Cardwell v. American Bridge Co. , 113 U.S. 205 (1885), was a bill in equity, for the removal of a bridge erected by the defendant over the American River in northern California, downriver from the property of the plaintiff on that navigable section of the river. [1]

The doctrine that, in the absence of legislation by Congress, a state may authorize a navigable stream within its limits to be obstructed by a bridge or highway reasserted, and the former cases to that effect referred to. The provision in the act admitting California

That all the navigable waters within the said state shall be common highways and forever free, as well to the inhabitants of said state as to the citizens of the United States, without any tax, impost, or duty therefor

does not deprive the state of the power possessed by other states, in the absence of legislation by Congress, to authorize the erection of bridges over navigable waters within the state. That provision aims to prevent the use of the navigable streams by private parties to the exclusion of the public and the exaction of tolls for their navigation.

The American River is a tributary of the Sacramento River in California. It is entirely within the state, and navigable for small steamboats and barges from its mouth on the Sacramento River to the town of Folsom, a distance of 30 miles (48 km). From its confluence with the Sacramento River, vessels starting upon it can proceed to San Francisco Bay and the Pacific Ocean, and thence to adjoining states and foreign countries. It is therefore a navigable water of the United States and, as such, is under the control of the general government in the exercise of its power to regulate foreign and interstate commerce so far as may be necessary to insure its free navigation.

The defendant was a corporation organized under the laws of California, and pursuant to the authority conferred by an act of its legislature, has constructed a bridge over the American River, of 20 feet (6.1 m) wide and 300 feet (91 m) long, and was used as a roadway across the river. Its floor is about 14 feet (4.3 m) above lowest water and about 5 feet (1.5 m) above highest water, was without a draw or opening for the passage of vessels. Steamboats and other craft were therefore obstructed by it in the navigation of the river.

The complainant alleged that he was the owner of a large tract of land, bordering on the river below Folsom, and raises many tons of grain each year; that he was also the owner of a steamboat and other vessels by which he could ship his grain down the river but for the obstruction caused by the bridge; that there are also large quarries of granite on his land sufficient to supply the markets of Sacramento and San Francisco for years, and also large deposits of cobblestone which have a value for paving, and, but for the obstruction, he could ship the granite and cobblestone by his vessels and sell them at a profit, whereas the expense of sending them by rail or other means open to him are such as to deprive him of all profit on them. He therefore files his bill against the company and prays that it may be enjoined from maintaining the bridge across the river until a draw shall have been placed in it sufficient to allow steamboats, vessels, and watercraft capable of navigating the stream to pass and repass freely and safely.

A demurrer to the bill was sustained and the bill dismissed, and the case is brought here on appeal.

The decree was affirmed.

The Wheeling Suspension Bridge is a suspension bridge spanning the main channel of the Ohio River at Wheeling, West Virginia. It was the largest suspension bridge in the world from 1849 until 1851. Charles Ellet Jr. designed it and supervised construction of what became the first bridge to span a major river west of the Appalachian mountains. It linked the eastern and western section of the National Road, and became especially strategically important during the American Civil War. Litigation in the United States Supreme Court concerning its obstruction of the new high steamboat smokestacks eventually cleared the way for other bridges, especially needed by expanding railroads. Because this bridge was designed during the horse-and-buggy era, 2-ton weight limits and vehicle separation requirements applied in later years until it was closed to automobile traffic in September 2019.

A body of water, such as a river, canal or lake, is navigable if it is deep, wide and calm enough for a water vessel to pass safely. Such a navigable water is called a waterway, and is preferably with few obstructions against direct traverse that needed avoiding, such as rocks, reefs or trees. Bridges built over waterways must have sufficient clearance. High flow speed may make a channel unnavigable due to risk of ship collisions. Waters may be unnavigable because of ice, particularly in winter or high-latitude regions. Navigability also depends on context: a small river may be navigable by smaller craft such as a motorboat or a kayak, but unnavigable by a larger freighter or cruise ship. Shallow rivers may be made navigable by the installation of locks that regulate flow and increase upstream water level, or by dredging that deepens parts of the stream bed.

Many steamboats operated on the Columbia River and its tributaries, in the Pacific Northwest region of North America, from about 1850 to 1981. Major tributaries of the Columbia that formed steamboat routes included the Willamette and Snake rivers. Rivers and Harbors Act may refer to one of many pieces of legislation and appropriations passed by the United States Congress since the first such legislation in 1824. At that time Congress appropriated $75,000 to improve navigation on the Ohio and Mississippi rivers by removing sandbars, snags, and other obstacles. Like when first passed, the legislation was to be administered by the United States Army Corps of Engineers (USACE), under its Chief Engineer and the Secretary of War.

<i>Washington</i> (steamboat 1851)

Washington was an early steamboat operated in the states of California and Oregon. Washington was built in California and was initially operated on the Sacramento River. In 1851, the steamer was purchased and brought on a ship to the Oregon Territory, where it was operated on the Willamette River until the summer of 1853. Washington was sold again, and then transferred to the Oregon coast, where it operated on the Umpqua River, on the Coquille River and on Coos Bay. Washington was able to operate for shorter distances over the open ocean along the Oregon coast. The steamer was wrecked by a boiler explosion in December 1857, near Scottsburg, O.T., on the Umpqua river.

The California Steam Navigation Company was formed in 1854 to consolidate competing steamship companies in the San Francisco Bay Area and on the Sacramento and San Joaquin Rivers. It was successful in this effort and established a profitable near-monopoly which it maintained by buying out or bankrupting new competitors. In response to the Fraser Canyon gold rush and economic growth in the Pacific Northwest, the company expanded to ocean routes from San Francisco north to British Columbia. Similarly, as California's economy grew, the company offered service from San Francisco south to San Pedro and San Diego. It exited these markets in 1867 when competition drove prices to unprofitable levels. While the California Steam Navigation Company was successful throughout its life in suppressing steamboat competition on its core Bay Area and river routes, it could not control the rise of railroads. These new competitors reduced the company's revenue and profit. Finally, in 1871, the company's assets were purchased by the California Pacific Railroad, and the corporation was dissolved.

Steamboats operated in California on San Francisco Bay and the Sacramento–San Joaquin River Delta, and Sacramento River as early as November 1847, when the Sitka built by William A. Leidesdorff briefly ran on San Francisco Bay and up the Sacramento River to New Helvetia. After the first discovery of gold in California the first shipping on the bays and up the rivers were by ocean going craft that were able to sail close to the wind and of a shallow enough draft to be able to sail up the river channels and sloughs, although they were often abandoned by their crews upon reaching their destination. Regular service up the rivers, was provided primarily by schooners and launches to Sacramento and Stockton, that would take a week or more to make the trip.

<i>Minnehaha</i> (sternwheeler) Sternwheeler steamboat

Minnehaha was a sternwheel-driven steamboat which was built in 1866 on Oswego Lake, then known as Sucker Lake, in Oregon, United States. Minnehaha was later transferred to the Willamette and Columbia rivers where it operated for the first part of the 1870s.
