Color consciousness

Color consciousness is a theory stating that equality under the law is not enough.[ further explanation needed ] It rejects the concept of fundamental racial differences, but holds that physical differences such as skin color can and do negatively impact some people's life opportunities. [1] Supreme Court Justice Harry Blackmun in 1978, stated, "In order to get beyond racism, we must first take account of race. There is no other way. And in order to treat some persons equally, we must treat them differently." [2] (Regents of the University of California v. Bakke).

19th Century

David R. Roediger in his book Wages of Whiteness, draws a distinction between black and white wage workers in the 19th century:

As early as 1807, the British investor Charles W. Janson published the indignant replies he had received when he visited an acquaintance in New England and asked the maid who answered the door, 'Is your master home?' Not only did the maid make it clear that she had 'no master' but she insisted, 'I am Mr. ____'s help. I'd have you to know, man, that I am no sarvant; none but negars are sarvants.' [3]

This distinction between free black and white wage workers shows a kind of negative color consciousness, in which the white "help" insists on being recognized as a white person, since she is therefore higher in the social hierarchy, even though she is employed as an unskilled laborer. This contrasts with modern notions of positive color consciousness, through such endeavors as affirmative action, to bolster those that had been handicapped by their race.

Regents of the University of California v. Bakke, 438 U.S. 265 (1978), was a landmark decision by the Supreme Court of the United States. It upheld affirmative action, allowing race to be one of several factors in college admission policy. However, the court ruled that specific racial quotas, such as the 16 out of 100 seats set aside for minority students by the University of California, Davis School of Medicine, were impermissible.

Racial discrimination is any discrimination against any individual on the basis of their skin color, or racial or ethnic origin. Individuals can discriminate by refusing to do business with, socialize with, or share resources with people of a certain group. Governments can discriminate in a de facto fashion or explicitly in law, for example through policies of racial segregation, disparate enforcement of laws, or disproportionate allocation of resources. Some jurisdictions have anti-discrimination laws which prohibit the government or individuals from discriminating based on race in various circumstances. Some institutions and laws use affirmative action to attempt to overcome or compensate for the effects of racial discrimination. In some cases, this is simply enhanced recruitment of members of underrepresented groups; in other cases, there are firm racial quotas. Opponents of strong remedies like quotas characterize them as reverse discrimination, where members of a dominant or majority group are discriminated against.

Karl Marx's theory of alienation describes the social alienation of people from aspects of their human nature as a consequence of living in a society of stratified social classes. The alienation from the self is a consequence of being a mechanistic part of a social class, the condition of which estranges a person from their humanity.

Whiteness studies is the study of the structures that produce white privilege, the examination of what whiteness is when analyzed as a race, a culture, and a source of systemic racism, and the exploration of other social phenomena generated by the societal compositions, perceptions and group behaviors of white people. An interdisciplinary arena of inquiry that has developed beginning in the United States from white trash studies and critical race studies, particularly since the late 20th century. It is focused on what proponents describe as the cultural, historical and sociological aspects of people identified as white, and the social construction of "whiteness" as an ideology tied to social status.

The matrix of domination or matrix of oppression is a sociological paradigm that explains issues of oppression that deal with race, class, and gender, which, though recognized as different social classifications, are all interconnected. Other forms of classification, such as sexual orientation, religion, or age, apply to this theory as well. Patricia Hill Collins is credited with introducing the theory in her work entitled Black Feminist Thought: Knowledge, Consciousness, and the Politics of Empowerment. As the term implies, there are many different ways one might experience domination, facing many different challenges in which one obstacle, such as race, may overlap with other sociological features. Characteristics such as race, age, and sex, may affect an individual in extremely different ways, in such simple cases as varying geography, socioeconomic status, or simply throughout time. Other scholars such as Kimberle Crenshaw's Mapping the Margins: Intersectionality, Identity Politics, and Violence against Women of Color are credited with expanding Collins' work. The matrix of domination is a way for people to acknowledge their privileges in society. How one is able to interact, what social groups one is in, and the networks one establishes is all based on different interconnected classifications.

Wage labour relationship where a worker sells labour to an employer

Wage labour, usually referred to as paid work, paid employment, or paid labour, refers to the socioeconomic relationship between a worker and an employer in which the worker sells their labour power under a formal or informal employment contract. These transactions usually occur in a labour market where wages or salaries are market-determined.

