Writ of Kalikasan

A Writ of Kalikasan is a legal remedy under Philippine law that provides protection of one's constitutional right to a healthy environment, as outlined in Section 16, Article II of the Philippine Constitution, which states that the "state shall protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature." [1] Kalikasan is a Filipino word for "nature". [1]

The writ is comparable to the writ of amparo and the writ of habeas corpus. [1] In contrast, this writ protects one's right for a healthy environment rather than constitutional rights. [2] The Writ of Kalikasan originated in the Philippines, whereas the two aforementioned writs have roots in European and Latin American law. [1]

History

Provision for the Writ of Kalikasan was written in 2010 by the Supreme Court of the Philippines under Rule 7 of the Rules of Procedure for Environmental Cases as a Special Civil Action. [3] The Supreme Court under Chief Justice Reynato Puno took the initiative and issued Rules of Procedure for Environmental Case because Section 16, Article II of the Philippines' 1986 Constitution was not a self-executing provision. [4]

Cases

The Writ of Kalikasan may be sought to deal with environmental damage of such magnitude that it threatens life, health, or property of inhabitants in two or more cities or provinces. [5]

In 2013, the Court of Appeals upheld a court ruling banning field trials of Bt eggplant in the Philippines. The ruling stated that the field trials violated people's right to a balanced ecology. [6]

In September 2014, the Supreme Court of the Philippines ruled unanimously against issuing a Writ of Kalikasan against the United States Government over the grounding of the USS Guardian on the Tubbataha Reef in 2013. [1]

In April 2023, the Supreme Court issued a Writ of Kalikasan ordering the Department of Agriculture and the Department of Environment and Natural Resources to stop the sale of genetically modified golden rice and Bt eggplant in the Philippines. [7]

In August 2023, the Supreme Court issued a Writ of Kalikasan against Celestial Nickel Mining and Exploration Corporation, Ipilan Nickel Corporation, and the Department of Environment and Natural Resources. The court ruled that mining operations on the Mount Mantalingahan mountain range may cause irreparable environmental damage to the Mount Mantalingahan protected area and the Indigenous Cultural Communities' ancestral domain. The Supreme Court (Filipino: Kataas-taasang Hukuman; colloquially referred to as the Korte Suprema is the highest court in the Philippines. Today, environmental problems in the Philippines include pollution, mining and logging, deforestation, threats to environmental activists, dynamite fishing, landslides, coastal erosion, biodiversity loss, extinction, global warming and climate change. Due to the paucity of extant documents, a complete history of land use in the archipelago remains unwritten. However, relevant data shows destructive land use increased significantly in the eighteenth century when Spanish colonialism enhanced its extraction of the archipelago's resources for the early modern global market. The Philippines is projected to be one of the most vulnerable countries to the impacts of climate change, which would exacerbate weather extremes. As the Philippines lies on the Pacific Ring of Fire, it is prone to natural disasters, like earthquakes, typhoons, and volcanic eruptions. In 2021, the Philippines ranked the fourth most affected country from "weather-related loss events", partly due to the close proximity of major infrastructure and residential areas to the coast and unreliable government support. One of the most devastating typhoons to hit the archipelago was Typhoon Haiyan, known locally as Yolanda, in 2013 that killed 6,300 people and left 28,689 injured. Congress passed the Clean Air Act of 1999, the Philippine Clean Water Act of 2004, the Climate Change Act of 2009 to address environmental issues. The country is also a signatory to the Paris Agreement. However, research has found that outside of cities, the general public doesn't feel equally informed. Environmental activists and land defenders, consisting mostly of Indigenous communities who have been attempting to bring attention to the environmental issues in the country have been met with violence or murder. As a result, the Philippines has been ranked one of the most dangerous places in the world for environmental activists.

He served as the 22nd chief justice of the Supreme Court of the Philippines from December 8, 2006, by President Gloria Macapagal Arroyo until his mandatory retirement on May 17, 2010. Puno had initially been appointed to the Supreme Court as an associate justice on June 28, 1993.

In most legal systems of the Spanish-speaking world, the writ of amparo is a remedy for the protection of constitutional rights, found in certain jurisdictions. The amparo remedy or action is an effective and inexpensive instrument for the protection of individual rights.

On 5 December 2013, he received the 2013 Hero for the Environment national individual award from the Center for Environmental Concerns in collaboration with the Department of Environment and Natural Resources of the Republic of the Philippines. The judiciary of the Philippines consists of the Supreme Court, which is established in the Constitution, and three levels of lower courts, which are established through law by the Congress of the Philippines. The Supreme Court has expansive powers, able to overrule political and administrative decisions, and with the ability to craft rules and law without precedent. It further determines the rules of procedure for lower courts, and its members sit on electoral tribunals.

India currently only grows GM cotton, while China produces GM varieties of cotton, poplar, petunia, tomato, papaya and sweet pepper. Cost of enforcement of regulations in India are generally higher, possibly due to the greater influence farmers and small seed firms have on policy makers, while the enforcement of regulations was more effective in China. Other Asian countries that grew GM crops in 2011 were Pakistan, the Philippines and Myanmar. GM crops were approved for commercialisation in Bangladesh in 2013 and in Vietnam and Indonesia in 2014.
