House Bill 2001

House Bill 2001 is an Oregon bill that allows for alternative, more economical types of housing in an effort to preserve outer-city rural areas, such as farms. The bill is especially aimed at reducing the pace of urban sprawl in densely populated cities such as Portland, Oregon, with non-traditional land use zoning.

On July 2, 2019, the state of Oregon passed House Bill 2001 which provides an alternative to single-family zoning. [1] [2] [3] The bill is an example of inclusionary zoning and allow for more affordable housing to be built. The bill allows duplexes, triplexes, fourplexes, and cottage clusters (which are several smaller homes built around a community backyard or other green space) to be built on land zoned for single family homes in cities with over 25,000 residents. [4] In cities with over 10,000 residents duplexes will be allowed on land zoned for single family homes. [5] Approximately 2.8 million people of Oregon’s 4.1 million population live in areas that will be affected by this bill. [6] The bill was signed into law by Governor Kate Brown on August 8, 2019 and will take effect in 2020. [7]

Background

Oregon has often been seen as a leader in non-traditional land use as they have had a statewide urban growth boundary since 1973. While Urban Growth Boundaries and in particular Portland’s have become more controversial lately, the idea is to prevent urban sprawl from growing into farmland directly outside of the city. Affordable housing has become an increasing problem in Portland and other US cities. HB 2001 is one way that Oregon is attempting to combat that. [8]

This bill is similar to Minneapolis’s new housing policy that bans zoning for single family homes. [9] A similar plan has been adopted into certain neighborhoods in Seattle. While Oregon’s plan is less extreme, it does not ban single family homes but simply makes it easier for alternatives to be built, it is the first bill of its type to be implemented at a state rather than local level. The bill passed through the house fairly quickly and easily. The bill’s main sponsor, Representative Tina Kotek, makes clear that this bill is about choice and providing more affordable alternatives rather than banning single family homes. [5]

Criticism

The bill has received criticism from both sides of the aisle. From the right opponents of the bill argue that the state should expand or get rid of the Urban Growth Boundary to combat the rising cost of housing rather than implement HB 2001. [5] From the other side, people believe that it is not enough and that there will not be the short term effects that the city needs. [10]

It also advocates compact, transit-oriented, walkable, bicycle-friendly land use, including neighborhood schools, complete streets, and mixed-use development with a range of housing choices. The term "smart growth" is particularly used in North America. In Europe and particularly the UK, the terms "compact city", "urban densification" or "urban intensification" have often been used to describe similar concepts, which have influenced government planning policies in the UK, the Netherlands and several other European countries.

An urban growth boundary, or UGB, is a regional boundary, set in an attempt to control urban sprawl by, in its simplest form, mandating that the area inside the boundary be used for urban development and the area outside be preserved in its natural state or used for agriculture. Legislating for an "urban growth boundary" is one way, among many others, of managing the major challenges posed by unplanned urban growth and the encroachment of cities upon agricultural and rural land.

Zoning is a method of urban planning in which a municipality or other tier of government divides land into areas called zones, each of which has a set of regulations for new development that differs from other zones. Zones may be defined for a single use, they may combine several compatible activities by use, or in the case of form-based zoning, the differing regulations may govern the density, size and shape of allowed buildings whatever their use. The planning rules for each zone determine whether planning permission for a given development may be granted. Zoning may specify a variety of outright and conditional uses of land. It may indicate the size and dimensions of lots that land may be subdivided into, or the form and scale of buildings. These guidelines are set in order to guide urban growth and development.

Urban sprawl is defined as "the spreading of urban developments on undeveloped land near a city." Urban sprawl has been described as the unrestricted growth in many urban areas of housing, commercial development, and roads over large expanses of land, with little concern for urban planning. In addition to describing a special form of urbanization, the term also relates to the social and environmental consequences associated with this development. Medieval suburbs suffered from the loss of protection of city walls, before the advent of industrial warfare. Modern disadvantages and costs include increased travel time, transport costs, pollution, and destruction of the countryside. The cost of building urban infrastructure for new developments is hardly ever recouped through property taxes, amounting to a subsidy for the developers and new residents at the expense of existing property taxpayers.

Metro is the regional government for the Oregon portion of the Portland metropolitan area, covering portions of Clackamas, Multnomah, and Washington Counties. It is the only directly elected regional government and metropolitan planning organization in the United States. Metro is responsible for overseeing the Portland region's solid waste system, general planning of land use and transportation, maintaining certain regional parks and natural areas, and operating the Oregon Zoo, Oregon Convention Center, Portland's Centers for the Arts, and the Portland Expo Center. <span class="mw-page-title-main">Duplex (building)</span> Type of residential building

A duplex house plan has two living units attached to each other, either next to each other as townhouses, condominiums or above each other like apartments. By contrast, a building comprising two attached units on two distinct properties is typically considered semi-detached or twin homes but is also called a duplex in parts of the Northeastern United States, Western Canada, and Saudi Arabia.

