The 2023 Omnibus Law on Job Creation, officially the Act No. 6 of 2023 On the Enaction of Government Regulation in Lieu of Act No. 2 of 2022 On Job Creation into Act (Indonesian : Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang) is an Indonesian act which made the Government Regulation in Lieu of Act (Perpu) No. 2 of 2022 On Job Creation, a replacement of the Omnibus Law on Job Creation, permanent (the entirety of the Perpu is set as a schedule to the Act). The law is passed by the People's Representative Council on 21 March 2023. [1] The law commenced on 31 March 2023. [2]

History

After the Omnibus Law on Job Creation declared "conditionally unconstitutional", Joko Widodo administration issued Government Regulation in Lieu of Law No. 2/2022 as temporary replacement of the law on 30 November 2022. [1] by the Indonesian Constitution, any Government Regulation in Lieu of Law should be made into law if the law made into the permanent one. [3]

Controversial Articles

Flexibility on Outsourcing

Article 64 of the law granted flexibility to the companies to outsource their manpower, which labour unions disliked. [4]

No Long Leave Rights

Article 79 and 84 of the law revoking mandatory rights for the workers to take leave outside leave regulated by the law such as annual leave, weekly leave, and resting. Long leave is not a mandatory, but companies are granted to create their own regulations for long leave outside the law regulated. [4]

On Minimum Wages

Article 88C, 88D, and 88F granted central and provincial government to establish indexing to establish minimum wages applicable to provincial and regency/city level. Labour unions accused that these would ease formulation of formula to establish cheap wage. [4]

Reactions

Government side

Coordinating Minister for Economic Affairs, Airlangga Hartarto, expected the investment will come easily after the passage of the law. [5]

Japanese businessmen and industrialists welcomed the passage of the law positively as Japan External Trade Organization reported. [6]

Opposition

Prior the passing of the law, Indonesian labour unions, motorized by the Labour Party, threatened to start nationwide strike to bring total collapse on Indonesian economy if the law passed and vowed to commit "jihad" against the government and law. [7] Opposition parties Democratic Party and Prosperous Justice Party, rejected the law passage. [8] [9] [10] Despite now in coalition with the opposition, Nasdem Party however supported the passage of the law. [11]

Motorized by Labour Party, as the passage of the law become fruition, 5 millions of labors across more than 100 thousands companies will proceed to the start nationwide strike campaign from July to August 2023 period to halt production of every goods produced. [12] They also will hold sporadic protests every week to People's Representative Council and government institutions, while also filed judicial reviews to Constitutional Court. [13]

Constitutional Status

The Constitutional Court declared the law constitutional and rejected cases filed by workers associations motorized by the Labour Party on 2 October 2023. [14]

The Indonesia omnibus law protests were a series of demonstrations and civil disorder against Indonesia's Omnibus Law on Job Creation which was passed on 5 October 2020 as well as President Joko Widodo. Demonstrations had begun on 13 January 2020 while the then-bill, claimed by the government as vital to boosting the country's manufacturing industry and foreign investment, was still being drafted. Protesters were concerned with the law's impact on the protection of the environment and working conditions.

The Job Creation Act, officially Act Number 11/2020 on Job Creation, is a bill that was passed on 5 October 2020 by Indonesia's People's Representative Council (DPR), with the aim of creating jobs and raising foreign and domestic investment by reducing regulatory requirements for business permits and land acquisition processes. Due to its length of 1,035 pages and its coverage of many non-employment sectors, it is also referred to in Indonesia as an omnibus bill. The final draft was changed to 812 pages due to pagination being changed to legal format. After being passed into law, there were various substantial text alterations and deletions, as well as procedural issues, which made its legal status eligible for being formally annulled.

The Law on Sexual Violence Crimes is a law aimed to tackle sexual violence in Indonesia. The bill of the law was proposed on January 26, 2016. The law focuses on the prevention of sexual violence, more rights for victims and to acknowledge marital rape.

<span class="mw-page-title-main">National Research and Innovation Agency</span> Indonesian research superagency

The National Research and Innovation Agency is a cabinet-level government agency formed by the Indonesian government in 2019. Originally a new agency attached to the Ministry of Research and Technology, which became the Ministry of Research and Technology/National Research and Innovation Agency, the agency was controversially separated and established as a new non-ministerial government agency directly under the President of Indonesia on 28 April 2021. Central Sumatra was a province in Indonesia whose territories included present day West Sumatra, Riau, Jambi, and the Riau Islands. Since 1957 this province has not been registered as an Indonesian province after it was dissolved by Ordinance-as-Act No. 19/1957 and divided into the provinces of West Sumatra, Riau and Jambi through Law No. 61/1958 by the Sukarno government.

The Law on South Kalimantan province, officially Law Number 8 of 2022, is a law passed by the People's Representative Council of Indonesia regarding the existence of the province of South Kalimantan. The law is one of several laws passed with relatively minor changes to provide an updated legal basis for the existence of Indonesian provinces; previously, the legal standing for many Indonesian provinces was based on laws from the era of the United States of Indonesia. However, while other provinces' laws were passed uncontroversially without major change, South Kalimantan's province law was passed with a sudden change of the capital city from Banjarmasin to Banjarbaru. This change led to a court challenge from elements associated with Banjarmasin city, with consequent response from Banjarbaru city.

Said Iqbal is an Indonesian labour activist and politician. He is the first president of the Labour Party, founded in 2021, and has served as president of the Indonesian Trade Union Confederation since 2012.

The 2023 State Capital Act is an omnibus bill to amend the previous Law on State Capital, a piece of law to relocate capital of Indonesia from Jakarta to Nusantara at East Kalimantan as new capital of Indonesia. Introduced on 21 August 2023, the omnibus bill was passed into law on 3 October 2023. The law intended to amend and expand the power given to the Nusantara Capital City Authority (OIKN).

The Special Region of Jakarta Act is a law that declared that Jakarta is no longer capital of Indonesia. With the law enaction, Nusantara is officially Indonesia new capital since 25 April 2024 de jure and Jakarta status as "Special Capital Region" revoked. The law turned Jakarta into "Special Region" for economic and trading.
