Consumer Protection Act, 2019 is an Act of the Parliament of India. It repeals and replaces the Consumer Protection Act, 1986.

Introduction

The Consumer Protection Act, 2019 was introduced in the Lok Sabha as a replacement of COPRA, 1986 on 8 July 2019 by the Minister of Consumer Affairs, Food and Public Distribution, Ram Vilas Paswan. [1] It was passed by Lok Sabha on 30 July 2019 [2] and later passed in Rajya Sabha on 6 August 2019. [3] [4] [5]

The bill received assent from the President Ram Nath Kovind on 9 August, and was notified in The Gazette of India on the same date. [6] The Act came into effect by 20 July 2020, while certain other provisions of the Act like establishing the Central Consumer Protection Authority came into effect from 24 July 2020. [7] [8]

The Act features focuses on giving customer more power by taking transparency to another level. In September 2020 government declared a new draft known as advertising code which gives customer protection against false advertisements. [9]

Provisions

The Consumer Protection Act has made it mandatory for every e-commerce entity to display the country of origin. [10]

Councils, Authorities and Commissions established

This act is also focused on continuing the formally defined institutions created by the CORPA,1986 to take up cases and decisions related to consumer protection. It allows the central government to move away the burden of establishing consumer protection laws from the parliament and the burden of litigation from the courts; by providing an alternate pathway for the governments and citizens alike to approach, deliberate, discuss and decide on matters related to consumer protection in the interest of consumers.

Consumer Protection Authority (Body)

This act also allows for the establishment of independent statutory authority bodies on both the levels of the centre and the state to have jurisdiction over consumer protection law and cases. These bodies have a wide range of powers, including but not limited to search and seizure, declaration of judgements, protection of good-faith decisions. These bodies have formal internal structure with their own investigative wing to conduct research into a particular case.

They have the right to recall goods, refer the matter to other regulators for investigating a case on all fronts, to issue directions and penalties against false or misleading advertisements.

Consumer Disputes Redressal Commission (Body)

This act allows for the creation of commissions to which consumers can approach and place their concerns on the levels of the district, state, and centre. They function in a manner similar to the courts, and have complete jurisdiction over declaration of case judgements. Their function is similar to ones defined in the CORPA, 1986.

Consumer Protection Councils (Body)

The job of the body is to advise the central government and the prime minister on issues to be mitigated and policies to made regarding consumer protection.

Rights of consumers

The consumer protection bill 2019 primarily defines the following consumer rights.

  1. Be protected against marketing of goods and services which are hazardous to life and property.
  2. Be informed of the quality, quantity, potency, purity, standard and price of goods and services.
  3. Be assured of access to a variety of goods or services at competitive prices.
  4. Seek redressal against unfair and restrictive trade practices. [11]

The National Waterways Act, 2016 is an Act of Parliament of India. It was tabled in Lok Sabha by Minister of Shipping, Road Transport and Highways Nitin Gadkari on 5 May 2015. A Member of Parliament in the Lok Sabha is the representative of a legislative constituency in the Lok Sabha; the lower house of the Parliament of India. Members of parliament of Lok Sabha are chosen by direct elections on the basis of the adult suffrage. The maximum permitted strength of members of parliament in the Lok Sabha is 550. This includes the maximum 530 members to represent the constituencies and states and up to 20 members to represent the union territories. The Muslim Women Act, 2019 is an Act of the Parliament of India criminalising triple talaq. In August 2017, the Supreme Court of India declared triple talaq, which enables Muslim men to instantly divorce their wives, to be unconstitutional. The minority opinion suggested the Parliament to consider appropriate legislation governing triple talaq in the Muslim community.

The Repealing and Amending Act, 2019 is an Act of the Parliament of India that repealed 58 Acts. It also made minor amendments to the Income Tax Act, 1961 and The Indian Institutes of Management Act, 2017. The Act was the sixth such repealing act aimed at repealing obsolete laws tabled by the Narendra Modi administration, and the first tabled during its second term. The government had repealed 1,428 Acts during its first term between 2014 and 2019.

The Code on Wages, 2019, also known as the Wage Code, is an Act of the Parliament of India that consolidates the provisions of four labour laws concerning wage and bonus payments and makes universal the provisions for minimum wages and timely payment of wages for all workers in India. The Code repeals and replaces the Payment of Wages Act, 1936, the Minimum Wages Act, 1948, the Payment of Bonus Act, 1965, and the Equal Remuneration Act, 1976.

The Transgender Persons Act, 2019 is an act of the Parliament of India with the objective to provide for protection of rights of transgender people, their welfare, and other related matters. The act was introduced in the Lok Sabha, the lower house of the Parliament, on 19 July 2019 by the Minister of Social Justice and Empowerment, Thawar Chand Gehlot, in light of the lapse of the Transgender Persons Bill, 2018. The 2019 act and the immediately preceding 2018 bill, were both preceded by a 2016 version. They were met with protests and criticism by some transgender people, lawyers, and activists in India. The 2016 bill was sent to a standing committee which submitted its report in July 2017. Following this, the Lok Sabha tabled and passed a newer version of the bill in December 2018. However, it did not incorporate many of the committee's recommendations. Although members of the opposition criticised the 2019 act and assured activists that they would not vote in favour of it, it was passed by the Lok Sabha on 5 August 2019 and by the Rajya Sabha, the upper house of the Parliament, on 26 November 2019. The president assented to it on 5 December 2019, upon which the act was published in the Gazette of India. It has been in effect since 10 January 2020 following a notification of the same in the Gazette on the same day.

Special Protection Group (Amendment) Act, 2019 is an act passed by Indian parliament in 2019 which reduces Special Protection Group cover to only Prime Minister, former Prime Minister and their immediate family members up to 5 years after ceasing post if they are residing at the residence allotted. The bill amends Special Protection Group Act 1988 which was in application.

<span class="mw-page-title-main">Personal Data Protection Bill, 2019</span> Data Protection Bill of India

The Personal Data Protection Bill, 2019 was a proposed legislation by the Parliament of India which was withdrawn. The bill covers mechanisms for protection of personal data and proposes the setting up of a Data Protection Authority of India for the same. Some key provisions the 2019 Bill provides for which the 2018 draft Bill did not, such as that the central government can exempt any government agency from the Bill and the Right to Be Forgotten, have been included.

The Central Industrial Security Force Act, 1968, is an act of the Indian Parliament through which the Central Industrial Security Force (CISF) was raised on 10 March 1969. The CISF is a Central Armed Police Force which specialises in providing security and protection to industrial undertakings and other critical installations including nuclear plants, space centres and Delhi Metro.