The YIMBY movement is a pro-housing movement in contrast and opposition to the NIMBY phenomenon. The YIMBY position supports increasing the supply of housing within cities where housing costs have escalated to unaffordable levels. YIMBYs often seek rezoning that would allow denser housing to be produced or the repurposing of obsolete buildings, such as shopping malls, into housing. Some YIMBYs have also supported public-interest projects like clean energy or alternative transport.

Affordable housing is housing which is deemed affordable to those with a household income at or below the median as rated by the national government or a local government by a recognized housing affordability index. Most of the literature on affordable housing refers to mortgages and a number of forms that exist along a continuum – from emergency homeless shelters, to transitional housing, to non-market rental, to formal and informal rental, indigenous housing, and ending with affordable home ownership.

Mixed use is a type of urban development, urban design, urban planning and/or a zoning classification that blends multiple uses, such as residential, commercial, cultural, institutional, or entertainment, into one space, where those functions are to some degree physically and functionally integrated, and that provides pedestrian connections. Mixed-use development may be applied to a single building, a block or neighborhood, or in zoning policy across an entire city or other administrative unit. These projects may be completed by a private developer, (quasi-) governmental agency, or a combination thereof. A mixed-use development may be a new construction, reuse of an existing building or brownfield site, or a combination.

Secondary suites are self-contained apartments, cottages, or small residential units, that are located on a property that has a separate main, single-family home, duplex, or other residential unit. In some cases, the ADU or in-law is attached to the principal dwelling or is an entirely separate unit, located above a garage or in the backyard on the same property. In British English the term annex or granny annex is used instead. Reasons for wanting to add a secondary suite to a property may be to receive additional income, provide social and personal support to a family member, or obtain greater security.

<span class="mw-page-title-main">Medium-density housing</span>

Medium-density housing is a term used within urban planning and academic literature to refer to a category of residential development that falls between detached suburban housing and large multi-story buildings. There is no singular definition of medium-density housing as its precise definition tends to vary between jurisdiction. Scholars however, have found that medium density housing ranges from about 25 to 80 dwellings per hectare, although most commonly sits around 30 and 40 dwellings/hectare. Typical examples of medium-density housing include duplexes, triplexes, townhouses, row homes, detached homes with garden suites, and walk-up apartment buildings.

<span class="mw-page-title-main">Zoning in the United States</span>

In the United States, zoning includes various land use laws falling under the police power rights of state governments and local governments to exercise authority over privately owned real property. Zoning laws in major cities originated with the Los Angeles zoning ordinances of 1904 and the New York City 1916 Zoning Resolution. Early zoning regulations were in some cases motivated by racism and classism, particularly with regard to those mandating single-family housing. Zoning ordinances did not allow African-Americans moving into or using residences that were occupied by majority whites due to the fact that their presence would decrease the value of home. The constitutionality of zoning ordinances was upheld by the Supreme Court of the United States in Village of Euclid, Ohio v. Ambler Realty Co. in 1926.

Missing middle housing describes a range of multi-family or clustered housing types that are compatible in scale with single-family or transitional neighborhoods. Missing middle housing is intended to meet the demand for walkable neighborhoods, respond to changing demographics, and provide housing at different price points. The term "missing middle" is meant to describe housing types that were common in the pre-WWII United States such as duplexes, rowhouses, and courtyard apartments but are now less common and, therefore, "missing". Rather than focusing on the number of units in a structure, missing middle housing emphasizes scale and heights that are appropriate for single-family neighborhoods or transitional neighborhoods. After the introduction of the term in 2010, the concept has been applied in the United States, Canada, and Australia.

Market Urbanism is an urban policy theory which advocates for the liberalization of urban planning and transportation policy. Market Urbanists support loosening urban land use and zoning regulations, implementing congestion pricing on public roads, and applying classical liberal theory to urban policy issues.

Since about 1970, California has been experiencing an extended and increasing housing shortage, such that by 2018, California ranked 49th among the states of the U.S. in terms of housing units per resident. This shortage has been estimated to be 3-4 million housing units as of 2017. Experts say that California needs to double its current rate of housing production to keep up with expected population growth and prevent prices from further increasing, and needs to quadruple the current rate of housing production over the next seven years in order for prices and rents to decline.

California Senate Bill 50 was a proposed California bill that would have preempted local government control of land zoning near public transit stations and jobs centers. The bill would have also required, at minimum, four-plex residential zoning statewide. The bill was the successor to a similar bill introduced by state senator Scott Wiener in January 2018 as Senate Bill 827 ; both would have applied to areas within one-half-mile (0.8 km) of frequent transit corridors, including rail stations and bus routes. The bills were sponsored by California YIMBY, a pro-housing lobbying group while they were opposed by local governments, anti-gentrification activists, and suburban homeowners. The bills were written in response to an ongoing housing affordability crisis in California's largest urban areas.

Single-family zoning is a type of planning restriction applied to certain residential zones in the United States and Canada in order to restrict development to only allow single-family detached homes. It disallows townhomes, duplexes, and multifamily housing (apartments) from being built on any plot of land with this zoning designation.
