Nintendo and fan games

The stance of Nintendo, a video game company, towards fan games has historically been hostile, in accordance with their proactive protections on intellectual property (IP) usage. Fan games have been heavily targeted for removal by the company, resulting in numerous DMCA takedowns. As Nintendo is one of the most popular companies in the gaming realm for fan-made content, this strict enforcement of copyright guidelines has proven controversial with critics and fans. Despite acknowledging that these takedowns are within Nintendo's rights, critics have argued that Nintendo should set guidelines and policies on fan content in a similar vein as other major publishers, such as Riot Games, Bethesda Softworks, and Sega, in order to maintain fan goodwill and allow for free expression. While former Nintendo president Satoru Iwata expressed interest in adopting such guidelines in 2010, Nintendo has since maintained a hardline stance, removing anything remotely popular that might infringe upon a Nintendo copyright. Despite Nintendo's assertions that they are protecting their copyright, their common takedowns of free, not-for-profit games have been described as legally unnecessary, as they are normally used as a "last line of defense" against those seeking to profit from another's IP. History

In 2016, Nintendo issued DMCA takedowns for hundreds of fan games hosted on the platform Game Jolt, as well as others off-site, such as the unofficial Metroid II remake, AM2R . This followed another takedown request for AM2R issued earlier that year. [2] Two of the affected games, Pokémon Uranium and AM2R, had been nominated for The Game Awards that year, and were subsequently removed. [3] Later the same year, Pokémon Prism was also shut down. [4]

In 2020, an in-development Mother 3 fan sequel previously dubbed Mother 4 was renamed Oddity , and its references to the series removed, in order to prevent the game from being taken down. [5] An "ambitious" Metroid -based fan game, Metroid Prime 2D, which had been in development for 15 years, was taken down by Nintendo in August 2021, four months after a demo was released. [6] In March 2024, former lawyer of The Pokemon Company Don McGowan interviewed with Aftermath about his time working at Bungie and the company. McGowan also discussed about the company's approach to cease and desist and point out that there was many discussions about the 2024 video game Palworld due of its similarity to the Pokemon franchise. In 2016, Sean Buckley of Engadget remarked on the takedown of 500 games. While noting that Nintendo was "within its right to put a lid on these fan projects", he called the takedowns "always a bummer". He described the removed games as "passionate fan works", and AM2R as "lovingly crafted". [2] Kyle Orland of Ars Technica remarked on this as well, saying that while cease-and-desist letters were nothing new in the gaming industry, Nintendo's stance was "wide-ranging" and "hardline". [26] Jon Partridge of Red Bull said that while most of the removed games would "not be missed", several of the removed games were nevertheless "amazing", such as Pokémon Uranium and AM2R. [27]

In 2017, Owen S. Good of Polygon argued that creating and sharing fan games was a "significant part of gaming culture" that could not be denied or shut down by publishers, despite Nintendo's attempts to do so. Using the example of Breath of the NES, a 2D fan-made demake of The Legend of Zelda: Breath of the Wild , he highlighted that any creators making fan games based on Nintendo IP expected to be shut down, forcing creators to remove any Nintendo references. While many fans adopted the position that fan games should not be advertised until they were released, allowing for "underground" distribution, this would be completely untenable for many fan game creators, who would receive no player feedback or motivation to continue development. Stephen McArthur, the "video game lawyer", was interviewed for the piece, and noted that most major publishers had rules for fan-created content that incorporates their IP. He stated that, while publishers reserve the right to shut something down for any reason, blanket prohibitions on fan works are "legally unnecessary and also a terrible business and marketing policy". He also noted that Nintendo's repeated takedowns had no proactive effect, as they did not stop further fan works from being created, while at the same time angering fans. Developers simply assume that they will be caught and proceed with making the game anyway. [1]

In 2019, Luke Plunkett of Kotaku said that Nintendo's copyright takedowns were so "predictable and tragic" that they had become an Internet meme, noting that Nintendo was disproportionately focused on removing fan games, while ignoring fan art, music, etc. While saying that Nintendo's lawyers have a "job to do" and that they should not be blamed, he still expressed his opinion that "the letter of the law can and does suck", and that the company was failing to distinguish between "things that are trying to steal from them" and "homages to their legacy". He described Nintendo's response at the time as "almost algorithmic" and "ruthless" in "shutting down even the most innocuous projects". He highlighted Nintendo's former Creator's Program for YouTube videos as an example to emulate in the fan game realm, and said that, even outside Nintendo's legal departments, many in Nintendo, such as employees at Game Freak, enjoyed seeing fan games. He also noted that Installation 01 , a Halo fan game, had reached a deal with Microsoft to continue development, saying that such things could be possible with Nintendo fan games as well. [28]

Players must find and exterminate the Metroids to progress.

A fan game is a video game that is created by fans of a certain topic or IP. They are usually based on one, or in some cases several, video game entries or franchises. Many fan games attempt to clone or remake the original game's design, gameplay, and characters, but it is equally common for fans to develop a unique game using another as a template. Though the quality of fan games has always varied, recent advances in computer technology and in available tools, e.g. through open source software, have made creating high-quality games easier. Fan games can be seen as user-generated content, as part of the retrogaming phenomena, and as expression of the remix culture.

