that state. Additionally, almost every state has passed mobility laws to allow CPAs from other states to practice in their state. State licensing requirements vary, but the minimum standard requirements include passing the Uniform Certified Public Accountant Examination, 150 semester units of college education, and one year of accounting related experience.

Refund anticipation loan

Refund anticipation loan (RAL) is a short-term consumer loan in the United States provided by a third party against an expected tax refund for the duration it takes the tax authority to pay the refund. The loan term was usually about two to three weeks, related to the time it took the U.S. Internal Revenue Service to deposit refunds in electronic accounts. The loans were designed to make the refund available in as little as 24 hours. They were secured by a taxpayer's expected tax refund, and designed to offer customers quicker access to funds.

Joseph Ronald Banister is a former special agent of the Criminal Investigation Division of the Internal Revenue Service (IRS) and anti-tax activist. Banister resigned from the IRS and later appeared on the television program "60 Minutes II" challenging the conduct of the IRS concerning legal issues with taxation. Banister's books, such as Investigating The Federal Income Tax: A Report To The American People, and other material, challenge the legality of some aspects of the income tax.

Enrolled Agent is a tax advisor who is a federally authorized tax practitioner empowered by the U.S. Department of the Treasury. Enrolled Agents represent taxpayers before the Internal Revenue Service (IRS) for tax issues including audits, collections and appeals.

A Registered Tax Return Preparer was formerly a category of federal tax return preparers created by the U.S. Internal Revenue Service (IRS).

The Registered Tax Return Preparer Test was a test produced by the U.S. Internal Revenue Service (IRS). Until the program was suspended in January 2013, the IRS had implemented rules requiring that certain individuals who wanted to work as tax return preparers pass this test to demonstrate their ability to understand U.S. tax law, tax form preparation and ethical requirements. The competency test was part of an agency effort to better regulate the tax return preparation industry, to improve the accuracy of tax return preparation and to improve service to taxpayers.
