1894 Constitution of the Republic of Hawaii

The 1894 Constitution of the Republic of Hawaii was the fundamental law of the short-lived Republic of Hawaii before it was annexed by the United States. It was promulgated by a constitutional convention of 35 members: 19 from the Executive and Advisory Councils of the Provisional Government of Hawaii and 18 delegates elected by those who were eligible to do so. While based on the American system of government, there were several notable changes.

Preparations for the constitutional convention

When it was obvious that annexation to the United States would not be immediate, the Provisional Government decided to end their temporary form of government and establish a more permanent system of government. A resolution to elect a constitutional convention to draft a permanent constitution passed the Provisional Government on February 15, 1894, who appointed a committee to draft a law for it. That committee came back with a draft on March 8, which was passed into law a week later on March 15. [1]

The election was set for May 2, 1894. The method of election was changed from those of previous ones in Hawaii: each voter had as many votes as delegates his district were to choose, and could split them however they wish. Voters were required to be male and at least twenty years old, to have lived in Hawaii for at least a year and be a registered voter, to swear allegiance to the Provisional Government, to be "of Hawaiian, American or European birth or descent", and to have paid their taxes for 1893. Those who had not paid their taxes or resided in Hawaii for the required time could still vote, though, if they could prove they were soldiers, militiamen, or policemen on January 1, 1894. [2]

Some supporters of the Provisional Government, not to mention supporters of the Kingdom of Hawaii, opposed the allocation of delegates since it ensured members of the government would always have a majority. [3] That opposition did not prompt any changes in the apportionment of delegates. Clubs supportive of annexation combined to form an American Union Party, which requested government endorsement but was denied as in their view it would be "impolitic". The government also encouraged Native Hawaiians to register, and asked Albert S. Willis, the ambassador of the United States to Hawaii, to issue a statement that the monarchy was over; he refused because he stated he did not have the authority to do so. Portuguese on the islands were also enticed to vote by the promise that the oath to the Provisional Government would not affect their status as Portuguese citizens. In April 1894 the Provisional Government began to prepare a draft for the convention to consider when writing the final document. Eight to twelve people from Honolulu advised them, and Lorrin A. Thurston, Hawaiian minister to the US at the time, also sent in his thoughts on the matter. They also received many proposals from the United States, but discarded most of them because they did not consider them "in line with existing circumstances". [4]

There was some competition, but no organized opposition parties, in the election. Against the wishes of the administration that government officials not be nominated, a judge was nominated in a Honolulu district, while another campaigned for the constitution to be ratified by popular vote, not just by the convention. A little more than four thousand people were reported to be registered, less than half the number of those registered for the preceding one. On the day of the election, 2,904 people voted, about three-quarters of those registered and 2.9 percent of the whole population of the islands. [5] While people from many countries with many political views were elected, none were opposed to annexation. [6]

The convention opened at 11 AM on May 30, 1894, at the legislative hall in the Judiciary Building. President Sanford B. Dole gave the opening address, in which he declared that the monarchy had come to its end by attempting to deprive the people of their rights. He also reminded the delegates that they had a "difficult and delicate...duty...to perform.", as the people of Hawaii came from many countries and were "without a common origin, religion or purpose". He stated voting was a duty, not a right, which only intelligent people could perform well, and recommended that only people who owned a certain amount of property should be allowed to vote, as in his view this would reflect intelligence. [7]

After settling a dispute over whether one of its members had been lawfully elected, the Convention decided upon how it was to approve the constitution: there would be two readings, in each of which the constitution would be considered article by article. Later a third reading was added "for purposes of revision only." The first thirteen articles, relating to the rights of the people, were mostly passed by unanimous consent, but a clause banning advocacy for restoring the monarchy, violently overthrowing the government, or invading the country, was shot down and replaced by a clause banning "the publication or public utterance of seditious or indecent language". A section allowing the government to make laws for the "registration, supervision, control and identification of all persons or of any class or nationality of persons" was placed in the very first article. [8] At the second reading it was decided that the government should have the right to appeal acquittals in criminal cases, but later it was repealed. [9]

