Thryv, Inc. v. Click-to-Call Technologies, LP, 140 S. Ct. 1367, was a 2020 decision by the United States Supreme Court regarding whether inter partes review institution decisions by the United States Patent and Trademark Office were subject to judicial review. Writing for the majority, Justice Ruth Bader Ginsburg issued an opinion finding that such decisions were not judicially reviewable. Justices Neil Gorsuch and Sonia Sotomayor dissented from the majority's ruling, arguing that neither Congress or the Constitution authorized a lack of judicial review of such decisions.

Background

In 1998, the Patent Office awarded U.S. Patent No. 5,818,836 to Stephen DuVal for an invention pertaining to anonymizing telephone calls. Duval licensed the patent to InfoRocket.com, Inc. In 2001, InfoRocket sued a predecessor of Thryv, Inc., alleging that Thryv had infringed upon the '836 patent. Following protected litigation that involved challenges to the validity of the '836 patent, the parties settled their claims and jointly dismissed the lawsuit. [1] [2]

In 2011, Duval transferred the license of the '836 patent to Click-to-Call who then proceeded to file a new patent infringement lawsuit against Thryv. In response to this new lawsuit, Thryv filed a petition for inter partes review with the patent office seeking to invalidate the patent. Click-to-Call argued that Thryv's petition was untimely because, under 35 U.S.C. § 315(b), no inter partes review proceeding can be initiated more than 1 year after being served with a complaint alleging patent infringement. The Patent Office rejected this argument, finding that, because the 2001 lawsuit had been voluntarily dismissed, Section 315(b) did not serve as a bar to inter partes review. [3]

Click-to-Call subsequently appealed the Patent Office's determination to the United States Court of Appeals for the Federal Circuit. The Federal Circuit, sitting en banc, ruled in Click-to-Call's favor, holding that, while 35 U.S.C. § 314(d) generally barred judicial review of the Patent Office's decision to institute inter partes review, there was no evidence that Congress specifically intended for determinations regarding the 1-year bar to be unreviewable. The decision was issued by a sharply divided court, with several Federal Circuit judges dissenting. On June 24, 2019, the Supreme Court granted certiorari and held oral argument on December 9, 2019. The Supreme Court issued its ruling on April 20, 2020. Writing for a seven justice majority, Justice Ginsburg held that Section 314(d) bars courts from reviewing determinations regarding the 1-year time bar to filing inter partes review petitions. Justice Ginsburg's opinion rested heavily on the Court's 2016 decision in Cuozzo Speed Technologies, LLC v. Lee , which had upheld the constitutionality of inter partes review generally and the validity of Section 314(d) specifically. [6]

Justices Gorsuch and Sotomayor dissented from the majority's ruling. In their view, it was improper to limit the ability of the judiciary to review administrative agency determinations. Justice Gorsuch in particular re-emphasized his stance from Oil States Energy Services, LLC v. Greene's Energy Group, LLC that it was improper for an administrative agency to revoke an intellectual property right without meaningful judicial review. [6]

Reaction

Reaction among the legal community was mixed. [7] Writing for SCOTUSBlog, John Duffy described the opinion as having relatively little impact on the state of American patent law, but potentially representing a "a tiny skirmish in a much larger war" surrounding the review-ability of administrative decisions by American courts. [6] Over at IPWatchDog, Gene Quinn criticized the Court's ruling as giving the Patent Office free license to invalidate patents without concern of meaningful judicial review. [8]

The Supreme Court of the United States (SCOTUS) is the highest court in the federal judiciary of the United States. It has ultimate appellate jurisdiction over all federal court cases, and over state court cases that involve a point of U.S. Constitutional or federal law. Global-Tech Appliances, Inc. v. SEB S.A., 563 U.S. 754 (2011), is a United States Supreme Court case. The case considered whether a party, in order to "actively [induce] infringement of a patent" under 35 U.S.C. § 271(b), must know that the induced act constitutes patent infringement, or whether deliberate indifference to the existence of a patent can be considered a form of actual knowledge. In an 8–1 decision delivered by Justice Samuel Alito, the Court held that induced infringement requires knowledge of patent infringement, but because the petitioners had knowledge of a patent infringement lawsuit involving the respondent and Sunbeam Products over the same invention, the Federal Circuit's judgement that petitioners induced infringement must be affirmed under the doctrine of willful blindness.

Bowman v. Monsanto Co., 569 U.S. 278 (2013), was a United States Supreme Court patent decision in which the Court unanimously affirmed the decision of the Federal Circuit that the patent exhaustion doctrine does not permit a farmer to plant and grow saved, patented seeds without the patent owner's permission. The case arose after Vernon Hugh Bowman, an Indiana farmer, bought transgenic soybean crop seeds from a local grain elevator for his second crop of the season. Monsanto originally sold the seed from which these soybeans were grown to farmers under a limited use license that prohibited the farmer-buyer from using the seeds for more than a single season or from saving any seed produced from the crop for replanting. The farmers sold their soybean crops to the local grain elevator, from which Bowman then bought them. After Bowman replanted the crop seeds for his second harvest, Monsanto filed a lawsuit claiming that he infringed on their patents by replanting soybeans without a license. In response, Bowman argued that Monsanto's claims were barred under the doctrine of patent exhaustion, because all future generations of soybeans were embodied in the first generation that was originally sold.

The Patent Trial and Appeal Board (PTAB) is an administrative law body of the United States Patent and Trademark Office (USPTO) which decides issues of patentability. It was formed on September 16, 2012, as one part of the America Invents Act. Prior to its formation, the main judicial body in the USPTO was the Board of Patent Appeals and Interferences (BPAI).

