Citizens to Preserve Overton Park v. Volpe, 401 U.S. 402 (1971), is a landmark decision by the Supreme Court of the United States that established the basic legal framework for judicial review of the actions of administrative agencies. It substantially narrowed the Administrative Procedure Act's Section 701(a)(2) exception from judicial review. It also stands as a notable example of the power of litigation by grassroots citizen movements to block government action. [1] [2]

Background

The case concerned the decision by the Secretary of Transportation John A. Volpe to approve the construction of Interstate 40 through Overton Park in Memphis, Tennessee pursuant to his powers under the Department of Transportation Act of 1966 and the Federal-Aid Highway Act of 1968. [1] These acts prohibited the Secretary from financing interstate construction through public parks if a "feasible and prudent" alternative route existed. Further, if no alternative route was found by the secretary, the secretary could only allow the construction through the park if "all possible planning to minimize harm" had been conducted. [1]

During the Interstate Highway System building boom of the late 1950s and early 1960s, public parks were viewed as desirable construction sites because approval did not require invocation of eminent domain. That changed after passage of the Department of Transportation Act of 1966, which required the government to demonstrate that there were no "feasible and prudent" alternatives to building through public lands. [3]

Procedural history

After Secretary Volpe approved the Tennessee Department of Highways proposal to construct the highway through Overton Park, a group called Citizens to Preserve Overton Park brought suit against him in the Western District of Tennessee for violation of § 4(f) of the Department of Transportation Act. The Secretary responded by filing a motion for summary judgment, which was granted by the District Court. On appeal, the 6th Circuit affirmed the grant of summary judgment. At the Supreme Court, the case was "decided on an expedited timetable". [4]

Decision

On March 3, 1971, the U.S. Supreme Court reversed the Circuit Court and held that summary judgment was improperly granted. While the Secretary was not required to make formal findings, the Secretary's sole reliance on litigation affidavits was insufficient in light of the "feasible and prudent" clause of § 4(f). The Court held that the Secretary's decision did not fall into the Administrative Procedure Act (APA)'s Section 701(a)(2) exception from judicial review for action "committed to agency discretion." [5] The Court stated that the exception was "very narrow" and that it was applicable when statutes were "drawn in such broad terms that in a given case there is no law to apply." [6] This marked the Court's first general explanation of Section 701(a)(2). [4] Because the agency's decision was classified as informal adjudication, the Court found that it would be reviewed under the "arbitrary or capricious" standard of review under Section 706. [7]

Justice Thurgood Marshall, writing for the Court, held § 4(f) "is a plain and explicit bar to the use of federal funds for construction of highways through parks; only the most unusual situations are exempted." The Court rejected the Secretary's proposed understanding of "prudent" as a grant of discretion to weigh costs and benefits to determine whether alternatives exist. [6] Because the costs of building through parks were demonstrably low, as construction before 1966 had shown, the Court held that the 1966 enactment of the "feasible and prudent" clause "indicates that protection of parkland was to be given paramount importance." [8] The Court remanded the case to the District Court for further proceedings. [9] Justice Black, joined by Justice Brennan, concurred in vacating the summary judgment. However, they would have remanded the case to the Secretary of Transportation rather than the District Court. [10]

Impact

Overton Park is one of "the most important cases in the administrative law repertoire". [11] It marked a shift in how lawyers attacked federal regulation, [11] and is considered a landmark case. [2] Besides being the first interpretation of Section 701(a)(2) of the APA, it provided scholars with a "great deal" of information on Section 706 of the APA. [7] Its conclusion that courts must examine the entire record of an agency's decision established the "hard look" doctrine further expanded upon by State Farm Mutual Automobile Insurance Co. v. Campbell (1983). [7]

The "no law to apply doctrine" that originated from Overton Park "engenders confusion among courts and commentators" due to its ambiguity. [4] It is a standard that is rarely met because Congress typically attempts to give statutory guidance to agencies. [12]

John Anthony Volpe was an American businessman, diplomat, and politician from Massachusetts. A son of Italian immigrants, he founded and owned a large construction firm. Politically, he was a Republican in increasingly Democratic Massachusetts, serving as its 61st and 63rd Governor from 1961 to 1963 and 1965 to 1969, as the United States Secretary of Transportation from 1969 to 1973, and as the United States Ambassador to Italy from 1973 to 1977. As Secretary of Transportation, Volpe was an important figure in the development of the Interstate Highway System at the federal level.

Tennessee Valley Authority v. Hiram Hill et al., or TVA v. Hill, 437 U.S. 153 (1978), was a United States Supreme Court case and the Court's first interpretation of the Endangered Species Act of 1973. After the discovery of the snail darter fish in the Little Tennessee River in August 1973, a lawsuit was filed alleging that the Tennessee Valley Authority (TVA)'s Tellico Dam construction was in violation of the Endangered Species Act. Plaintiffs argued dam construction would destroy critical habitat and endanger the population of snail darters. It was decided by a 6-3 vote, in which the U.S. Supreme Court ruled in favor of Hill, et al. and granted an injunction stating that there would be conflict between Tellico Dam operation and the explicit provisions of Section 7 of the Endangered Species Act.

The Old Forest Arboretum of Overton Park, one of the few remaining old growth forests in Tennessee, is a natural arboretum with labeled trees along trails.

