Agriculture Retention and Development Act

The Agriculture Retention and Development Act was created as part of New Jersey's efforts to counteract the loss of farmland in the state. The legislation formed the basis needed for the state to purchase the easements of New Jersey farms in order to ensure they remain as farms, and could never be sold for housing or for non-farming commercial development. [1] [2] The effect was to slow farmland loss in the state. The farmland preservation efforts made in New Jersey have effectively kept the farms as private land with a public legacy of permanent farm status. [2] As of July 2022, New Jersey has permanently preserved 2,800 farms covering 247,517 acres.

History

In his message to the Legislature in January, 1971, Governor William T. Cahill announced his firm belief in the need for a Blueprint Commission on the Future of New Jersey Agriculture. This followed the desires of the agricultural community as expressed in resolutions of the State Agricultural Convention, which in turn had been generated earlier by the concern of leading farm organizations. Later in the year, Governor Cahill directed Secretary of Agriculture Phillip Alampi to create the Commission, assume its leadership, and to appoint the members of the Commission. The initial meeting of the Commission was held in mid-September, at which time the outline of work prepared at staff level was approved by the Commission. The first phase of the work was started immediately by establishing eight task forces. These groups covered business climate, research and education, production, marketing, management and commercial services, land and water resources, agribusiness, and organizations. The second phase of the program was implemented shortly after the task forces began their work. This effort centered on the real issue of establishing a permanent land base for a continuing agriculture in the Garden State.

Published in April 1973, the Report off the Blueprint Commission states:

"Agriculture in New Jersey operates in the most densely populated area in the nation, hence has both problems and opportunities. Farmland declined rapidly from 1954 to 1968, and has substantially slowed down since then, due, in part, to the Farmland Assessment Act. There are presently about 1.1 million acres in farms in the state, which is over 600,000 acres less than in 1950. Due largely to forces external to itself, agriculture in New Jersey is operating under the influence of an impermanence syndrome which leads to short-term decision making, less investment in agricultural enterprises, and slower technological adaptation. This can be corrected by creating a permanent land preserve for agricultural production and by making it feasible for farmers to farm this land and make a profit. This report addresses itself to both of these objectives."

In November 1981, voters approved the concept of the Farmland Preservation Program and passed the $50 million Farmland Preservation Bond Act to fund it.

On January 23, 1983, Governor Tom Kean signed the Agriculture Retention and Development Act into legislation. The Act enabled the establishment of County Agriculture Development Boards (CADB's) and specified their membership and function, provided for the establishment of voluntary farmland preservation programs, and authorized the purchase of development easements and the funding of soil and water projects on agricultural land.

In the United States, a conservation easement is a power invested in a qualified land conservation organization called a "land trust", or a governmental entity to constrain, as to a specified land area, the exercise of rights otherwise held by a landowner so as to achieve certain conservation purposes. Before the implementation of these policies, the distribution of land in what was then known as Rhodesia saw a population of 4,400 white Rhodesians owning 51% of the country's land while 4.3 million black Rhodesians owned 42%, with the remainder being non-agricultural land. The discrepancy of this distribution, as well as the overall dominance of the white population in the newly-independent but largely unrecognized Rhodesian state was challenged by the black nationalist organizations ZANU and ZAPU in the Rhodesian Bush War. At the establishment of the modern Zimbabwean state in 1980 after the bush war, the Lancaster House Agreement held a clause that prohibited forced transfer of land, this resulted in changes in land distribution from the willing sale or transfer by owners being minor until 2000, when the government of Robert Mugabe began a more aggressive policy.

British Columbia's Agricultural Land Reserve (ALR) is a collection of land where agriculture is designated as the priority use. Farming is encouraged and non-agricultural uses are restricted.

Farmland development rights in Suffolk County, New York began in 1975 in Suffolk County as the state of New York began a program to purchase development rights for farmland to insure they remained as farms and open space rather than being developed for housing.

American Farmland Trust (AFT) is a non-profit organization in the United States with a mission to protect farmland, promote environmentally sound farming practices, and keep farmers on the land. AFT is staffed by farmers, policy experts, researchers, and scientists, and governed by a board of directors. Its headquarters are in Washington, D.C., and it has regional offices throughout the country. AFT also runs the Farmland Information Center, an online collection of information on farmland and ranchland protection and stewardship established as a public-private partnership with the USDA Natural Resources Conservation Service.

Farmland preservation is a joint effort by non-governmental organizations and local governments to set aside and protect examples of a region's farmland for the use, education, and enjoyment of future generations. They are operated mostly at state and local levels by government agencies or private entities such as land trusts and are designed to limit conversion of agricultural land to other uses that otherwise might have been more financially attractive to the land owner. Through different government programs and policy enactments farmers are able to preserve their land for growing crops and raising livestock. Every state provides tax relief through differential (preferential) assessment. Easements are a popular approach and allow the farms to remain operational. Less common approaches include establishing agricultural districts, using zoning to protect agricultural land, purchasing development rights, and transferable development rights. It is often a part of regional planning and national historic preservation. Farmland preservation efforts have been taking place across the United States, such as in Virginia, Minnesota, Maryland, Florida, and Connecticut.

The agricultural policy of the United States is composed primarily of the periodically renewed federal U.S. farm bills. The Farm Bills have a rich history which initially sought to provide income and price support to US farmers and prevent them from adverse global as well as local supply and demand shocks. This implied an elaborate subsidy program which supports domestic production by either direct payments or through price support measures. The former incentivizes farmers to grow certain crops which are eligible for such payments through environmentally conscientious practices of farming. The latter protects farmers from vagaries of price fluctuations by ensuring a minimum price and fulfilling their shortfalls in revenue upon a fall in price. Lately, there are other measures through which the government encourages crop insurance and pays part of the premium for such insurance against various unanticipated outcomes in agriculture.

Development-supported agriculture is a nascent movement in real estate development that preserves and invests in agricultural land use. As farmland is lost due to the challenging economics of farming and the pressures of the real estate industry, DSA attempts to reconcile the need for development with the need to preserve agricultural land. The overall goal of DSA is to incubate small-scale organic farms that co-exist with residential land development, providing benefits to farmers, residents, the local community, and the environment.

The Farmland Assessment Act of 1964 provided for reduced taxes on farmland in New Jersey in an effort to reduce the sale of farmland to developers for housing and commercial space.

Agricultural zoning is a United States land management tool that refers to local zoning designations made by United States local jurisdictions that are intended to protect farmland and farming activities from incompatible land uses. Agricultural zoning can specify many factors, such as the uses allowed, minimum lot size, the number of nonfarm dwellings allowed, or the size of a buffer separating farm and nonfarm properties. Some jurisdictions further subdivide agricultural zones to distinguish industrial farming from uses like rural residence farms and retirement farms on large lots.

The Agricultural Reserve is a designated land use zone in Montgomery County, Maryland. The 93,000 acres (380 km2) zone was created in 1980 by the Montgomery County Council to preserve farm land and rural space in the northwestern part of the county. The farmland protection program has been characterized as "the most famous, most studied and most emulated" program of its kind in the United States.

Preservation development is a model of real-estate development that addresses farmland preservation. It shares many attributes with conservation development, with the addition of strategies for maintaining and operating productive agriculture and silviculture, often in perpetuity. A preservation development is a planned community that allows limited, carefully designed development on a working farm, while placing the majority of productive land under a system of easements and community governance to ensure a continuity of farming and environmental stewardship.

Agrarian reform and land reform have been a recurring theme of enormous consequence in world history. They are often highly political and have been achieved in many countries.