AM2R is an action-adventure game developed by Argentinian programmer Milton Guasti and released on August 6, 2016, Metroid's 30th anniversary. It was originally released for Windows. It is an unofficial remake of the 1991 Game Boy game Metroid II: Return of Samus in the style of Metroid: Zero Mission (2004). As in the original Metroid II, players control bounty hunter Samus Aran, who aims to eradicate the parasitic Metroids. AM2R adds several features, including new graphics and music, new areas and bosses, altered controls, and a map system.

<i>Pokémon Uranium</i> 2016 video game

Pokémon Uranium is a fan-made video game based on the Pokémon series. The game was in development for nine years, and used the RPG Maker XP engine. The game adds 166 new fan-made species of Pokémon, with only 160 currently available, along with a new region. Similar to the official games, Uranium contains both online trading and online battling. In August 2016, after one and a half million downloads, the download links for Pokémon Uranium were taken down from the official website because the developers wanted to "respect Nintendo's wishes", after learning other sites that offered the download received DMCA takedown notice letters from lawyers representing Nintendo. The following month, the developers announced that they had officially ceased development of the title and shut down the website and servers. Following the announcement, community members created a new website and continued to develop patches for the base game, including bug fixes and new features.

The Nintendo data leak, also known as the Nintendo Gigaleak, is a series of leaks of data from the Japanese video game company Nintendo on the anonymous imageboard website 4chan. The leak started in March 2018, but became most prominent in 2020. Ten main sets of data leaked on 4chan, ranging from game and console source code to internal documentation and development tools. The name "Gigaleak" mainly refers to the second leak on July 24, 2020, which was 3 gigabytes in size. The leaks are believed to have come from companies contracted by Nintendo in the design of these consoles, and/or from individuals previously convicted of intrusion into Nintendo systems. An earlier, much smaller leak had also occurred in 2018 which contained the Nintendo Space World 1997 demos for Pokémon Gold and Silver.

freeShop Defunct piracy software for the Nintendo 3DS

freeShop was a homebrew application for the Nintendo 3DS that allowed games to be downloaded from the Nintendo eShop's servers without being previously purchased. freeShop was first released in April 2016, before being removed from GitHub following a DMCA takedown notice sent in late December 2016.

A reanimated collaboration is a type of collaborative fan-made animation project wherein each animator recreates one shot of an existing film in their own style. The individual works are then stitched into the original order and published on the internet as a completed collaboration, creating a collaborative tribute to the original film. This differs from a shot-for-shot recreation, as the goal of a reanimate is to display each of the independent animators' unique stylings rather than to produce a unified or identical result. Multiple collaborations focus on media made a decade or more prior that receives renewed interest due to internet memes, nostalgia, or the death of a voice actor. As they are often non-profit tributes to an existing work, animators expect to receive little or no profit.

Emulators of the Nintendo Switch, Nintendo's current eighth-generation video game console, have been in development since 2017, less than a year after the console's release. Multiple emulators have been in development, the most well-known being the now-defunct Yuzu, and Ryujinx. Switch emulators have been widely noted by video games journalists for the swift and significant progress of their abilities to accurately emulate the console, as they are already able to run existing and new titles for the console in a playable state, sometimes within days of their release, as well as able to run on a variety of devices, including PCs running Microsoft Windows and Linux, and the Steam Deck.

<span class="mw-page-title-main">PointCrow</span> American internet personality (born 1998)

Eric Morino, better known as PointCrow, is an American YouTuber and Twitch streamer. He is known for online content surrounding video games—most notably The Legend of Zelda: Breath of the Wild and The Legend of Zelda: Tears of the Kingdom—and other real life productions. He has completed several challenges based around Breath of the Wild, and has received media attention for offering a US$10,000 bounty to whoever created a mod that allowed the game to be played in online multiplayer. The mod was released on April 4, 2023, and some of Morino's videos making use of it were issued YouTube copyright strikes by Nintendo shortly after.

Pokémon Essentials was a development tool for Pokémon fangames developed by Maruno and released in 2007, functioning as a free add-on for RPG Maker XP. It was notably used to create a number of Pokémon fangames before being taken offline alongside its Fandom wiki in 2018 following a copyright infringement claim by Nintendo. Its shutdown was controversial with fans, and was described as a major blow against the creation of fangames for the series. Still, unofficial forks have continued to exist, to keep Pokémon Essentials updated with elements introduced in later generations.

Legend Maker, formerly known as Zelda Maker, is an indie video game developed by Justin Sink. Inspired by Super Mario Maker, it allows players to create their own top-down adventure games in a similar graphical and gameplay style to early games in Nintendo's Legend of Zelda series. A first demo of the game was released in 2015, but was subject to a cease and desist and copyright takedown from Nintendo, despite positive feedback from critics and fans. The game was then rebooted with similar, yet original art assets as Legend Maker so as not to infringe on Nintendo's copyrights. While a 2016 Kickstarter campaign failed, the game remains in development as of 2024.