White privilege, or white skin privilege, is the societal privilege that benefits white people over non-white people in some societies, particularly if they are otherwise under the same social, political, or economic circumstances. With roots in European colonialism and imperialism, and the Atlantic slave trade, white privilege has developed in circumstances that have broadly sought to protect white racial privileges, various national citizenships, and other rights or special benefits.

Employment discrimination is a form of discrimination based on race, gender, religion, national origin, physical or mental disability, sexual orientation, and gender identity by employers. Earnings differentials or occupational differentiation—where differences in pay come from differences in qualifications or responsibilities—should not be confused with employment discrimination. Discrimination can be intended and involve disparate treatment of a group or be unintended, yet create disparate impact for a group.

Reverse racism or reverse discrimination is the concept that affirmative action and similar color-conscious programs for redressing racial inequality are a form of anti-white racism. The concept is often associated with conservative social movements and the belief that social and economic gains by black people in the United States and elsewhere cause disadvantages for white people.

David R. Roediger is the Foundation Distinguished Professor of American Studies and History at the University of Kansas, where he has been since the fall of 2014. Previously, he was an American Kendrick C. Babcock Professor of History at the University of Illinois at Urbana-Champaign (UIUC). Bruce Nelson is a professor emeritus of history at Dartmouth College. He is a noted labor historian and scholar of the history of the concepts of race and class in the United States and among Western European immigrants to the U.S.

Constitutional colorblindness is an aspect of United States Supreme Court case evaluation that began with Justice Harlan's dissent in Plessy v. Ferguson in 1896. Prior to this, the Supreme Court considered color as a determining factor in many landmark cases. Constitutional colorblindness holds that skin color or race is virtually never a legitimate ground for legal or political distinctions, and thus, any law that is "color conscious" is presumptively unconstitutional regardless of whether its intent is to subordinate a group, or remedy discrimination. The concept, therefore, has been brought to bear both against vestiges of Jim Crow oppression, as well as remedial efforts aimed at overcoming such discrimination, such as affirmative action.

The minimum wage in the United States is set by U.S. labor law and a range of state and local laws. The first federal minimum wage was created as part of the National Industrial Recovery Act of 1933, signed into law by President Franklin D. Roosevelt, but declared unconstitutional. In 1938 the Fair Labor Standards Act established it at $0.25 an hour. Its purchasing power peaked in 1968 at $1.60. Since 2009, it has been $7.25 per hour.

Garcia v. San Antonio Metropolitan Transit Authority, 469 U.S. 528 (1985), is a United States Supreme Court decision in which the Court held that the Congress has the power under the Commerce Clause of the Constitution to extend the Fair Labor Standards Act, which requires that employers provide minimum wage and overtime pay to their employees, to state and local governments. In this case, the Court overruled its previous decision in National League of Cities v. Usery, in which the Court had held that regulation of the activities of state and local governments "in areas of traditional governmental functions" would violate the Tenth Amendment to the United States Constitution.

Racial Culture: A Critique is a 2005 non-fiction book by American author and Stanford Law School professor Richard T. Ford which raises critical questions regarding the somewhat popular and common presumption of political multiculturalism that social categories emerge from as a result of distinctive cultural practices. Ford argues against legislation that prevents discrimination on the basis of cultural practices and details specific examples in support of this argument.

Califano v. Webster, 430 U.S. 313 (1977), was a case before the United States Supreme Court that was decided per curiam.

In the United States, despite the efforts of equality proponents, income inequality persists among races and ethnicities. Asian Americans have the highest median income, followed by White Americans, Hispanic Americans, African Americans, and Native Americans. A variety of explanations for these differences have been proposed—such as differing access to education, two parent home family structure, high school dropout rates and experience of discrimination and deep-seated and systemic anti-Black racism—and the topic is highly controversial.

In political theory and particularly Marxism, class consciousness is the set of beliefs that a person holds regarding their social class or economic rank in society, the structure of their class, and their class interests. According to Karl Marx, it is an awareness that is key to sparking a revolution that would "create a dictatorship of the proletariat, transforming it from a wage-earning, property-less mass into the ruling class".

Schuette v. Coalition to Defend Affirmative Action, 572 U.S. 291 (2014), was a landmark decision of the Supreme Court of the United States concerning affirmative action and race- and sex-based discrimination in public university admissions. In a 6-2 decision, the Court held that the Fourteenth Amendment's Equal Protection Clause does not prevent states from enacting bans on affirmative action in education.
