Each year, the journal selects 52 new members from a class of approximately 450. Members are selected using a competitive process, which takes into account an applicant's first-year grades, performance in a writing competition, and potential to contribute to diversity on the journal.^[4]

Lawsuit over discrimination against white males

On October 6, 2018, a group called "Faculty, Alumni, and Students Opposed to Racial Preferences" filed a lawsuit in the United States District Court for the Southern District of New York against the review over discrimination against white males in selecting staff editors and articles to publish.^[9] The challengers lost at trial ^[10] and again on appeal to the United States Court of Appeals for the Second Circuit.^[11] The Supreme Court of the United States declined to review the case.^[12]

The New York University School of Law is the law school of New York University, a private research university in New York City. Established in 1835, it was the first law school established in New York City and is the oldest surviving law school in New York State and one of the oldest law schools in the United States. Wachtell, Lipton, Rosen & Katz is an American law firm in New York City, considered to be the top firm in the United States for major mergers and acquisitions. While many peer law firms have grown and become international brands, Wachtell has only a single, Manhattan office. It is one of the smallest firms in the AmLaw 100, but has the highest per partner profits of any law firm and pays significantly above the "Cravath scale" market rate for associates. The firm pays its partners through a lockstep system, meaning that compensation is tied to firm seniority, rather than hours billed or business brought in. The same is true for associate bonuses. This compensation model has led to the firm being called the "last true partnership."

Martin Lipton is an American lawyer, a founding partner of the law firm of Wachtell, Lipton, Rosen & Katz specializing in advising on mergers and acquisitions and matters affecting corporate policy and strategy. From 1958–1978 he taught courses on Federal Regulation of Securities and Corporation Law as a lecturer and adjunct professor of law at New York University School of Law.

He writes and teaches primarily in the areas of behavioral law and economics, intellectual property, and criminal law Masur also directs the Wachtell, Lipton, Rosen & Katz Program in Behavioral Law, Finance, and Economics.

Jerome H. Kern is an American lawyer, investment banker, consultant, and philanthropist. Kern was one of the founding members of Wachtell, Lipton, Rosen & Katz. After a career in investment banking, he served as a senior partner of Shea & Gould, then at Baker Botts, while holding senior leadership positions at Tele-Communications Inc. In the early 2000s, he was CEO of Linkshare, On Command, and Playboy. He was also chairman and CEO of Colorado Symphony and is currently a senior advisor to Moelis & Company.
