Virginia's 40th House of Delegates district elects one of 100 seats in the Virginia House of Delegates, the lower house of the state's bicameral legislature. While District 40 was previously in Fairfax County and Prince William County, Virginia, as of 2023 it is part of the Roanoke metropolitan area. District 40 has been represented by Democrat Dan Helmer since 2020. [1]

In 2017, Republican incumbent Hugo was challenged by first-time candidate, Democrat Donte Tanner. The race became one of four recounts in the 2017 Virginia House of Delegates election, with control of the House decided by one seat; in the 40th district recount, Hugo won reelection by 99 votes, of roughly 30,000 cast. In 2019, Hugo was challenged and defeated by Democrat Dan Helmer. [3] Helmer, an army veteran who attended the United States Military Academy (West Point), campaigned on gun control, teacher pay increases and continuing Virginia's Medicaid expansion. [3]
Timothy Douglas Hugo is an American businessman, military veteran, and Republican politician in the Commonwealth of Virginia. He served as a member of the Virginia House of Delegates from 2003 to 2020, representing the 40th district. Hugo was defeated for re-election in 2019 by Democrat Dan Helmer.

The majority of the pre-redistricted 40th district's population and landmass was located in Fairfax County with a small part in Prince William County. Helmer currently represents the 10th district post-redistricting, which is located entirely in Fairfax County.

A member of the Republican Party, she defeated incumbent Democratic delegate Lashrecse Aird in the 2021 election. Taylor represents parts of Chesterfield, Dinwiddie, and Prince George counties, taking in the city of Petersburg and parts of Hopewell.

All 100 delegates were elected to two-year terms from single-member districts. Nomination primaries held through the Department of Elections were held June 20, 2023. Democrats gained 3 seats, winning back control with a 51–49 majority after having previously lost it in 2021.
