Campbell v. Clinton, 203 F.3d 19 (D.C. Cir. 2000), [1] was a case holding that members of Congress could not sue President Bill Clinton for alleged violations of the War Powers Resolution in his handling of the war in Yugoslavia.
The War Powers Resolution requires the President to submit a report within 48 hours "in any case in which United States Armed Forces are introduced … into hostilities or into situations where imminent involvement in hostilities is clearly indicated by the circumstances," and to "terminate any use of United States Armed Forces with respect to which a report was submitted (or required to be submitted), unless the Congress … has declared war or has enacted a specific authorization for such use of United States Armed Forces" within 60 days.
On March 26, 1999, two days after President Clinton announced the commencement of NATO air and cruise missile attacks on Yugoslav targets, he submitted to Congress a report, "consistent with the War Powers Resolution," detailing the circumstances necessitating the use of armed forces, the deployment's scope and expected duration, and asserting that he had "taken these actions pursuant to [his] authority … as Commander in Chief and Chief Executive." On April 28, Congress voted on four resolutions related to the Yugoslav conflict: It voted down a declaration of war 427 to 2 and an "authorization" of the air strikes 213 to 213, but it also voted against requiring the President to immediately end U.S. participation in the NATO operation and voted to fund that involvement.
The conflict between NATO and Yugoslavia continued for 79 days, ending on June 11 with Yugoslavia's agreement to withdraw its forces from Kosovo and allow deployment of a NATO-led peacekeeping force. Throughout this period Pentagon, State Department, and NATO spokesmen informed the public on a frequent basis of developments in the fighting.
The lawsuit was filed before the end of hostilities by 31 members of Congress opposed to U.S. involvement in the Kosovo intervention, led by Tom Campbell of California.
The Congressmen sought a declaratory judgment that the President's use of American forces against Yugoslavia was unlawful under both the War Powers Clause of the Constitution and the War Powers Resolution ("the WPR"). Appellants claim that the President did submit a report sufficient to trigger the WPR on March 26, or in any event was required to submit a report by that date, but nonetheless failed to end U.S. involvement in the hostilities after 60 days.
The district court granted the President's motion to dismiss for lack of standing. [2]
The appellate court affirmed. It held appellants had ample legislative authority it could exercise to stop appellee's war making, and thus, appellants lacked the power to challenge such executive action in court. [1]

The Kosovo Liberation Army was an ethnic Albanian separatist militia that sought the separation of Kosovo, the vast majority of which is inhabited by Albanians, from the Federal Republic of Yugoslavia (FRY) and Serbia during the 1990s. Albanian nationalism was a central tenet of the KLA and many in its ranks supported the creation of a Greater Albania, which would encompass all Albanians in the Balkans, stressing Albanian culture, ethnicity and nation.
The Rambouillet Agreement, formally the Interim Agreement for Peace and Self-Government in Kosovo, was a proposed peace agreement between the Federal Republic of Yugoslavia and a delegation representing the ethnic Albanian majority population of Kosovo. It was drafted by the North Atlantic Treaty Organization (NATO) and named for the Château de Rambouillet, where it was initially proposed in early 1999. Among other things, the accords called for 30,000 NATO peacekeeping troops in Kosovo; an unhindered right of passage for NATO troops on Yugoslav territory; and immunity for NATO and its agents to Yugoslav law. Yugoslavia's refusal to sign the accords was used by NATO to justify the 1999 bombing of Yugoslavia.
The Iraq disarmament crisis was claimed as one of primary issues that led to the multinational invasion of Iraq on 20 March 2003. Since the 1980s, Iraq was widely assumed to have been producing and extensively running the programs of biological, chemical and nuclear weapons. Iraq made extensive use of chemical weapons during the Iran–Iraq War in the 1980s, including against its own Kurdish population. NATO members are also subject to the North Atlantic Treaty.
The War Powers Resolution is a federal law intended to check the U.S. president's power to commit the United States to an armed conflict without the consent of the U.S. Congress. The resolution was adopted in the form of a United States congressional joint resolution. It provides that the president can send the U.S. Armed Forces into action abroad only by declaration of war by Congress, "statutory authorization", or in case of "a national emergency created by attack upon the United States, its territories or possessions, or its armed forces".
The Authorization for Use of Military Force Against Iraq Resolution of 2002, informally known as the Iraq Resolution, is a joint resolution passed by the United States Congress in October 2002 as Public Law No. 107-243, authorizing the use of the United States Armed Forces against Saddam Hussein's Iraq government in what would be known as Operation Iraqi Freedom.