The question of who could vote and be a citizen hung over the convention. The draft allowed people who had lived in Hawaii for a year, spoke English, come from a country "with express treaty stipulations with the Republic of Hawaii concerning naturalization", had a way to support themselves, owned $200, and swore an oath of loyalty to the Republic of Hawaii to be naturalized. [10] After much debate between those who favored one and three years of residence in Hawaii to qualify for citizenship, a compromise at two years of residence was carried by one vote. [11] The requirement for the naturalized person to come from a nation with treaty relations with the Republic of Hawaii led the Chinese population of the islands, whose government did not have a treaty with Hawaii, to petition the convention twice requesting equal rights, as well as the Japanese consul on Hawaii to demand equal rights of suffrage for his people, but the convention did not amend this clause. In fact, there were no countries in the world who had signed a naturalization treaty with Hawaii, but the problem was solved with the mechanism of "denization". [12]

The Republic of Hawaiʻi was a short-lived one-party state in Hawaiʻi between July 4, 1894, when the Provisional Government of Hawaii had ended, and August 12, 1898, when it became annexed by the United States as an organized incorporated territory of the United States. In 1893 the Committee of Public Safety overthrew Kingdom of Hawaii Queen Liliʻuokalani after she rejected the 1887 Bayonet Constitution. Sanford Ballard Dole was a lawyer, usurper and jurist from the Hawaiian Islands as a kingdom, protectorate, republic, and territory. A descendant of the American missionary community to Hawaii, Dole advocated the westernization of Hawaiian government and culture. After the overthrow of the monarchy, he served as the President of the Republic of Hawaii until his government secured Hawaii's annexation by the United States.

Committee of Safety (Hawaii) Organization

The Committee of Safety, formally the Citizen's Committee of Public Safety, was a 13-member group of the Annexation Club. The group was composed of mostly Hawaiian subjects of American descent and American citizens who were members of the Missionary Party, as well as some foreign residents in the Kingdom of Hawaiʻi. The group planned and carried out the overthrow of the Kingdom of Hawaiʻi on January 17, 1893. The goal of this group was to achieve annexation of Hawaiʻi by the United States. The new independent Republic of Hawaiʻi government was thwarted in this goal by the administration of President Grover Cleveland, and it was not until 1898 that the United States Congress approved a joint resolution of annexation creating the U.S. Territory of Hawaiʻi.

Lorrin A. Thurston Hawaiian politician

Lorrin Andrews Thurston was an American lawyer, politician, and businessman born and raised in the Kingdom of Hawaiʻi. Thurston played a prominent role in the Overthrow of the Hawaiian Kingdom that replaced Queen Liliʻuokalani with the Republic of Hawaii, dominated by American interests. He published the Pacific Commercial Advertiser, and owned other enterprises. From 1906 to 1916 he and friends lobbied with national politicians to create a National Park to preserve the Hawaiian Volcanoes.

Provisional Government of Hawaii

The Provisional Government of Hawaii, abbreviated "P.G.", was proclaimed after the coup d'état on January 17, 1893, by the 13-member Committee of Safety under the leadership of its chairman Henry E. Cooper and former judge Sanford B. Dole as the designated President of Hawaii. It replaced the Kingdom of Hawaii after the overthrow of Queen Liliʻuokalani as a provisional government until the Republic of Hawaii was established on July 4, 1894.

The proposed 1893 Constitution of the Hawaiian Kingdom would have been a replacement of the Constitution of 1887, primarily based on the Constitution of 1864 put forth by Queen Lili'uokalani. While it never became anything more than a draft, the constitution had a profound impact on Hawaiʻi's history: it set off a chain of events that eventually resulted in the overthrow of the Hawaiian Kingdom.

Along with the Blount Report submitted in 1893, it is one of the main source documents compiling the testimony of witnesses and participants in the overthrow of the Hawaiian Kingdom in January 1893. The Morgan Report was the final result of an official U.S. Congressional investigation into the overthrow, conducted by the United States Senate Committee on Foreign Relations, whose chairman was Senator John Tyler Morgan, Democrat of Alabama.

The overthrow of the Hawaiian Kingdom began on January 17, 1893, with a coup d'état against Queen Liliʻuokalani on the island of Oahu by local and international businessmen and government officials. They prevailed upon the United States Minister John L. Stevens to call in U.S. sailors and Marines to protect American interests, an action that effectively buttressed the rebellion. The insurgents established the Republic of Hawaii, but their ultimate goal was the annexation of the islands to the United States, which occurred in 1898.

However, there were several challenges to the reigning governments of the Kingdom and Republic of Hawaii during the 8+12-year (1887–1895) period.

