Waesche, Sheinbaum & O'Regan was a New York-based law firm focusing on international litigation and arbitration. It was co-founded in 1979 by Donald M. Waesche, Jr., Louis P. Sheinbaum and Francis M. O'Regan, partners from the Wall Street firm of Bigham, Englar, Jones & Houston.

The firm litigated cases involving the carriage of goods by sea and air, insurance, reinsurance, international personal jurisdiction, the doctrine of forum non conveniens, the Federal Arbitration Act, the Foreign Sovereign Immunities Act, and the application of international treaties. Colorado was one of several states with a process for citizens to propose initiatives for the ballot, which if passed became law. Barclays Capital Inc. v. Theflyonthewall.com, Inc., 650 F.3d 876, was a case decided in the United States Court of Appeals for the Second Circuit where the Second Circuit, reversing the decision of the US District Court below it, found that the claims of three major financial investment firms against an internet subscription stock news service (theflyonthewall.com) for "Hot-news" Misappropriation under state common law doctrine could not stand, as they were pre-empted by several sections of the Federal Copyright Act.

The misappropriation doctrine is a U.S. legal theory conferring a "quasi-property right" on a person who invests "labor, skill, and money" to create an intangible asset. Sheldon v. Metro-Goldwyn Pictures Corp., 309 U.S. 390 (1940), was a United States Supreme Court case in which the Court held, in the case of an unauthorized adaptation, courts may elect to award only a portion of an infringer's profits to the plaintiff. The proportion that the defendant is entitled to keep is in proportion to the amount of original creative work that went into the adaptation, and the court may be assisted in determining that by expert witness testimony.
