The Supreme Court of India is the supreme judicial authority and the highest court of the Republic of India. It is the final court of appeal for all civil and criminal cases in India. It also has the power of judicial review. The Supreme Court,which consists of the Chief Justice of India and a maximum of fellow 33 judges,has extensive powers in the form of original,appellate and advisory jurisdictions.
Capital punishment in India is a legal penalty for some crimes under the country's main substantive penal legislation,the Indian Penal Code,as well as other laws. Executions are carried out by hanging as the primary method of execution per Section 354(5) of the Criminal Code of Procedure,1973 is "Hanging by the neck until dead",and is imposed only in the 'rarest of cases'.
Section 377 of the British colonial penal code criminalized all sexual acts "against the order of nature". The law was used to prosecute people engaging in oral and anal sex along with homosexual activity. As per Supreme Court Judgement since 2018,Indian Penal Code Section 377 is used to convict non-consensual sexual activities among homosexuals with a minimum of ten years imprisonment extended to life imprisonment. It has been used to criminalize third gender people,such as the apwint in Myanmar. In 2018,then British Prime Minister Theresa May acknowledged how the legacies of British colonial anti-sodomy laws continue to persist today in the form of discrimination,violence,and death.
Yeshwant Vishnu Chandrachud was an Indian jurist who served as the 16th Chief Justice of India,serving from 22 February 1978 to the day he retired on 11 July 1985. Born in Pune in the Bombay Presidency,he was first appointed a Justice of the Supreme Court of India on 28 August 1972 and is the longest-serving Chief Justice in India's history at 7 years and 4 months. His nickname was Iron Hands after his well-regarded unwillingness to let anything slip past him.
Jagdish Sharan Verma was an Indian jurist who served as the 27th Chief Justice of India from 25 March 1997 to 18 January 1998. He was the chairman of the National Human Rights Commission from 1999 to 2003,and chairman of the Justice Verma Committee Report on Amendments to Criminal Law after the 2012 Delhi gang rape case. He remains one of India's most highly regarded Chief Justices and eminent jurists in its history.
The Constitution Act,1951,enacted in 1951,made several changes to the Fundamental Rights provisions of the Indian constitution. It provided means to restrict freedom of speech and expression,validation of zamindari abolition laws,and clarified that the right to equality does not bar the enactment of laws which provide "special consideration" for weaker sections of society.
Naz Foundation v. Govt. of NCT of Delhi (2009) is a landmark Indian case decided by a two-judge bench of the Delhi High Court,which held that treating consensual homosexual sex between adults as a crime is a violation of fundamental rights protected by India's Constitution. The verdict resulted in the decriminalization of homosexual acts involving consenting adults throughout India. This was later overturned by the Supreme Court of India in Suresh Kumar Koushal vs. Naz Foundation,in which a 2 judge bench reinstated Section 377 of the Indian Penal Code. However,even that was overturned by a 5 judge bench in Navtej Singh Johar v. Union of India in 2018,decriminalizing homosexuality once again.
Ananga Kumar Patnaik is an Indian jurist and a former judge of the Supreme Court of India.
Colin Gonsalves is a designated Senior Advocate of the Supreme Court of India and the founder of Human Rights Law Network (HRLN). He specializes in human rights protection,labour law and public interest law. He has been awarded Right Livelihood Award for the year 2017 for "his tireless and innovative use of public interest litigation over three decades to secure fundamental human rights for India’s most marginalised and vulnerable citizens." Considered a pioneer in the field of public interest litigation in India,he has brought several cases dealing with economic,social and cultural rights. Most of these cases,decided by the Supreme Court,have been set as precedents.
Anand Grover is a senior lawyer known for legal activism in Indian law relating to homosexuality and HIV. Along with his wife Indira Jaising,he is a founder-member of the Lawyers Collective. He was the United Nations Special Rapporteur on the right to health from August 2008 to July 2014. He is currently and acting member of the Global Commission on Drug Policy.
Dipak Misra is an Indian jurist who served as the 45th Chief Justice of India from 28 August 2017 till 2 October 2018. He is also former Chief Justice of the Patna High Court and Delhi High Court. He is the nephew of Justice Ranganath Misra,who was the 21st Chief Justice from 1990 to 1991.
Kuttiyil Mathew Joseph is a former judge of the Supreme Court of India;he retired on 16 June 2023. He is former chief justice of the Uttarakhand High Court. Before his appointment as chief justice of the High Court of Uttarakhand on 31 July 2014,he had served as a judge of the Kerala High Court for more than nine years.
Sudhansu Jyoti Mukhopadhaya is a former justice of the Supreme Court of India. He was also chair of the National Company Law Appellate Tribunal from 1 June 2016 to 14 March 2020. He previously served as Chief Justice of Gujarat High Court and also served as acting Chief Justice at the Jharkhand High Court and the Madras High Court.
Prafulla Chandra Pant is an Indian judge and author who served as a judge of the Supreme Court of India from 2014 to 2017. He later served as a member of the National Human Rights Commission of India from 2019 to 2021,and briefly acted as its chairperson. Prior to his appointment as a judge of the Supreme Court of India,he had previously served as chief justice of the Meghalaya High Court at Shillong and as a judge of the Uttarakhand High Court at Nainital.
Lily Isabel Thomas was an Indian lawyer who initiated improvement and change to existing laws by filing petitions in India's apex court,the Supreme Court of India and regional courts. Her petitions resulted in changes to laws to prevent convicted politicians getting elected,the addition of a new marriage law and protections for parliamentarians. She was hailed most notably for petitioning to amend the Representation of the People Act,1951.
Olga Tellis v. Bombay Municipal Corporation was a 1985 case in the Supreme Court of India. It came before the Court as a written petition by pavement and slum dwellers in Bombay,seeking to be allowed to stay on the pavements against their order of eviction during the monsoon months by the Bombay Municipal Corporation.
Justice K. S. Puttaswamy is an Indian retired judge of the Karnataka High Court who was also the original petitioner,challenging the Government of India over making Aadhaar mandatory. He had filed a writ petition in 2012 and over the last five years,26 other petitions have been tagged along with his,challenging the scheme.
Justice K.S. Puttaswamy (Retd.) &Anr. vs. Union of India &Ors. (2017),also known as the Right to Privacy verdict,is a landmark decision of the Supreme Court of India,which holds that the right to privacy is protected as a fundamental right under Articles 14,19 and 21 of the Constitution of India.
Ujjawal &Anr. versus State of Haryana&Ors.(2021),a case where Punjab and Haryana High Court,refused to provide police protection to a couple facing threat to their lives and personal liberty,citing potential disruption to "social fabric of the society."
