The Court of Appeals (Filipino : Hukuman ng Apelasyon [2] ) is an appellate collegiate court in the Philippines. The Court of Appeals consists of one presiding justice and sixty-eight associate justices. Pursuant to the Constitution, the Court of Appeals "reviews not only the decisions and orders of the Regional Trial Courts awards, judgments, final orders or resolutions of, or authorized by administrative agencies exercising quasi-judicial functions mentioned in Rule 43 of the 1997 Rules of Civil Procedure, plus the National Amnesty Commission (Pres. Proclamation No. 347 of 1994) and the Office of the Ombudsman". [3] Under Republic Act No. 9282, which elevated the Court of Tax Appeals to the same level of the Court of Appeals, en banc decisions of the Court of Tax Appeals are subject to review by the Supreme Court instead of the Court of Appeals (as opposed to what is currently provided in Section 1, Rule 43 of the Rules of Court). Added to the formidable list are the decisions and resolutions of the National Labor Relations Commission which are now initially reviewable by the Court of Appeals, instead of a direct recourse to the Supreme Court, via petition for certiorari under Rule 65. History

Organized on February 1, 1936, the Court of Appeals was initially composed of Justice Pedro Concepcion, as the first presiding judge, and ten appellate judges appointed by the president of the Philippines with the consent of the Commission on Appointments of the National Assembly. It had exclusive appellate jurisdiction of all cases not falling under the original and exclusive appellate jurisdiction of the seven-man Supreme Court. Its decisions in those cases were final, except when the Supreme Court upon petition for certiorari on questions of law required that the case be certified to it for review. It had also original jurisdiction to issue writs of mandamus, prohibition, injunction, certiorari, habeas corpus and all other auxiliary writs in aid of its appellate jurisdiction. The court then sat either en banc or in two divisions, one of six and another of five judges. The appellate judges had the same qualifications as those provided by the Constitution for Supreme Court justices.

In March 1938, the appellate judges were named justices and their number increased from eleven to fifteen, with three divisions of five under Commonwealth Act No. 259. On December 24, 1941, the membership of the court was further increased to nineteen justices under Executive Order No. 395.

The court functioned during the Japanese occupation from 1941 to 1944. However, in March 1945, due to abnormal conditions at the time,[ clarification needed ] the court was abolished by President Sergio Osmeña through Executive Order No. 37. The end of World War II restored the democratic processes in the country. On October 4, 1946, Republic Act No. 52 was passed, recreating the Court of Appeals, with a presiding justice and fourteen associate justices. The court was composed of five divisions of three justices each.

On August 23, 1956, the membership of the court was expanded to eighteen justices per Republic Act No. 1605. The number was hiked to twenty-four justices as decreed by Republic Act No. 5204 approved on June 15, 1968. Ten years later, the unabated swelling of the court's dockets called for a much bigger court of forty-five justices under Presidential Decree No. 1482 of June 10, 1978. Then came the judiciary reorganization on January 17, 1983, through Executive Order No. 864 of President Ferdinand Marcos. The court was renamed the Intermediate Appellate Court, and its membership was enlarged to fifty-one justices. However, only thirty-seven justices were appointed to this court.

On July 28, 1986, President Corazon Aquino issued Executive Order No. 33, which restored the original name of the appellate court to the Court of Appeals and its presiding justice and fifty associate justices.

On February 23, 1995, Republic Act No. 7902 was passed, which expanded the jurisdiction of the court effective March 18, 1995. On December 30, 1996, Republic Act No. 8246 created six more divisions in the court, thereby increasing its membership from fifty-one to sixty-nine justices. These additional divisions—three for the Visayas and three for Mindanao—paved the way for the appellate court's regionalization. The court in the Visayas sits in Cebu City, while Cagayan de Oro is home to the court for Mindanao.

On August 18, 2007, the then-president of the Cebu City Chapter of the Integrated Bar of the Philippines, Briccio Joseph Boholst, opposed the abolition of the court in Cebu City, as he claimed that it would cause inconvenience for both litigants and lawyers. Supreme Court Associate Justice Ruben Reyes was tasked to investigate and submit his recommendations to the High Tribunal regarding the alleged massive graft and corruption of justices, especially in the issuance of temporary restraining orders. The Court of Appeals consists of a presiding justice and sixty-eight associate justices. Among the current members of the court, Fernanda Lampas-Peralta is the longest-serving associate justice, with a tenure of 7,382 days (20 years, 77 days) as of April 26, 2024; the most recent justice to enter the court are Selma Palacio Alaras and Wilhelmina Jorge-Wagan whose respective tenure began on October 11, 2022.

The United States courts of appeals are the intermediate appellate courts of the United States federal judiciary. They hear appeals of cases from the United States district courts and some U.S. administrative agencies, and their decisions can be appealed to the Supreme Court of the United States. The courts of appeals are divided into 13 "Circuits". Eleven of the circuits are numbered "First" through "Eleventh" and cover geographic areas of the United States and hear appeals from the U.S. district courts within their borders. The District of Columbia Circuit covers only Washington, DC. The Federal Circuit hears appeals from federal courts across the United States in cases involving certain specialized areas of law.

In law, certiorari is a court process to seek judicial review of a decision of a lower court or government agency. Certiorari comes from the name of an English prerogative writ, issued by a superior court to direct that the record of the lower court be sent to the superior court for review. The term is Latin for "to be made more certain", and comes from the opening line of such writs, which traditionally began with the Latin words "Certiorari volumus...".