An inter partes review (IPR) is a procedure for challenging the validity of a United States patent before the United States Patent and Trademark Office.

Versata Development Group, Inc. v. SAP America, Inc., 793 F.3d 1306, is a July 2015 decision of the Federal Circuit affirming the final order of the Patent Trial and Appeal Board (PTAB), the recently created adjudicatory arm of the United States Patent and Trademark Office (USPTO), invalidating as patent ineligible the claims in issue of Versata's U.S. Patent No. 6,553,350. This was the first case in the Federal Circuit reviewing a final order in a Covered Business Method (CBM) invalidation proceeding under the America Invents Act (AIA). The Supreme Court of the United States handed down nine per curiam opinions during its 2016 term, which began October 3, 2016 and concluded October 1, 2017.

Nelson v. Colorado, 581 U.S. ___ (2017), is a decision by the Supreme Court of the United States. In a 7-1 decision written by Justice Ruth Bader Ginsburg, the Court held that a state had no right to keep fines and other money based on an invalid conviction. Justice Samuel Alito wrote an opinion concurring in the judgment, Justice Clarence Thomas wrote a dissenting opinion, and Justice Neil Gorsuch did not take part in the consideration or decision of the case.

Trump v. Hawaii, No. 17-965, 585 U.S. ___ (2018), was a landmark United States Supreme Court case involving Presidential Proclamation 9645 signed by President Donald Trump, which restricted travel into the United States by people from several nations, or by refugees without valid travel documents. Hawaii and several other states and groups challenged the Proclamation and two predecessor executive orders also issued by Trump on statutory and constitutional grounds. Citing a variety of statements by Trump and administration officials, they argued that the proclamation and its predecessor orders were motivated by anti-Muslim animus.

Sessions v. Dimaya, 584 U.S. ___ (2018), was a United States Supreme Court case in which the Court held that 18 U.S.C. § 16(b), a statute defining certain "aggravated felonies" for immigration purposes, is unconstitutionally vague. The Immigration and Nationality Act (INA) classifies some categories of crimes as "aggravated felonies", and immigrants convicted of those crimes, including those legally present in the United States, are almost certain to be deported. Those categories include "crimes of violence", which are defined by the "elements clause" and the "residual clause". The Court struck down the "residual clause", which classified every felony that, "by its nature, involves a substantial risk" of "physical force against the person or property" as an aggravated felony.

Oil States Energy Services, LLC v. Greene's Energy Group, LLC, 584 U.S. ___ (2018), was a United States Supreme Court case in which the Court held that the inter partes review process granted by Congress to the United States Patent and Trademark Office for challenging the validity of patents, rather than a jury trial, is constitutional and did not violate either Article III of the Constitution nor the Seventh Amendment.

SAS Institute Inc. v. Iancu, 584 U.S. ___ (2018), was a United States Supreme Court case in which the Court held the United States Patent and Trademark Office, when conducting an inter partes review, must make judgement on all patent claims contested by the petitioner.

Peter v. NantKwest Inc., 589 U.S. ___ (2019), was a United States Supreme Court case from the October 2019 term.

Espinoza v. Montana Department of Revenue, 591 U.S. ___ (2020), was a landmark United States Supreme Court case in which the Court ruled that a state-based scholarship program that provides public funds to allow students to attend private schools cannot discriminate against religious schools under the Free Exercise Clause of the Constitution.

Nautilus, Inc. v. Biosig Instruments, Inc., 134 S.Ct. 2120 (2014), was a 2014 decision by the United States Supreme Court pertaining to the validity of U.S. patents. The opinion addressed the requirement contained in 35 U.S.C. § 112, ¶ 2 that a patent "particularly point[] out and distinctly claim[] the subject matter which the applicant regards as the invention." Writing for a unanimous court, Justice Ruth Bader Ginsburg held that a patent fails to comply with this requirement when the patent's claims, read in light of the specification and the prosecution history, "fail to inform, with reasonable certainty, those skilled in the art about the scope of the invention." Subsequent to the Court’s decision the case was remanded to the United States Court of Appeals for the Federal Circuit which, using the new standard, declined to invalidate Biosig's patent.

United States v. Arthrex, Inc., 594 U.S. ___ (2021), was a United States Supreme Court case related to the Appointments Clause of the United States Constitution as it related to patent judges on the Patent Trial and Appeal Board (PTAB). In a complex decision, the Court ruled that these judges were considered "primary officers" under the Appointments Clause, normally subject to appointment through the US President and the US Senate, but to remedy the matter, the Court ruled that the constitutional issue is resolved by allowing the PTAB decisions to be subject to review by the appropriately-appointed Director of the Patent Office.

Commil USA, LLC v. Cisco Systems, Inc., 135 S.Ct. 1920 (2015), was a 2015 decision by the United States Supreme Court pertaining to the standard for induced patent infringement. Writing for a 6-2 majority, Justice Anthony Kennedy held that (1) a claim of induced infringement requires a showing that the defendant knew that it is engaging in infringing conduct and (2) a defendant's belief that a patent is invalid is not a defense to a claim of induced infringement. Justice Antonin Scalia dissented from the second point, arguing that, in his view, a good faith belief in a patent's invalidity should constitute a defense to a charge of induced infringement.

Moore v. Harper is an ongoing United States Supreme Court case related to the independent state legislature theory (ISL), arising from the redistricting of North Carolina's districts by the North Carolina legislature following the 2020 census, which the state courts found to be too artificial and partisan, and an extreme case of gerrymandering in favor of the Republican Party.
