The Badman Review, also known as the Review into Elective Home Education in England , was conducted by Graham Badman, the former Director of Children's Services at Kent County Council. [1]
The review was commissioned on 19 January 2009 by Ed Balls [2] the Secretary of State for Children, Schools and Families with a remit to investigate current practice of local authorities in relation to home educators, and also to investigate whether home education could be used as a cover for some forms of child abuse, such as forced marriage and domestic servitude. [3]
Published on 11 June 2009 the review's recommendations that related to safeguarding were accepted in full by Ed Balls on the day of publication. [4] The review found no evidence to support suggestions that home education was linked to forced marriage, servitude or child trafficking. [5] A public consultation on the recommendations of the review ended in October 2009. [6]
The review caused widespread anger [7] amongst home educators who rejected Badman's review as rushed, badly researched, disproportionate and offering little in the way of evidence to justify his recommendations. [8]
The Conservative MP Mark Field has spoken against any changes to the current laws covering education in England. He presented a debate [9] on 9 June 2009 in which he argued for the status quo to remain.
On 22 July 2009, the Children, Schools and Families Committee (the Parliamentary Select Committee with oversight of the work of the Department for Children, Schools and Families) announced its own inquiry [10] into the handling of the Badman Review. Its report was published on 16 December 2009. [11]
On the evening of 8 December 2009, history was made in the House of Commons when the highest number of petitions ever presented simultaneously on a single topic was placed in the petitions bag behind the Speaker's chair. [14] Conservative MP Graham Stuart presented the petition rejecting the recommendations of the Badman Review from home educators across England and Wales declaring:
This is a historic night. More than 70 Honourable and Right Honourable members will present petitions from more than 120 different constituencies opposing the compulsory registration and monitoring of home educated children.
Following their acceptance of the Badman Review the government proposed, in the Queen's Speech on 18 November 2009, the introduction of a Children, Schools and Families Bill [15] which would amend the Education Act 1996 so as to require home educated children to be registered with the local authority. [16] The proposed changes were dropped due to a lack of cross party support prior to the pending election in May 2010 [17]
Home education in the United Kingdom of Great Britain and Northern Ireland is often termed "elective home education" ("EHE") to signify the independent nature of practice from state provisions such as education for children with ill-health provided by the local authority in the family home. EHE is a collective term used in the UK to describe education provided other than through the schooling system. Parents have a duty to ensure their children are educated but the education legislation in England and Wales does not differentiate between school attendance or education otherwise than at school. Scots education legislation on the other hand differentiates between public (state) school provision and education "by other means", which includes both private schooling and home education. The numbers of families retaining direct responsibility for the education of their children has steadily increased since the late 1970s. This increase has coincided with the formation of support groups such as Education Otherwise. Home education may involve an informal style of education described as unschooling, informal learning, natural or autonomous learning. Others prefer to retain a structured school at home approach sometimes referred to as homeschooling although the terms are often interchanged.
The Children and Family Court Advisory and Support Service (Cafcass) is a non-departmental public body in England set up to promote the welfare of children and families involved in family court. It was formed in April 2001 under the provisions of the Criminal Justice and Court Services Act 2000 and is accountable to Parliament through the Ministry of Justice. Cafcass is independent of the courts, social services, education, health authorities and all similar agencies.
The General Teaching Council for Scotland (GTCS) is a fee based registered charity and the world's first independent self-regulating body for teaching. The current Chief Executive and Registrar is Dr Pauline Stephen. The GTCS maintains a register of qualified teachers; there were 73,306 teachers on the register on 1 May 2016.
The Cambridge Primary Review (CPR), following a lengthy period of consultation and planning, was launched in October 2006 as a fully independent enquiry into the condition and future of primary education in England. The Review, directed by Professor Robin Alexander, has been supported since its inception by grants from the Esmée Fairbairn Foundation. The scope of the Review and the depth of its evidence have made it the most comprehensive enquiry into English primary education since the Plowden Report of 1967. Between October 2007 and February 2009 the Review published 31 interim reports, including 28 surveys of published research, 39 briefings, 14 media releases and several newspaper articles. The Review's 608-page final report Children, their World, their Education: final report and recommendations of the Cambridge Primary Review was published on 16 October 2009, together with an 850-page companion volume, The Cambridge Primary Review Research Surveys. Both books are published by Routledge.
Safeguarding is a term used in the United Kingdom and Ireland to denote measures to protect the health, well-being and human rights of individuals, which allow people — especially children, young people and vulnerable adults — to live free from abuse, harm and neglect.
