In the United States, an executive order is a directive by the president of the United States that manages operations of the federal government. The legal or constitutional basis for executive orders has multiple sources. Article Two of the United States Constitution gives presidents broad executive and enforcement authority to use their discretion to determine how to enforce the law or to otherwise manage the resources and staff of the executive branch. The ability to make such orders is also based on expressed or implied Acts of Congress that delegate to the president some degree of discretionary power. The vast majority of executive orders are proposed by federal agencies before being issued by the president.
National security directives are presidential directives issued for the National Security Council (NSC). Starting with Harry Truman, every president since the founding of the National Security Council in 1947 has issued national security directives in one form or another, which have involved foreign, military and domestic policies. National security directives are generally highly classified and are available to the public only after "a great many years" have elapsed. Unlike executive orders, national security directives are usually directed only to the National Security Council and the most senior executive branch officials, and embody foreign and military policy-making guidance rather than specific instructions.
Executive Order 12148 was an executive order enacted by President Jimmy Carter on July 20, 1979, to transfer and reassign duties to the newly formed agency, known as the Federal Emergency Management Agency (FEMA), created by Executive Order 12127. The order combined several federal agencies tasked with emergency preparedness and civil defense spread across the executive departments into a unified entity that was established as an independent agency, free of Cabinet interference, with authority as the lead federal agency in a presidentially-declared disaster.
Executive Order 12170 was issued by American president Jimmy Carter on November 14, 1979, ten days after the Iran hostage crisis had started. The executive order, empowered under the International Emergency Economic Powers Act, ordered the freezing of all Iranian government assets held within the United States.
The Information Security Oversight Office (ISOO) is responsible to the President for policy and oversight of the government-wide security classification system and the National Industrial Security Program in the United States. The ISOO is a component of the National Archives and Records Administration (NARA) and receives policy and program guidance from the National Security Council (NSC).
The Directorate of Operations (DO), less formally called the Clandestine Service, is a component of the US Central Intelligence Agency. It was known as the Directorate of Plans from 1951 to 1973; as the Directorate of Operations from 1973 to 2005; and as the National Clandestine Service (NCS) from 2005 to 2015.
Executive Order 12333, signed on December 4, 1981 by U.S. President Ronald Reagan, was an executive order intended to extend powers and responsibilities of U.S. intelligence agencies and direct the leaders of U.S. federal agencies to co-operate fully with CIA requests for information. This executive order was titled United States Intelligence Activities.
President Harry S. Truman signed United States Executive Order 9835, sometimes known as the "Loyalty Order", on March 21, 1947. The order established the first general loyalty program in the United States, designed to root out communist influence in the U.S. federal government. Truman aimed to rally public opinion behind his Cold War policies with investigations conducted under its authority. He also hoped to quiet right-wing critics who accused Democrats of being soft on communism. At the same time, he advised the Loyalty Review Board to limit the role of the Federal Bureau of Investigation (FBI) to avoid a witch hunt. The program investigated over 3 million government employees, just over 300 of whom were dismissed as security risks.
The National Security and Homeland Security Presidential Directive, signed by President of the United States George W. Bush on May 4, 2007, is a Presidential Directive establishing a comprehensive policy on the federal government structures and operations in the event of a "catastrophic emergency". Such an emergency is defined as "any incident, regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the U.S. population, infrastructure, environment, economy, or government functions."
A presidential determination is a kind of presidential directive issued by the White House stating a determination resulting in an official policy or position of the executive branch of the United States federal government. Presidential determinations may involve any number of actions, including setting or changing foreign policy, setting drug enforcement policy, or any number of other exercises of executive power.
A presidential memorandum is a type of directive issued by the president of the United States to manage and govern the actions, practices, and policies of the various departments and agencies found under the executive branch of the United States government. It has the force of law and is usually used to delegate tasks, direct specific government agencies to do something, or to start a regulatory process. There are three types of presidential memoranda: presidential determination or presidential finding, memorandum of disapproval, and hortatory memorandum.
Executive Order 13526 was issued on December 29, 2009, by United States President Barack Obama. It is one of a series of executive orders from US Presidents outlining how classified information should be handled. It revokes and replaces the previous Executive Orders in effect for this, which were EO 12958 (text) and EO 13292 (text).
The Assistant to the Secretary of Defense for Intelligence Oversight, formerly the Senior Intelligence Oversight Official, or SIOO, was responsible to the U.S. Secretary of Defense for the independent oversight of all intelligence, counterintelligence, and intelligence-related activities in the Department of Defense. The organization's charter is articulated in DoD Directive 5148.13. The ATSD(IO) ensures that all activities performed by intelligence, counterintelligence, and intelligence related units are conducted in accordance with Federal law, Executive Orders, DoD directives, regulations and policies. In July 2014, this position was retitled as the Department of Defense Senior Intelligence Oversight Official, after the position was aligned within the Office of the Deputy Chief Management Officer (DCMO). On January 11, 2021, the Acting Secretary of Defense directed the "re-establishment" of the ATSD(IO) office and title. On September 1, 2021, the Department of Defense disestablished the ATSD (IO) and subordinated the DoD Intelligence Oversight function under a new Assistant to the Secretary of Defense for Privacy, Civil Liberties & Transparency, ASTD (PCLT).
The National Defense Resources Preparedness executive order is an order of the President of the United States, signed by President Barack Obama on March 16, 2012. The purpose of this executive order is to delegate authority and address national defense resource policies and programs under the Defense Production Act of 1950. Executive Order 13603 provides the framework and authority for the allocation or appropriation of resources, materials, and services to promote national defense.
A presidential directive, or executive action, is a written or oral instruction or declaration issued by the president of the United States, which may draw upon the powers vested in the president by the U.S. Constitution, statutory law, or, in certain cases, congressional and judicial acquiescence. Such directives, which have been issued since the earliest days of the federal government, have become known by various names, and some have prescribed forms and purposes. Presidential directives remain in effect until they are revoked, which the president is free to do. The classification of presidential directives is not easily done, as the distinction between the types can be quite arbitrary, arising from convenience and bureaucratic evolution, and none are defined in the Constitution. Furthermore, the different types may overlap. As one legal scholar put it: "it is a bit misleading to overclassify presidential directives as comprising separate and distinct 'types' just because they have different headings at the top of the first page." In terms of legal applicability, what matters is the substance of the directive, not the form, unless a certain kind of directive is specifically required by relevant statute.