The Old Forest Arboretum of Overton Park is a forest tract and natural arboretum located in Overton Park, Memphis, Tennessee. It is open to the public daily without charge. The forest was placed on the National Register of Historic Places in 1979 as part of the Overton Park Historic District. Tree identification began in 1997, with some 70 tree species identified by 2002 when it was certified as an arboretum. Today the arboretum contains walking trails with 49 tree markers identifying 32 species. Approximately three-fourths of the Arboretum was designated as the Old Forest State Natural Area in 2011.

Heckler v. Chaney, 470 U.S. 821 (1985), is a decision of the Supreme Court of the United States which held that a federal agency's decision to not take an enforcement action is presumptively unreviewable by the courts under section 701(a)(2) of the Administrative Procedure Act (APA). The case arose out of a petition to the Food and Drug Administration (FDA) by a group of death row inmates, who sought to have the agency act against states' plans to execute them by lethal injection. The FDA declined to interfere, a decision the inmates appealed unsuccessfully to the District Court for the District of Columbia. On further review, the D.C. Circuit Court of Appeals held that the FDA's action was reviewable and that its denial was "arbitrary and capricious". Citizens to Preserve Overton Park (CPOP) was a 501(c)(4) nonprofit advocacy group founded in Memphis, Tennessee, in 1957. CPOP is best known for its success at preventing the extension of Interstate 40 through Overton Park adjacent to the Memphis Zoo, through the landmark 1971 Supreme Court case Citizens to Preserve Overton Park v. Volpe. The nonprofit status was revoked by the IRS on 15th of May 2010 and posted 09 June 2011.

Sam Cooper Boulevard is an urban highway in Memphis, Tennessee, United States. The more recent western segment of the road follows a parkway design, while the older eastern portion, which was proposed and constructed as a segment of Interstate 40 (I-40), was built as a controlled-access highway, without at-grade intersections and traffic lights. The western terminus of Sam Cooper Boulevard is at East Parkway North. At the western termination point of the road there is a short concurrency of East Parkway North with U.S. Route 64 (US 64), US 70, and US 79. From its western end, Sam Cooper Boulevard continues east for 5.8 miles (9.3 km) to reach its eastern terminus at the I-40/I-240 interchange.

The Portage Glacier Highway, or Portage Glacier Road, is a highway located in the U.S. state of Alaska. The highway is made up of a series of roads, bridges, and tunnels that connect the Portage Glacier area of the Chugach National Forest and the city of Whittier to the Seward Highway. Most of the highway travels through mainly rural areas just north of the Kenai Peninsula, with the Anton Anderson Memorial Tunnel passing under Maynard Mountain, part of the Chugach Mountain Range. Parts of the route were first constructed in the early 1900s, and the entire highway was completed on June 7, 2000, as part of the Whittier Access Project. The Federal-Aid Highway Act of 1968 is legislation enacted by the United States Congress and signed into law on August 24, 1968, which expanded the Interstate Highway System by 1,500 miles (2,400 km); provided funding for new interstate, primary, and secondary roads in the United States; explicitly applied the environmental protections of the Department of Transportation Act of 1966 to federal highway projects; and applied the Davis–Bacon Act to all highway construction funded by the federal government. It established three new programs: a National Bridge Inspection Program, funding and fair housing standards for those displaced by federally funded highway construction, and a traffic operations study program.

Motor Vehicle Manufacturers Association v. State Farm Mutual Automobile Insurance Co., 463 U.S. 29 (1983), commonly known in U.S. administrative law as State Farm, is a United States Supreme Court decision concerning regulations requiring passive restraints in cars. Decided in 1983, one year before Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc., the Court found that the National Highway Traffic Safety Administration had not provided a "reasoned analysis" for rescinding regulations that required either airbags or automatic seat belts in new cars.

In public administration, administrative discretion refers to the flexible exercising of judgment and decision making allowed to public administrators. Regulatory agencies have the power to exercise this type of discretion in their day-to-day activities, and there have been cases where regulatory agencies have abused this power. Administrative law can help these agencies get on the path of following regulations, serve the public, and in turn, a reflection of the public's values and beliefs.

Bowen v. Georgetown University Hospital, 488 U.S. 204 (1988), was a case in which the United States Supreme Court held that agencies should not be presumed to have the power to promulgate retroactive rules unless that power is expressly authorized by Congress. Justice Anthony Kennedy wrote for a unanimous court that the Secretary of Health and Human Services had exceeded his rulemaking authority under the Medicare Act in promulgating a wage index rule in 1984 under which he would recoup Medicare reimbursements paid to hospitals, including Georgetown University Hospital, that had been disbursed since 1981 according to the pre-1984 rule. Justice Antonin Scalia concurred in the judgment, writing separately that, in addition to the particular language of the Medicare Act, the Administrative Procedure Act more broadly prohibits retroactive rulemaking because it defines rules as having exclusively future effect, as opposed to adjudicative orders.

<span class="mw-page-title-main">Memphis tanker truck disaster</span> 1988 explosion and fire in Memphis, Tennessee, United States

On December 23, 1988, a tractor-trailer tanker truck hauling liquefied propane crashed on an exit ramp at the Interstate 40/Interstate 240 (I-40/I-240) interchange in downtown Memphis, Tennessee, US. The crash ruptured the tank; the leaking gas exploded, setting multiple vehicles and structures on fire. The explosion propelled the tank 125 yards (114 m) into a residential complex and started additional fires. The accident caused nine deaths and ten injuries. The interchange where the accident occurred was considered unsafe and poorly designed, and had been the site of several previous accidents; it was completely rebuilt in the 2000s.