Opposition to the overthrow of the Hawaiian Kingdom took several forms. Following the overthrow of the monarchy on January 17, 1893, Hawaii's provisional government—under the leadership of Sanford B. Dole—attempted to annex the land to the United States under Republican Benjamin Harrison's administration. But the treaty of annexation came up for approval under the administration of Grover Cleveland, a Democrat, anti-expansionist, and friend of the deposed Queen Liliuokalani of Hawaii. Cleveland retracted the treaty on March 4, 1893, and launched an investigation headed by James Henderson Blount; its report is known as the Blount Report.

William Pūnohu White

William Pūnohuʻāweoweoʻulaokalani White was a Hawaiian lawyer, sheriff, politician, and newspaper editor. He became a political statesman and orator during the final years of the Kingdom of Hawaii and the beginnings of the Territory of Hawaii. Despite being a leading Native Hawaiian politician in this era, his legacy has been largely forgotten or portrayed in a negative light, mainly because of a reliance on English-language sources to write Hawaiian history. He was known by the nickname of "Pila Aila" or "Bila Aila" for his oratory skills.

George Panila Kamauoha

George Panila Kamauoha was a Native Hawaiian politician of Hawaii. He served in the legislature of the Kingdom of Hawaii and the Republic of Hawaii and later in the Senate of the Territory of Hawaii.

David William Pua

David William Pua, also known as D. W. Pua, was a Native Hawaiian politician during the Kingdom of Hawaii. He served as a legislator during the last years of the Legislature of the Kingdom of Hawaii and became a member of the Hui Aloha ʻĀina, founded after the overthrow of the monarchy to protest attempts of annexation to the United States.

William Henry Daniels American politician

William Henry Daniels was a judge, lawyer, and businessman of Wailuku, Maui during the Kingdom of Hawaii. He was declined reappointment to his office as district magistrate for refusing to take an oath to the Provisional Government of Hawaii and was arrested by the Republic of Hawaii for suspected involvement in the 1895 Counter-Revolution in Hawaii.

John William Kalua

John William Kalua, sometime referred to as Keahiowailuku, was a Native Hawaiian politician of Hawaii. He served in the legislature of the Kingdom of Hawaii and the Territory of Hawaii for the island of Maui.

Hui Aloha ʻĀina were two Hawaiian nationalist organizations established by Native Hawaiian political leaders and statesmen and their spouses in the aftermath of the overthrow of the Hawaiian Kingdom and Queen Liliʻuokalani on January 17, 1893. The organization was formed to promote Hawaiian patriotism and independence and oppose the overthrow and the annexation of Hawaii to the United States. Its members organized and collected the Kūʻē Petitions to oppose the annexation, which ultimately blocked a treaty of annexation in the United States Senate in 1897.

The Hui Kālaiʻāina was a political group founded in 1888 to oppose the 1887 Constitution of the Hawaiian Kingdom, often known as the Bayonet Constitution, and to promote Native Hawaiian leadership in the government. It and the two organizations of Hui Aloha ʻĀina were active in the opposition to the overthrow of the Hawaiian Kingdom and the annexation of Hawaii to the United States from 1893 to 1898.

Womens suffrage in Hawaii

Women's suffrage in Hawaii began in the 1890s. However, when the Kingdom of Hawaii ruled, women had roles in the government and could vote in the House of Nobles. After the overthrow of Queen Liliʻuokalani in 1893, women's roles were more restricted. Suffragists, Wilhelmine Kekelaokalaninui Widemann Dowsett and Emma Kaili Metcalf Beckley Nakuina, immediately began working towards women's suffrage. The Women's Christian Temperance Union (WCTU) of Hawaii also advocated for women's suffrage in 1894. As Hawaii was being admitted as a territory in 1899, racist ideas about the ability of Native Hawaiians to rule themselves caused problems with allowing women to vote. Members of the National American Woman Suffrage Association (NAWSA) petitioned the United States Congress to allow women's suffrage in Hawaii with no effect. Women's suffrage work picked up in 1912 when Carrie Chapman Catt visited Hawaii. Dowsett created the National Women's Equal Suffrage Association of Hawai'i that year and Catt promised to act as the delegate for NAWSA. In 1915 and 1916, Prince Jonah Kūhiō Kalanianaʻole brought resolutions to the U.S. Congress requesting women's suffrage for Hawaii. While there were high hopes for the effort, it was not successful. In 1919, suffragists around Hawaii met for mass demonstrations to lobby the territorial legislature to pass women's suffrage bills. These were some of the largest women's suffrage demonstrations in Hawaii, but the bills did not pass both houses. Women in Hawaii were eventually franchised through the passage of the Nineteenth Amendment.
