Cockerton Judgement

The Cockerton Judgement of 1899 determined that it was unlawful for the London School Board to spend money raised in the rates to fund higher-grade classes in science and art, thus limiting them to providing education for the under 12s. [1]

Background

The Elementary Education Act 1870 (33 & 34 Vict. c. 75) had created local school boards to be responsible for the provision of elementary education. Some school boards also established classes for higher classes. These "higher tops" and even separate schools were provided for older pupils who showed ability and commitment, along with new types of evening school for adults. This competition angered churches who were lobbying for public money for the church schools, and some older grammar schools who were also having problems with finance. It was seen by leading conservatives as an unacceptable extension to local government, and an unacceptable use of the rates. [1]

The test case

In 1899, Sir John Gorst's private secretary Sir Robert Morant (1863–1920) engineered a test case in which a School of Art in London complained of competition from evening classes run by the London School Board. The District Auditor – Cockerton – ruled that the London School Board could not use the rates to fund higher-grade classes in science and art. The London School Board unsuccessfully appealed twice. A new education act was needed. [1]

Implications

The Cockerton Judgement halted advanced, or secondary, teaching fostered by the more radical and enterprising School Boards. It prevented school boards from funding anything but elementary schools. As an interim measure, the Board of Education established, by Minute dated 6 April 1900, a new system of "Higher elementary schools". The subsequent Education Act 1902 (Balfour Act), which Morant drafted, created all-embracing local education authorities which had a wider remit and powers to provide public monies to the church schools. Morant became Permanent Secretary of the Board of Education in April 1903. [1]

Local education authorities (LEAs) were defined in England and Wales as the local councils responsible for education within their jurisdictions. The term was introduced by the Education Act 1902 which transferred education powers from school boards to existing local councils.

The Illinois Community College System consists of 39 public community college districts, composed of 48 community colleges and one multi-college center where 3 of the community colleges offer additional classes. Thirty-seven of the districts have a single college; two districts are multicollege. Since July 1990, the entire state has been included within community college district boundaries.

The Education Act 1902, also known as the Balfour Act, was a highly controversial Act of Parliament that set the pattern of elementary education in England and Wales for four decades. It was brought to Parliament by a Conservative government and was supported by the Church of England, opposed by many Nonconformists and the Liberal Party. The Act provided funds for denominational religious instruction in voluntary elementary schools, most of which were owned by the Church of England and the Roman Catholics. It reduced the divide between voluntary schools, which were largely administered by the Church of England, and schools provided and run by elected school boards, and reflected the influence of the Efficiency Movement in Britain. It was extended in 1903 to cover London.

Education in Ontario comprises public and private primary schools, secondary schools and post-secondary institutions. United Kingdom enterprise law concerns the ownership and regulation of organisations producing goods and services in the UK, European and international economy. The existence of Catholic schools in Canada can be traced to the year 1620, when the first school was founded Catholic Recollet Order in Quebec. The first school in Alberta was also a Catholic one, at Lac Ste.-Anne in 1842. As a general rule, all schools in Canada were operated under the auspices of one Christian body or another until the 19th century.

Gerald L. Zahorchak is an American educator and the former Secretary of Education for the Pennsylvania Department of Education, a position he held from 2006 to 2010. Throughout the 1980s and 1990s, Zahorchak worked at various Pennsylvania public school districts in a number of positions, including teacher, football coach, principal, federal programs director, strategic planning coordinator and personnel director. Zahorchak worked as superintendent of the Greater Johnstown School District in Cambria County from 1997 to 2003, when he was chosen to be Deputy Secretary for Elementary and Secondary Education for the state. Governor Ed Rendell appointed him Secretary of Education in 2005.

<span class="mw-page-title-main">Elementary school (England and Wales)</span>

Elementary schools were the first schools in England and Wales intended to give a basic education to the children of working class families. At the start of the 19th century, the only schooling available to these young people was run by private concerns or by charities, and was often of a very poor standard. In the first decades of that century, a network of elementary schools was established by societies backed by the Christian churches. In an effort to expand this "voluntary" system, the government made grants available to these societies, initially for new school buildings but later towards their running costs. It became apparent that although this system worked reasonably well in rural communities, it was far less successful in the rapidly expanding industrial cities, and that Britain was falling behind the rest of the developed world. In 1870, an act of parliament established elected school boards throughout England and Wales, which were empowered to create secular "board schools" funded by local taxation where there was no provision by the church societies. Further legislation made school attendance compulsory, and eventually free of charge. The problem of how the education of older pupils should be managed was solved by abolishing school boards in 1902 and passing responsibility to local councils. Elementary schools were eventually replaced in 1944 by the system of primary and secondary education.

<span class="mw-page-title-main">Anthony John Mundella (journalist and educationalist)</span> English journalist

Anthony John Mundella, known as Anthony Mundella, was an English journalist, education reformer and campaigner for child welfare. After working as Private Secretary to his namesake uncle, Rt Hon Anthony John Mundella, a Liberal Party Member of Parliament and Cabinet Minister, he became a journalist and parliamentary sketch writer for The Manchester Guardian. He was elected Chairman of the Press Gallery. Subsequently, he was for 35 years Secretary of the National Education Association, and campaigned for a free progressive system of national education, publicly controlled and free from sectarian interest. He was well known in the House of Commons and much sought after by MPs and government ministers for his wide knowledge and expertise in educational reform and child welfare. It is said that he was responsible more than any other for the abolition of the injurious employment of children of school age.

A Higher Grade School was a kind of educational establishment which flourished in England from 1876 until shortly after they were declared illegal in the Cockerton Judgement of 1899. They provided educational services regarded as higher than that of an elementary school.
