The Public Dance Halls Act 1935 is an Act of the Oireachtas which regulates dance halls in Ireland by introducing a licensing system and a tax on admission tickets. [1]

Background

The proposals were based on the recommendations of the 1932 report of the Carrigan Commission into juvenile sex crimes. [2] Other Carrigan Report recommendations were enacted in the Criminal Law (Amendment) Bill, which raised the age of consent and banned artificial contraception. [2] [3] On dance halls, the report stated:

In the course of the Inquiry no form of abuse was blamed more persistently for pernicious consequences than the unlicensed dances held all over the country in unsuitable buildings and surroundings, for the profit of persons who are liable to no control or supervision by any authority. The scandals that are the outcome of such a situation are notorious. They have been denounced in pastorals, exposed in the Press, and condemned by clergy, judges and justices, without avail. Before us the Commissioner, speaking for the Civic Guard, said these dance gatherings in many districts were turned into "orgies of dissipation, which in the present state of legislation the police are powerless to prevent." In short, there is no effective legislation to put down this nuisance.

The Public Dance Halls Bill was introduced in 1934 by the then government of Fianna Fáil, and supported by the opposition Fine Gael and Labour parties. [4] It was supported by the Catholic hierarchy. Secular nationalist institutions like the Gaelic League the legislation were seen as beneficial for protecting Irish culture against foreign influence. [5]

Cultural effect

Licensing is administered at the district court, subject to the discretion of the local judge. In the early years of its effect, they were less tolerant of more recently introduced musical styles, such as set dancing (seen as "foreign") and jazz dance clubs. [6] [7] [8] However, it also disadvantaged many traditional Irish musical activities, such as private house dances and crossroad dances, forcing spontaneous and social music and dance into a controlled and commercialized environment. This set the conditions for the predominance of the céilidh, with its large and loud musical ensembles and wide open dance spaces. [5] [9] The ceilidh arose at the expense of older traditional music, which declined in popularity for decades until the creation of the Comhaltas Ceoltóirí Éireann, and later the Folk Revival brought new attention to traditional Irish music. [7]

Current status

The Act remains in force, with amendments. [10] Nightclubs may be subject to stricter conditions in some districts than in others, depending on the particular judge. The Irish Nightclub Industry Association has described the legislation as "archaic". [11] In 2001 there was confusion about whether the Act applied to lapdancing clubs. [12]

Constitution of the Irish Free State

The Constitution of the Irish Free State was adopted by Act of Dáil Éireann sitting as a constituent assembly on 25 October 1922. In accordance with Article 83 of the Constitution, the Irish Free State Constitution Act 1922 of the British Parliament, which came into effect upon receiving the royal assent on 5 December 1922, provided that the Constitution would come into effect upon the issue of a Royal Proclamation, which was done on 6 December 1922. In 1937 the Constitution of the Irish Free State was replaced by the modern Constitution of Ireland following a referendum.

The Attorney General of Ireland is a constitutional officer who is the legal adviser to the Government and is therefore the chief law officer of the State. The attorney general is not a member of the Government but does participate in cabinet meetings when invited and attends government meetings. The current attorney general is Paul Gallagher, SC.

The Fourth Amendment of the Constitution Act 1972 is an amendment to the Constitution of Ireland which lowered the voting age for all national elections and referendums in the state from twenty-one to eighteen years of age. It was approved by referendum on 7 December 1972 and signed into law on 5 January 1973.

Wexford is a parliamentary constituency represented in Dáil Éireann, the lower house of the Irish parliament or Oireachtas. The constituency elects 5 deputies on the system of proportional representation by means of the single transferable vote (PR-STV).

In the Irish Free State, an extern minister, formally a Minister who shall not be a Member of the Executive Council, was a minister who had charge of a department but was not a member of the Executive Council. Extern ministers were individually nominated by Dáil Éireann, whereas of the Executive Council only the President was: he in turn nominated the other members. All ministers were formally appointed by the Governor-General. The Executive Council included the senior ministers, exercised cabinet collective responsibility, and had to be TDs ; the extern ministers filled more junior technocratic roles, and need not be legislators, though in fact all were TDs. In practice, all ministers formed a united administration, and no extern ministers were appointed after 1927.