Department for Children, Schools and Families (DCSF) was a department of the UK government, between 2007 and 2010, responsible for issues affecting people in England up to the age of 19, including child protection and education. DCSF was replaced by the Department for Education after the change of government following the 2010 General Election.
The Office of theChildren's Commissioner for England is a non-departmental public body in England responsible for promoting and protecting the rights of children as set out in the United Nations Convention on the Rights of the Child, as well as other human rights legislation, such as the Human Rights Act 1998. The Children's Commissioner was established under the Children Act 2004 to "represent the views and interests of children", and the office was further strengthened by the Children and Families Act 2014 providing a legal mandate to promote and protect the rights of children. According to the Commissioner's website, the role's purpose is to facilitate long-term improvements for all children, and in particular for the most vulnerable, and involves “being the eyes and ears of children within the system and the country as a whole", as well as acting with political independence from government, children's agencies and the voluntary and private sectors. The Children's Commissioner also has a duty to speak on behalf of all children in the United Kingdom on non-devolved issues, which include immigration, and youth justice in Wales.
The Early Years Foundation Stage (EYFS) is the statutory framework for Early Years education in England. The term was defined in Section 39 of the British government's Childcare Act 2006. The equivalents in Wales and Scotland are the Foundation Phase and the Early Years Framework.
The Independent Safeguarding Authority (ISA) was a non-departmental public body for England, Northern Ireland and Wales, that existed until 1 December 2012, when it merged with the Criminal Records Bureau (CRB) to form the Disclosure and Barring Service (DBS).
Same-sex marriage in Scotland has been legal since 16 December 2014. As family law is not reserved to the Parliament of the United Kingdom, the Scottish Parliament has legislative competence to make changes to the law on marriage. A same-sex marriage law was approved by the Scottish Parliament in February 2014 and received royal assent on 12 March 2014. It came into effect on 16 December with many civil partners converting their relationships into marriages, while the first same-sex marriage ceremonies occurred on 31 December 2014. Civil partnerships for same-sex couples have been legal in Scotland since 2005.
The Right of Children to Free and Compulsory Education Act or Right to Education Act (RTE) is an Act of the Parliament of India enacted on 4 August 2009, which describes the modalities of the importance of free and compulsory education for children between the age of 6 to 14 years in India under Article 21A of the Indian Constitution. India became one of 135 countries to make education a fundamental right of every child when the act came into force on 1 April 2010. The title of the RTE Act incorporates the words ‘free and compulsory’. ‘Free education’ means that no child, other than a child who has been admitted by his or her parents to a school which is not supported by the appropriate Government, shall be liable to pay any kind of fee or charges or expenses which may prevent him or her from pursuing and completing elementary education. ‘Compulsory education’ casts an obligation on the appropriate Government and local authorities to provide and ensure admission, attendance and completion of elementary education by all children in the 6-18 age group. With this, India has moved forward to a rights based framework that casts a legal obligation on the Central and State Governments to implement this fundamental child right as enshrined in the Article 21A of the Constitution, in accordance with the provisions of the RTE Act.17.
Peter Connelly was a 17-month-old British boy who died in London in 2007 after suffering more than fifty injuries over an eight-month period, during which he was repeatedly seen by the London Borough of Haringey Children's services and National Health Service (NHS) health professionals. Baby P's real first name was revealed as "Peter" on the conclusion of a subsequent trial of Peter's mother's boyfriend on a charge of raping a two-year-old. His full identity was revealed when his killers were named after the expiry of a court anonymity order on 10 August 2009.

The UK Council for Child Internet Safety (UKCCIS) was set up in 2008 under the Brown Government charged with bringing together government departments, law enforcement agencies, academia, private industry and third-sector representatives such as charities and voluntary groups to collaborate on strategies to ensure child internet safety. It is a group made up of more than 200 constituent organisations with a board chaired by ministers. It collates internet safety research, conducts its own consultations, gives advice to industry providers and publishes a code of practice. The remit of the Council began with the Byron Review and the group has subsequently drawn on diverse sources including the Bailey Review and the work of Professor Sonia Livingstone.

The Lamb Inquiry (2009) was established as part of the UK government’s response to the House of Commons Education and Skills Committee Report Special Educational Needs: Assessment and Funding. The enquiry was led by Brian Lamb, the chair of the Special Educational Consortium (SEC), who was tasked by the Department of Children’s, Schools, and Families (DCSF) to explore a range of ways in which parental confidence in the Special Educational Needs (SEN) assessment process might be enhanced.
The Marriage and Civil Partnership (Scotland) Act 2014 is an Act of the Scottish Parliament which allows same-sex couples to marry in Scotland since 16 December 2014.