NSA warrantless surveillance — also commonly referred to as "warrantless-wiretapping" or "-wiretaps" — refers to the surveillance of persons within the United States, including U.S. citizens, during the collection of notionally foreign intelligence by the National Security Agency (NSA) as part of the Terrorist Surveillance Program. United Nations Security Council resolution 1244, adopted on 10 June 1999, after recalling resolutions 1160 (1998), 1199 (1998), 1203 (1998) and 1239 (1999), authorised an international civil and military presence in the Federal Republic of Yugoslavia and established the United Nations Interim Administration Mission in Kosovo (UNMIK). It followed an agreement by Yugoslav President Slobodan Milošević to terms proposed by President of Finland Martti Ahtisaari and former Prime Minister of Russia Viktor Chernomyrdin on 8 June, involving withdrawal of all Yugoslav state forces from Kosovo.
The Authorization for Use of Military Force (AUMF) is a joint resolution of the United States Congress which became law on September 18, 2001, authorizing the use of the United States Armed Forces against those responsible for the September 11 attacks. The authorization granted the President the authority to use all "necessary and appropriate force" against those whom he determined "planned, authorized, committed or aided" the September 11 attacks, or who harbored said persons or groups. The AUMF was passed by the 107th Congress on September 18, 2001, and signed into law by President George W. Bush on September 18, 2001. Since its.passage in 2001, U.S. Presidents have interpreted their authority under the AUMF to extend beyond al Qaeda and the Taliban in Afghanistan to apply to numerous other groups as well as other geographic locales, due to the act's omission of any specific area of operations. In December 2016, the Office of the President published a brief interpreting the AUMF as providing Congressional authorization for the use of force against al-Qaeda and other militant groups. Today, the full list of actors the U.S. military is fighting or believes itself authorized to fight under the 2001 AUMF is classified.
The political status of Kosovo, also known as the Kosovo question, is the subject of a long-running political and territorial dispute between the Serbian government and the Government of Kosovo, stemming from the breakup of Yugoslavia (1991–92) and the ensuing Kosovo War (1998–99). In 1999, the administration of the Autonomous Province of Kosovo and Metohija was handed on an interim basis to the United Nations under the terms of UNSCR 1244 which ended the Kosovo conflict of that year. That resolution reaffirmed the territorial integrity of Serbia over Kosovo but required the UN administration to promote the establishment of 'substantial autonomy and self-government' for Kosovo pending a 'final settlement' for negotiation between the parties.
The Military Technical Agreement, also known as the Kumanovo Agreement, signed between the International Security Force (KFOR) and the Governments of the Federal Republic of Yugoslavia and the Republic of Serbia, was an accord concluded on 9 June 1999 in Kumanovo, Macedonia. It resulted in the end of the Kosovo War, and established new basic relations between Yugoslavia and the Kosovo Force, which would act to replace units of the Yugoslav Army in Kosovo.
United Nations Security Council resolution 1199, adopted on 23 September 1998, after recalling Resolution 1160 (1998), the Council demanded that the Albanian and Yugoslav parties in Kosovo end hostilities and observe a ceasefire.
The domestic reactions in the United States after the 2011 military intervention in Libya ranged from criticism to support. Unlike the revolutions in Tunisia and Egypt, which were carried out largely without external intervention, the brutal reaction of the Gaddafi regime to the protests that began in January and February 2011 quickly made it clear that the Libyan opposition forces would not be able to achieve political progress or to overthrow their government by themselves. In light of ongoing serious human rights violations, the United Nations Security Council established a no-fly zone over Libya and authorized the member states of the UN to take all necessary measures to protect civilians and civilian populated areas under threat of attack. Two days later, a coalition of states—including the United States, the United Kingdom, and France—began to carry out air strikes against military targets in Libya. By the end of March 2011, NATO had taken over the international military operation in Libya. With the support of NATO, the insurgents successively took power in Libya, gaining control over the capital, Tripoli, in August and over Sirte, the last city held by the Gaddafi regime, in October 2011. During the fights over Sirte, Gaddafi was killed. With the insurgents taking control over most of the country and being recognized as the legitimate (transitional) government of Libya by much of the international community, a change in the Libyan regime has taken place.

The bill passed the U.S. House on December 14, 2011, the U.S. Senate on December 15, 2011, and was signed into United States law on December 31, 2011, by President Barack Obama.
The No More Presidential Wars Act was co-sponsored in the House of Representatives on September 13, 2018, by Tulsi Gabbard (D-HI) and the late congressman Walter Jones (R-NC) as an effort to “reclaim the responsibility Congress has [and] to be the body that declares war, to end these presidential wars that are being fought without the authorization of Congress.”