Ministers and Secretaries Acts

The Ministers and Secretaries Acts 1924 to 2020 is the legislation which governs the appointment of ministers to the Government of Ireland and the allocation of functions between departments of state. It is subject in particular to the provisions of Article 28 of the Constitution of Ireland. The Acts allow for the appointment of between 7 and 15 Ministers of Government across 17 Departments, and for the appointment of up to 20 junior ministers, titled Ministers of State, to assist the Ministers of Government in their powers and duties.

Capital punishment in the Republic of Ireland was abolished in statute law in 1990, having been abolished in 1964 for most offences including ordinary murder. The last to be executed was Michael Manning, hanged for murder in 1954. All subsequent death sentences, the last handed down in 1985, were commuted by the President, on the advice of the Government, to terms of imprisonment of up to 40 years. The Twenty-first Amendment of the constitution, passed by referendum in 2001, prohibits the reintroduction of the death penalty, even during a state of emergency or war. Capital punishment is also forbidden by several human rights treaties to which the state is a party.

Emergency Powers Act 1939

The Emergency Powers Act 1939 (EPA) was an Act of the Oireachtas enacted on 3 September 1939, after an official state of emergency had been declared on 2 September 1939 in response to the outbreak of the Second World War. The Act empowered the government to:

make provisions for securing the public safety and the preservation of the state in time of war and, in particular, to make provision for the maintenance of public order and for the provision and control of supplies and services essential to the life of the community, and to provide for divers and other matters connected with the matters aforesaid.

The Constitution Act 1931, popularly called the Public Safety Act 1931, was an Act of the Oireachtas of the Irish Free State amending the Constitution of the Irish Free State. It inserted Article 2A which empowered the Executive Council to declare a state of emergency during which most provisions of the constitution could be suspended and extra security measures taken. These measures included the uses of the Constitution Tribunal, a military tribunal, to try civilians for political offences, granting extra powers of search and arrest to the Garda Síochána (police), and the prohibition of organisations deemed a threat to the state's security.

The Electoral Act 1923 was a law in Ireland which established the electoral law of the Irish Free State and provided for parliamentary constituencies in Dáil Éireann.

The crossroads dance was a type of social event popular in Ireland up to the mid-20th century, in which people would congregate at the large cleared space of a crossroads to dance. In contrast to the later ceili styles, crossroad dances were generally set dancing or solo dancing. The crossroads dance declined in popularity in the mid-20th century, due to rural depopulation, musical recordings, and pressure of the Catholic clergy which resulted in the Public Dance Halls Act of 1935 which restricted all dancing to licensed establishments. In the early 1930s the wooden platforms at crossroads became the focus of standoffs and faction fights between Fianna Fáil and the Blueshirts, with some destroyed by arson.

Ireland has had a franchise on an equal basis between men and women since the establishment of the Irish Free State in 1922. Historically, there had also been discrimination from the franchise on the basis of religion and on the basis of property. In 1972, the age of qualification for the franchise was reduced from 21 years to 18 years.

The Republic of Ireland has limited use of order of precedence.

Cannabis in Ireland is illegal for recreational purposes. Use for medical purposes requires case-by-case approval by the Minister for Health. A bill to legalise medical uses of cannabis passed second reading in Dáil Éireann in December 2016.

The Constitution Act 1933 was an Act of the Oireachtas of the Irish Free State amending the Constitution of the Irish Free State and the Constitution of the Irish Free State Act 1922. It removed the Oath of Allegiance required of members of the Oireachtas (legislature) and of non-Oireachtas extern ministers.

The Constitution Act, 1936 was an act of the Oireachtas (parliament) of the Irish Free State which abolished Seanad Éireann, the upper house of the Oireachtas, which thenceforth was unicameral, with Dáil Éireann as the sole house. The bill was introduced in 1934 by the Fianna Fáil government of Éamon de Valera, which was frustrated by the Seanad's repeated use of its power to delay legislation. In particular, Fianna Fáil favoured eliminating symbols of monarchy from the Free State, which the Seanad, with more Southern Unionist members, feared would antagonise the United Kingdom.

The Constitution Act 1936 was an Act of the Oireachtas of the Irish Free State amending the Constitution of the Irish Free State which had been adopted in 1922. It abolished the two university constituencies in Dáil Éireann.

It removed the restriction on the jurisdiction on citizenship law to the effect that citizenship rights only applied within the jurisdiction of the Free State.
