S.B. 152 and H.B. 311, collectively known as the Utah Social Media Regulation Act, are social media bills that were passed by the Utah State Legislature in March 2023. The bills would collectively impose restrictions on how social networking services serve minors in the state of Utah, including mandatory age verification, and restrictions on data collection, algorithmic recommendations, and on when social networks may be accessible to minors.

The Act was intended to take effect in March 2024. However, following a lawsuit over the Act by NetChoice, the Utah attorney general stated in January 2024 that its implementation had been delayed to October 2024, but was likely to be repealed and amended. On September 10, 2024 Chief Judge Robert J. Shelby issued a written order granting a request from NetChoice, a tech industry group, for a preliminary injunction, meaning that Utah will be unable to enforce its social media law as litigation plays out. [1] The law was appealed to the 10th Circuit on October 11, 2024 and is wanting a decision. [2]

Provisions

The Act comprises two bills, S.B. 152 and H.B. 311, which respectively regulate access to social network accounts registered to minors, and impose obligations on social networking services to follow design practices that protect the privacy of minors. [3] [4] The bills would apply to social networks with more than 5 million active users in the United States. [5]

Social networking services must verify the age of all users in the state of Utah, or else their account must be deleted. The Act does not specify a specific method of age verification. Users who are under 18 must have consent from a parent or guardian to open an account, and the parent must be able to have access to the account and its data for monitoring. [6]

Unless required to comply with state or federal law, social networks are prohibited from collecting data based on the activity of minors, and may not display targeted advertising or algorithmic recommendations of content, users, or groups to minors. A social network must not allow minors to access the service between the hours of 10:30 p.m., and 6:30 a.m. without parental consent. [3] [4] H.B. 311 prohibits social networks from exposing features to minors that cause them to have an "addiction" to the platform; the service must perform quarterly audits, and may be sued by users for harms caused by providing "addictive" features; there is a rebuttable presumption of harm if the plaintiff is 16 or younger. The bills prescribe fines of $2,500 per-violation for violations of the provisions of S.B. 152, and up to $250,000 in liabilities (plus fines of $2,500 per-user) for violations of the addiction rules. [7]

History

The two bills were passed in early-March 2023, [8] and signed by Governor Spencer Cox on March 23, 2023. [3] [4] Cox cited studies linking social media addiction to increases in depression and suicide among youth. [5] They were originally intended to take effect on March 1, 2024. [3] [4] In the wake of a lawsuit in Arkansas by the trade association NetChoice over a similar bill, state senator and bill author Mike McKell stated that he planned to introduce amendments when the legislature resumed in 2024. [9]

In December 2023, NetChoice filed a lawsuit in Utah seeking to block the Act, citing that its definition of a social network was too vague, and that it "restricts who can express themselves, what can be said, and when and how speech on covered websites can occur, down to the very hours of the day minors can use covered websites. The First Amendment, reinforced by decades of precedent, allows none of this." [5] In regards to its age verification requirements, NetChoice argued that "it may not be enough to simply verify the age of whatever person may be listed on a form of identification (even if they have such a record) because that record may not accurately reflect who the individual actually is." The office of the attorney general stated that the state was "reviewing the lawsuit but remains intently focused on the goal of this legislation: Protecting young people from negative and harmful effects of social media use." In January 2024, Attorney General Sean Reyes asked the court to delay a hearing over the bill, stating that its effective date had been delayed to October 2024, and that the legislature planned to repeal and replace the bills. [10] [11]

<span class="mw-page-title-main">E-Verify</span> Website to determine US work eligibility

E-Verify is a United States Department of Homeland Security (DHS) website that allows businesses to determine the eligibility of their employees, both U.S. and foreign citizens, to work in the United States. The site was originally established in 1996 as the Basic Pilot Program to prevent companies from hiring people who had violated immigration laws and entered the United States illegally. In August 2007, the DHS started requiring all federal contractors and vendors to use E-Verify. The Internet-based program is free and maintained by the United States government. While federal law does not mandate use of E-Verify for non-federal employees, some states have mandated use of E-Verify or similar programs, while others have discouraged the program.

Florence v. Shurtleff, Civil No. 2:05CV000485, was a case in which the U.S. District Court for the District of Utah issued an order stating that individuals could not be prosecuted for posting adult content that was constitutionally protected on general access websites, nor could they be civilly liable for failing to prevent access to adult content, so long as the material is identifiable by filtering software. The order was the result of a 2005 lawsuit, The King's English v. Moody v. NetChoice, LLC and NetChoice, LLC v. Paxton, 603 U.S. 707 (2024), were United States Supreme Court cases related to protected speech under the First Amendment and content moderation by interactive service providers on the Internet under Section 230 of the Communications Decency Act. Moody and Paxton were challenges to two state statutes – enacted in Florida and Texas, respectively – that sought to limit this moderation. In July 2024, the justices vacated the lower-court decisions in both cases due to both courts failing to perform a full First Amendment assessment of the laws, and remanded them for further consideration.

The Social Media Parental Notification Act is a bill implemented by Ohio's governor that requires online companies to obtain parental consent in order for a minor under the age of 16 to use the platform.

Censorship of educational research databases in the United States has been a concerted political effort since 2016. Activist groups that aim to change school curricula and ban books from libraries and schools are applying political and legislative pressure to limit the content in educational research databases to which libraries subscribe to give students online access to educational resources beyond what print collections can offer. In 2017, the American Library Association (ALA) found that 18% of challenges to library content were not book challenges, but about databases, games, and other non-book content. In 2023, ALA received reports of 1,247 localized censorship attempts on library resources, including databases. Recently, however, many of the educational research database censorship efforts take place in state legislatures; Idaho, Utah, Tennessee, and Oklahoma have encoded laws that specifically relate to educational research databases. Several states have failed legislative efforts, while other states have pending legislation in the 2024 season. Experts argue that these laws act on problems that do not actually exist. Where legislating about educational research databases specifically has been unsuccessful, activists have moved to attempting to curtail the long-held legal definition of "obscenity," as defined by the United States Supreme Court in Miller v. California, known as the Miller Test. For example, recent Tennessee legislation removes protections for materials with educational value from being defined as "obscene."

Protecting Kids on Social Media Act or HB 1891 is an American law that was created by William Lamberth of Sumner County, Tennessee and was later enacted by Tennesse's Governor on May 2, 2024. The bill requires social media websites such as X, YouTube, TikTok, Facebook and others to verify the age of users and if those users are under 18, they must have Parental Consent.

HB 18 also known as Securing Children Online Through Parental Empowerment Act or just The SCOPE Act is an American law in Texas. The law requires internet platforms to verify the age of a parent or guardian of accounts if they are signed in as under 18. It also requires parental consent before collecting the data on minors under 18 years of age. Which is an increase from the age set at the federal level under COPPA which is 13. It also requires platforms to block and filter if the content promotes suicide, self-harm, eating disorders, substance abuse, stalking, bullying, or harassment, or grooming.

In 2022 California passed The California Age-Appropriate Design Code Act or AB 2273 which requires websites that are likely to be used by minors to estimate visitors ages to give them some amount of privacy control and on March 23, 2023, Utah Governor Spencer Cox signed SB 152 and HB 311 collective known as the Utah Social Media Regulation Act which requires age verification and if they are under 18 they have to get parental consent before making an account on any social media platform. Since then multiple bills have been introduced or passed in multiple states however very few gone into effect mainly due to court challenges including both laws in California and Utah.