The state is geographically divided into four judicial departments of the Appellate Division. Established under Chapter 5 of the Constitution of South Korea, the Court has ultimate and comprehensive jurisdiction over all cases except those cases falling under the jurisdiction of the Constitutional Court of Korea. It consists of fourteen Justices, including the Chief Justice of the Supreme Court of Korea. The Supreme Court is at the top of the hierarchy of all ordinary courts in South Korea, and traditionally represented the conventional judiciary of South Korea. The Supreme Court has equivalent status as one of the two highest courts in South Korea. The other is the Constitutional Court of Korea.

In most legal jurisdictions, a supreme court, also known as a court of last resort, apex court, and highcourt of appeal, is the highest court within the hierarchy of courts. Broadly speaking, the decisions of a supreme court are binding on all other courts in a nation and are not subject to further review by any other court. Supreme courts typically function primarily as appellate courts, hearing appeals from decisions of lower trial courts, or from intermediate-level appellate courts. A Supreme Court can also, in certain circumstances, act as a court of original jurisdiction, however, this is typically limited to constitutional law.

The Oklahoma Court on the Judiciary is one of the two independent courts in the Oklahoma judiciary and has exclusive jurisdiction in adjudicating discipline and hearing cases involving the removal of a judge from office, excluding the Oklahoma Supreme Court, exercising judicial power under the Oklahoma Constitution.

The Montana Supreme Court is the highest court of the state court system in the U.S. state of Montana. It is established and its powers defined by Article VII of the 1972 Montana Constitution. It is primarily an appellate court which reviews civil and criminal decisions of Montana's trial courts of general jurisdiction and certain specialized legislative courts, only having original jurisdiction in a limited number of actions. The court's Chief Justice and six Associate Justices are elected by non-partisan, popular elections. The Montana Supreme Court meets in the Joseph P. Mazurek Building in Helena, Montana, the state's capital, an international style building completed in 1982 and named in the honor of former Montana Attorney General, Joseph P. Mazurek.

<span class="mw-page-title-main">Sandiganbayan</span> Special appellate collegial court in the Philippines

The Sandiganbayan is a special appellate collegial court in the Philippines that has jurisdiction over criminal and civil cases involving graft and corrupt practices and other offenses committed by public officers and employees, including those in government-owned and controlled corporations. The special court was established by Presidential Decree No. 1486. It was subsequently modified by Presidential Decree No. 1606 and by Republic Acts 7975, 8249 and 10660. It is equal in rank to the Court of Appeals, and consists of fourteen Associate Justices and one Presiding Justice. The Office of the Ombudsman owns exclusive authority to bring cases to the Sandiganbayan.

The Court of Tax Appeals is the special court of limited jurisdiction, and has the same level with the Court of Appeals. The court consists of 8 Associate Justices and 1 Presiding Justice. The Court of Tax Appeals is located on Senator Miriam P. Defensor-Santiago Avenue, Diliman, Quezon City in Metro Manila.

Ruben T. Reyes was a Filipino jurist who served as an Associate Justice of the Supreme Court of the Philippines from 2007 to 2009.

The Government of Guam (GovGuam) is a presidential representative democratic system, whereby the president is the head of state and the governor is head of government, and of a multi-party system. Guam is an organized, unincorporated territory of the United States with policy relations between Guam and the US under the jurisdiction of the Office of Insular Affairs.

<span class="mw-page-title-main">GSIS–Meralco bribery case</span>

The GSIS–Meralco bribery case was a landmark case heard by the Supreme Court of the Philippines. This complex case began with a complaint filed by the Philippines' Government Service Insurance System (GSIS) with the Securities and Exchange Commission of the Philippines (SEC) questioning the unvalidated proxy votes used by the Lopez family in a board election of the Manila Electric Company (Meralco). The SEC issued a cease and desist order (CDO) against Meralco, which was ignored by the latter. A show cause order (SCO) was then issued by the SEC, whereupon Meralco petitioned the Court of Appeals, questioning the jurisdiction of the SEC. The Court of Appeals issued a temporary restraining order (TRO) to the SEC while the Special 9th Division composed of Associate Justices Vicente Q. Roxas, Jose L. Sabio Jr. and Myrna Dimaranan Vidal heard the case. Roxas was assigned as the ponente while Sabio was the acting chairman.

<span class="mw-page-title-main">Supreme Court of Mississippi</span> Highest court in the U.S. state of Mississippi

The Supreme Court of Mississippi is the highest court in the state of Mississippi. It was established in 1818 per the terms of the first constitution of the state and was known as the High Court of Errors and Appeals from 1832 to 1869. The court is an appellate court. The court consists of nine justices elected in nonpartisan contests from three districts to serve eight-year terms. The most senior justice serves as the chief justice. It is housed in the Carroll Gartin Justice Building in Jackson, Mississippi, the state capital.

<span class="mw-page-title-main">Supreme Court of Albania</span> Highest court in Albanias judicial system

The Supreme Court of the Republic of Albania is the highest court of Albania and is the final court of appeals in the country's judicial system. It is composed of seventeen judges: the Chief Justice and sixteen Members.

In law, an appeal is the process in which cases are reviewed by a higher authority, where parties request a formal change to an official decision. Appeals function both as a process for error correction as well as a process of clarifying and interpreting law. Although appellate courts have existed for thousands of years, common law countries did not incorporate an affirmative right to appeal into their jurisprudence until the 19th century.

The judiciary of the Philippines consists of the Supreme Court, which is established in the Constitution, and three levels of lower courts, which are established through law by the Congress of the Philippines. The Supreme Court has expansive powers, able to overrule political and administrative decisions, and with the ability to craft rules and law without precedent. It further determines the rules of procedure for lower courts, and its members sit on electoral tribunals.
